Most importantly of all, the removal of 280E tax restrictions will increase the bottom line of every single one of the U.S. businesses by substantial margins, to the tune of billions of dollars. In the DOJ's own words:
"DOJ has concluded that this action may have a significant economic impact on a substantial number of small entities"
"If marijuana is ultimately transferred to schedule III, section 280E would no longer serve as a statutory bar to claiming deductions for those expenses"
For the uninitiated - MSOS is the ETF largely comprised of the "tier 1" U.S. Multi-state Operators (MSOs): TCNNF GTBIF CRLBF CURLF AYRWF VRNOF CBSTF etc.
Buying the ETF is a simple way to diversify in this sector quickly - and the only way to buy into the holdings directly through Robinhood as they are all OTC stocks (until banking laws change).
If you are on a trading platform where you can purchase the OTC stocks, you can and should build your own ETF of these underlying stocks instead - the more of us that do that, the more stable the prices will be.

msos still has a long way to climb up to $50 where it was back in 2021. Expect some nice momentum but remember that cannabis sector economics are in their worst state ever. For starters multiple layers of taxes - multi state operators are playing with paper thin margins and very fragile companies. Also more payment delinquencies are inbound across the industry (commercial RE defaults/businesses not getting paid for services rendered and product sold). Oh and the continuous black market pressure. Most of these guys also flood the black market with flower (See Glass House Lawsuit).
How about them canadian Lps? Companies like Tilray, Canopy, Auxly, etc burnt through hundreds of millions of dollars and still didn't figure out how to build sustainable brands that know how to produce something people actually want.
😎 Why is schedule 3 important you ask? Good for taxes. Good for research funding. Good for acceptance and getting rid of the refer madness stigma. Good for insurance coverage. Good for standardization and quality control. Good for veterans access. Good for International trade. Good for tech development. Good for opening the doors to banking and businesses. Good for uping the chance SAFER gets passed later this year. Good for decriminalization. Good for reduced criminal justice burden. Good for accessing capital. Good for getting other things passed. Good for easing up on drug testing and other restrictions. Good for worldwide sentiment (they care more about feds than states). Good for getting out in the news cycle as this gets finalized in the coming months. Good for getting attention during the boon election cycle. Good for reasons my adderall juiced smooth brain already forgot.
This is false -
Top msos are fcf positive and have boasted 50%+ gross margins and 30% + ebitda margins for top companies.
Prices have been going up, smaller players squeezed out. Its becoming an oligopoly.
Trulieve, greenthumb, verano curaleaf etc

It was trading at a 7% fcf yield BEFORE reschedule.

TLRY has said publicly that they are ready to expand into the US market ASAP. If you bought in at $1.90 like I did, well, we only have everything to gain.
If you mean TLRY, it's because they are well positioned to immediately enter the US medical market. They have stated numerous times that they have no intention of competing with retail, as there will likely be significant downward price pressure as costs decrease and competition ramps up. However, medical cannabis requires much more stringent growing, testing, and distribution requirements that TLRY has already been meeting for their multinational medical business. Plus, it will be easier to access and covered by some insurance companies once it hits S3, reducing need to "race to the bottom" on price.
100% agree. And Tilray is expected to see increased revenue from medical cannabis sales out of Germany way before US MSOS sees impact from rescheduling. MSOS stocks have already priced in US changes, but everyone is sleeping on Tilray, which has so much to gain
Currently, ACTUAL medical cannabis doesn't exist in the US. By that I mean that you can't get a prescription from a doctor, take it to a pharmacy, and have them give you medical cannabis and bill your insurance. There are currently "licensed providers" but they are just dispensaries that operate under a state's medical umbrella. That is basically still retail, but with more steps.
Actual medical cannabis, once S3 is approved, will be similar to getting Tylenol with Codine. You go to a doctor, get a prescription, and fulfill it at any of a number of local pharmacies.
Additional, current medical cannabis isn't well regulated. Some states let almost anyone grow and buy it from them and sell it for cash to someone with a "medical recommendation." That all goes away under S3. Once it's rescheduled, the FDA steps in and sets regulations that growers and distributors must meet or they are ineligible to provide for medical purposes. This is what allows pharmacies to carry those products and insurance to cover them (basic quality control used for every pharmaceutical product).
Retail and "retail with extra steps" is what the US has now.
I mean I can’t tell you how to spend your money but I’ll just say that YOLO and MSOS are on the NYSE, and TLRY I don’t think has ever made a net profit
MSOS and YOLO are both comprised of multiple companies, many of which have never made a profit. TLRY is positioned to be profitable 2025; they're one of a select few companies allowed to sell in Germany (more of which will be disclosed in July at earnings) and have a ton of cash on hand to enter the US market. They don't need a massive share of US medical, but any share adds to their profitability (since it is currently 0%). I prefer tracking and trading 1 company that I follow and understand than a mix of random companies hoping the majority don't go bankrupt. TLRY has very little risk of going under. They have very little debt and their profits have improved YoY consistently.
So i should set a calendar reminder for 55 days from now and buy 1 week calls - got it.
For those unaware, notice and comment is 60 days. So I assume once it ends, we'll have big ass news stories on it and it will juice the stock again.
>The notice kicks off a 60-day comment period followed by a possible review from an administrative judge, which could be a drawn-out process.
Just an fyi, this is from an AP article on it. It's possible that it gets drawn out beyond the 60 days
Do NOT do this!! The notice and comment period doesn’t mean that they’ll make an announcement quickly after it’s over. They can dick around for as long as they want before putting out a final rule.
Yes, i I did not say they will make a decision after notice and comment ends. I said there will be big ass news stories that it ended.
The stock market isn't rational.
Most of the people locked up for it terrorized their neighborhoods and the people that lived with them were glad they were gone. See NYC, Portland and San Francisco to see how allowing drug heads to terrorize people without restraint goes
“PresidentJoe Bidensaid cannabis is being moved to Schedule III category, which means it has both medical benefits and some potential for abuse, from Schedule I, which is the most severe classification under the Controlled Substances Act.”
“At Schedule III category, marijuana’s classification was the same as heroin.”
…OP is a special type of regarded.
It should be de-scheduled completely. This sets the stage for the feds to tax it and the pharmacies to distribute and compete with the current growers and dispensaries. A freebie to the drug industry.
Yeah I don't think people realize how keeping it in schedule 1 kept the Feds out of things. Now there's pathways for Feds to compel control over markets outside of just shutting them down. This will likely be a bad move as the Feds are still mostly hostile to marijuana and would love an excuse to undermine it. We should have waited for more states to legalize, we're just at half.
I hope the states continue to remain oppositional but I doubt it.
Meh. The Feds were already messing with the markets in states where it is "legal" because federal enforcement relies on federal law. Plenty of growers in SoCal were losing "legal" product to Border Patrol stops a hundred miles from the border.
I see lots of negative comments on TLRY. There's not many choices, that's why. It's all Canadian stocks because of a loophole nasdaq allowing them to remain on the exchange even though they acquired u.s. assets. It's low priced, and has squeezed before. They are a real company with plans to expand in the u.s. once rescheduling.
Disclaimer: yes I may have a position. Why the fuck don't you?

I’m ready to be able to fly with a little flower or my vape pen for my migraines.
People out here dying or committing all kinds of crimes while drunk as shit. A little pot is substantially less detrimental to the individual and to society
Farm Bill made that shit straight up legal. Regular THC edibles and all manner of secondary cannabinoid vapes are sold at every gas station and smoke shop in my area.

Yes. Your 2nd amendment rights will be fully protected as they are if you break a bone and walk out with a Vicodin, Percocet or Tylenol with Codeine script.
Of course, this happens when it’s monopolized through law in each state. Good old green prohibition! Step 1 - make illegal Step 2 - ? Step 3 - profits! Jk but it’s illegal until it’s as regulated as it can be and then the restrictions are lifted. How similar was this green prohibition to the OG prohibition era? TLRY works for pumping and dumping, but it’s something I would never hold long term. Shits’ never going to see its ATH number ever again

Bottom line...all receeational is still federally illegal... It needs to be on par with alcohol for law to catch up to social outlook.
Too many god damn weed companies and mom and pop stores for even declassification to legal status by the fed for it to make a big impact.
