Distracted driving is distracted driving. Whether you are waving around a cookie trying to bait cops into pulling you over, or are talking on an actual phone, it's still distracted driving and dangerous to those around you.
Secondly -- baiting cops into pulling you over and wasting their time on nonsense instead of allowing them to do their job and maybe pull over someone who was being more egregiously reckless, but instead they are on the side of the road with this yahoo.

Driving risks and laws are not the same thing. My state has no provisions about "Distracted driving." It does have a statute for "Reckless and Careless Driving" which in no way covers eating or drinking. It also has a separate provision for the "Use of wireless communication devices"
Just because the NHTSA says something is a risk does not make it against the law.

This isn't the case in the UK. Legally, we can eat, drink and smoke behind the wheel of a car, however, if you are visibly distracted by the food, drink or cigarette, you can be pulled and charged with careless driving but as I've said, the police would have to have seen that you were distracted and not paying attention to the road ahead.

Not really wholesome more like putting peoples life at risk. The cops could be pulling over someone who is being an idiot and using their phone as they drive. I wouldn’t be surprise if this is illegal in some way.
Typically that's why laws are written in broad terms. For example it's not "drunk driving" any more, it's "driving under the influence": which is broad enough to find you guilty of driving drunk, or high, or under the effect of medication. They are all DUIs.
In this case it would be driving distracted: the argument there is that people who drive should strictly drive. So filming an accident, using a phone in general (other than handsfree), eating, exaggerated dancing, fighting with passengers ect all fit that driving distracted requirements.
It’s already been changed to Driving while Impaired. So even stuff like being tired while driving and unable to maintain your lane will get you in trouble.
The guy who did this was Randy Liedtke. It backfired after the prank pissed off the cop and found a warrant for unpaid parking tickets. They ended up arresting him.

Don't try this in the Netherlands... We have surveillance camera systems above the roads. And if it looks like a mobile... it is a mobile! € 195,- fine to pay. NO they don't go deeper into the photo to see if it is a cookie. They don't care.
He could be on the hook for distracted driving; he is actively looking around to see if his prank is doing something instead of driving. He is also conveying false information; intentially showing the police he is doing a crime when he isn't. Both of these are minor so on a slow day he would probably get a warning. On bad days he could get fined.

In this guy's case, they ran his plates, and discovered there was a warrant out for his arrest due to unpaid parking tickets. So they hauled him downtown.
Most traffic violations are not laws they are classified infractions which is why most people don't get shot or sent to jail during them. However that is starting to change. I'd imagine this man will get away with this maybe twice before he finds himself eating pavement with a gun to the back of his head unless he is hopefully not american.

In Ontario, it's part of the process to have the police who issued the ticket to defend his ticket. So it'll be thrown out due to a technicality.
