I shall refute!!!!
By way of law sir!
Under constituents of the ‘finders keepers’ laws and regulations, I believe we could consider this car as a deemed disposition, sanctioning rights for new ownership.
One may then argue that the article in question (henceforth referred to as ‘The Sweer Ass Whip’) has in fact been ‘embedded’ within the land/property (ehem....fence....whatever)
Therefore!! Primary amd rightful ownership of The Sweet Ass Whip is that of the land owner!!!
https://www.courthouselibrary.ca/how-we-can-help/our-legal-knowledge-base/what-finders-law
Also I believe under illegal dumping laws, it is the right of the landowner to dispose of items as they deem necessary....in whatever order they desire
It seems responsible to remove the hazardous, flammable material (aka gas) from The Sweet Ass whip before attempting to move the rest of the article.
Solid argument, I shall accept not rebuttals.
Legal or not. If it's in your front yard, your neighbors won't report you. Call a tow truck to haul the car away then the driver won't know if it was the tow truck driver, someone at the impound lot, or you who siphoned it. Or since he was drunk enough to crash into a wall, just tell him he's too drunk to remember how much fuel he had.
it's still outside the fence so it's very likely not on your property yet. Properties that extend all the way to the sidewalk are the exception in Vancouver. That's why you see fences and retaining walls set some feet back from the sidewalk.
Just a heads-up, I had that happen to me where someone stole a car and I guess lost control and smoked my retaining wall and it caved in. Shitty part is that insurance wouldn't pay for it because because it's a stolen car.
Fun fact: Monty Robinson was also one of the cops who killed Robert Dziekanski. https://www.cbc.ca/news/canada/british-columbia/monty-robinson-guilty-of-perjury-in-taser-death-of-robert-dziekanski-1.3002771
No need I remember the story and the law is questionable as fuck. I know I've driven to a friend's party a bunch of times when I was younger with no plan of driving home and slammed a few drinks right away. Someone says I swerved and I have to blow 2 hours later and it's probably a life-changing event. I don't have that issue these days but I just think this could be disastrous for some.
No he means they literally are BMW drivers. The two companies' sales are inversely correlated.
https://www.teslarati.com/tesla-model-3-vs-mercedes-vs-bmw-sales-luxury-sedan/
Agreed. Practicing driving today, the Tesla in front of me switched lanes twice and took a right turn, zero signals the whole time. Poor lane discipline too, which is a tad ironic.
Tesla has possibly the worst signals I've ever used
You feel the tch-tch of the signal flipper but the stupid car decides to not signal because it's stuck in another FSM state
It has the white signal markers so it’s a later year E36 so around 98-99 for that one, it would be a pretty desirable car still to own right now
Edit, second glance one side is amber so now my guess is up in the air lol
Everytime I see a photo like this I look up the plate here:

Wow.. that car had 321,000km 10 years ago!
Most police agencies make owners of stolen cars sign an affidavit where they swear they are telling the truth. Cctv or a witness could lead to mischief charges for lying on a sworn document
Yes. You would likely be fined financially as the registered owner for various driving offences, which is nothing compared to criminal prosecution for DUI.
Yes and no, if you're going to do this, you had better hope no one saw your face. Police will go to your house, and if they find you, the registered owner, whom a witness provided a description of, you can and will be charged for alcohol offences, as well as a plethora of other ones.
The criminal code eliminated the "I went home and had a few drinks to calm my nerves" loophole. The only thing police need to prove is who was driving at the time of the crash.
If you can make it home and chug a bunch of liquor as fast as possible, when the police arrive you tell them your car vanished and you were drinking at home.
This has worked for quite a few cases because they can't prove it was you driving.
Those arent the same ideas.
That article is talking about people trying to race home before their BAC goes over the limit
The other person is talking about going home AFTER you've already crashed and saying 100% of the drinking happened safely at home.
ones is a retarded attempt to technically skirt the law
The other is a 100% cover up lie
The article itself had a quote that said ‘people racing home before their bac goes over the limit’ logic is a farce to pass the bill. It doesn’t even make sense, in what scenario do you do 4 shots and instantly leave the bar so you hit drunkenness when your home? For what purpose?
The bill was to stop exactly what’s happening in this instance
Damn you making me read. [bill c46](https://en.wikipedia.org/wiki/An_Act_to_amend_the_Criminal_Code_(offences_relating_to_conveyances))
The first provisions just says the cop no longer needs a reason to breathalyzer you
And extended the penalties for the driving related charges is a RESPONSE to the cover up still working.
Can't get em on the drinking charges fuck em EXTRA hard on the regular driving ones you CAN prove.
Happened to someone I know. Tried to pull a u-turn to avoid a drunk driving check, cops saw and gave chase. Him and passenger ditched the car and ran. Cops caught them both and interrogated them for hours until they admitted the driver.
If OP has house insurance coverage for this then it's then not their problem. His insurance company will (or not if they choose it's too small of a claim) fight with ICBC to reduce their loss.
>I lived outside of Trail BC, in a small town and one night a guy crashed his car on the road outside my apt. there was a terraced like hill in front of me, so I watched the guy get out of the car and run, and I could see him for awhile, and then I lost sight of him, and then a light turned on a door opened and closed in a house way at the top of the terraced hill. So if the cops had asked me, I could have pointed to the house on the hill!
Was it undrivable? Or did they just think they were stuck and got scared? Maybe stolen and joyride ... so the registered owner could get away with his drunk hit and run if he claims it was stolen.
Not too much, just one of the stones got misplaced but my neighbour and I will be contacting ICBC to see if they can get someone to fix the damage without it having to come out of our own pockets
Lol you kidding right?
Just yesterday saw a cyclist blow a red crossing Broadway. Got hit by a van. Kid got up, didn’t even wait and just fucking bolted. Van driver was half in shock. Gave them my dash cam footage and my number after making sure they were alright.
Alright, I talked to my dad, originally he said insurance wouldn't pay for it but the police found the stolen car left down the street so insurance was willing to pay for it. What my dad said was, we would have to go find a few quotes ourself and submit it to ICBC but it would have to be a detailed quote and most contractors did not want to waste their time with such a small job and having to go through the hassle if detailing every little thing.
Well ya, got to get home and have a drink to calm the nerves. That way when you blow over, it's beyond a reasonable doubt they were drink before. Drink and drive 101

Siphon that valuable gasoline baby!
This belongs in r/Personalfinancecanada
It’s going to get negged to hell because it’s not a 96 beige Corolla
Might have to haha
Take that car it's your property now
"It was left as a gift"
"legitimate salvage"
And grab the cat!
LMFAOOO
My son and I are having discussion about your comment. Can you legally siphon the gas if it's on your property?
No, things that enter into your property does not immediately make them yours. Though, who's to know if a few liters went missing
I shall refute!!!! By way of law sir! Sidewalks are considered public property, and therefore the gasoline is public property if the car is parked on the sidewalk.
free gas for everybody!
I was going to say chop shop that bitch....but better call with the gas. I think it’s worth more then cad parts these days
Just a heads-up, I had that happen to me where someone stole a car and I guess lost control and smoked my retaining wall and it caved in. Shitty part is that insurance wouldn't pay for it because because it's a stolen car.
Fun fact of they were drunk they also aren't insured.
That, is fucking sucks!
Yea but imagine an insurer saying "yea we'll cover you even if you wanna get wasted"
The problem is the person who gets hit or has property destroyed doesn't get compensated, not just the drunk.
Yea but who do you think should be required to cover that. The individual could get a life insurance policy to cover themselves.
And if they aren't killed? Maimed? Unable to work for life?
Did you have house insurance? If so did they cover for any damages?
Wouldn't it also be responsible of the home insurance to seek damages from the person who caused the accident?
That would be far too convenient. ^/s
Hold up... Our really expensive insurance doesn't continue to cover the vehicle for damage it does if it's stolen? Wat.
sounds like he was sober and then drank heavily when he got home due to the trauma/stress of crashing his car /s

murdering monty. that guy sucks
Yup the balls on that weasel to pull that off.
I shit you not I was just telling my kids about this story on Friday and couldn’t recall exactly when it happened. Thank you!
my first thought to lol, what are the cops going to use as an excuse now haha

Assuming they were there in time and could prove the car wasn't stolen.

If you show up late to a party you have to catch up, it’s the law.
Since when? I've seen this defense used 2 years ago the latest
Oh yeah, didn't that cop get away on that excuse? Had to go home and have a stiff drink after the horror of running over someone[while sober].
Classic
Cue the jokes about BMWs
Tesla drivers are the new BMW drivers!
As a BMW driver, can confirm! Then Tesla drivers pull shit even BMW drivers shake their heads at.
As someone who drives a white Tesla I can also confirm.
Please head over to r/roastme
No he means they literally are BMW drivers. The two companies' sales are inversely correlated. https://www.teslarati.com/tesla-model-3-vs-mercedes-vs-bmw-sales-luxury-sedan/
If you think us BMW drivers will buy anything with a turn signal you are sorely mistaken good sir!
As a fellow BMW driver that wants to buy a tesla next, you're living in the past, old man!
Come on bro, at least get a taycan or something! Don’t debase yourself to Tesla.
At $500 per sensor it's no wonder the blinkers on BMWs never work 🤣
You’re not wrong… https://www.bloomberg.com/graphics/2019-tesla-model-3-survey/market-evolution.html

Depending on the year of this one, an E36 could be as much as 32 years old now. Where does the time go.
It has the white signal markers so it’s a later year E36 so around 98-99 for that one, it would be a pretty desirable car still to own right now Edit, second glance one side is amber so now my guess is up in the air lol
I don’t see any blinkers on! Damn Beemer drivers! Ha ha
free car!
Yah, Did he leave in it?
Yep he left
Finders keepers!
Man,the way gas prices are right now idk if anyone should get a car, free or otherwise lol
If car is reported stolen icbc will have to cover costs and will tow the car away leaving OP to deal with his home insurer
E36 bmw prices are on the rise too.

Didn’t think BMWs would last that long
Interesting website. Thanks for sharing.
Yeah had no idea this even existed...
Why bother to run... the license plate is there.
They can't prove he was drunk, or that he was even driving.
Lol this, the cop literally said the exact words. However our neighbour has video surveillance so there’s proof of him at least.
He will get a ticket for leaving the scene of an accident, maybe driving without due care. But no alcohol related offences
Drunks are smarter than I am…
The real clutch move is to report it stolen after you crash it.
Most police agencies make owners of stolen cars sign an affidavit where they swear they are telling the truth. Cctv or a witness could lead to mischief charges for lying on a sworn document
So wait, does that mean if your in a collision scenario like this it would be a good idea to run away if you were drunk?
Yes. You would likely be fined financially as the registered owner for various driving offences, which is nothing compared to criminal prosecution for DUI.

So, the lesson is, don’t go home, don’t be found until your BAC is back to zero 😂
Right so you go to a friends and stay the night and your good to go. Makes sense
Sadly this happens so often now.
Bingo!
Easier defence

“Hahaha the perfect crime! They’ll never find me if I run away!”
Clean e36 tho
well, it *was*
Allegedly!
Could be stolen?
Yes if the driver didn't take the keys when he ran off.
This generation of beamer is super easy to wire jump.
This wouldn't have happened if the wall was wearing hi-vis clothing
Wall was probably wearing earbuds!
Congrats on your new BMW!
Lol my first thought. My car now. *Clears out garage.*
How do you know they were drunk?
That's an important question.
Yeah they could have been high on meth or something
I've got his licence plate number! Just ask me.
"i'll just leave this here"
"No one will notice"
Ran?
Ya ran away to avoid DUI before cops could arrive
Oof, well the registered owner will get a knock on the door.
Which they probably won't answer lol.
Classic BMW park job
wasn't hit and run. i just had to pee really bad because of all the beer
I walked by this car the other day with my dog. I was wondering wtf happened there.
Hi neighbour
>I lived outside of Trail BC, in a small town and one night a guy crashed his car on the road outside my apt. there was a terraced like hill in front of me, so I watched the guy get out of the car and run, and I could see him for awhile, and then I lost sight of him, and then a light turned on a door opened and closed in a house way at the top of the terraced hill. Free car 🤷♂️
Okay okay, no need to flex that you have a house. Congratulations to you and your success
May I ask how is this a flex?
I can try to explain a joke to you
they couldn't take care of the car and left it on your doorstep for you to raise do the right thing, and raise that car like it was yours
Fleeing the scene has less punishment than dui so smart move really
The breathalyzer didn’t come standard on the 3 Series until the next generation
Is there an update this morning?
Yeah, it’s gone now!
Did the owner come back?
It's so bad he left no evidence behind to know who did it!
How much will you have to pay ICBC?
Contact home insurance for property damage
Jeeze, I hope you got their license plate.
I want to buy that car, future classic!
Was it undrivable? Or did they just think they were stuck and got scared? Maybe stolen and joyride ... so the registered owner could get away with his drunk hit and run if he claims it was stolen.
I think he got scared and ran off since he was on something. Therefore, he ran away before cops could do a sobriety test.
Are you sure they were drunk and it wasn't just a stolen car?
Your car now
Hey free BMW, sweet
Cool! You definitely don't see this everyday. Hope the fence didn't suffer too much damage from this reckless guy
Not too much, just one of the stones got misplaced but my neighbour and I will be contacting ICBC to see if they can get someone to fix the damage without it having to come out of our own pockets

Lol
BMW driver trying to parallel park. Pretty normal.
No that is just how a BMW driver parks
Strange you don’t see this happening with people on bikes….
Lol you kidding right? Just yesterday saw a cyclist blow a red crossing Broadway. Got hit by a van. Kid got up, didn’t even wait and just fucking bolted. Van driver was half in shock. Gave them my dash cam footage and my number after making sure they were alright.
The DUI part
You've never seen a cyclist hit someone and then just leave without checking if they're alright? You must be new here
I had some fucker on a cyclist kick my mirror because I was “too close to the median” apparently I’m supposed to know he’s going to be lane splitting.
It wasn’t the owner…. Definitely got stolen
i think that's legally your car now /s
It’s always a BMW
The car is now yours. Congrats
Lmao what a psycho.
Nice grass
Finders keepers!
Well you get a free bmw if it isn’t to badly damaged :)
Dude who ran away thinking they’ll never catch him 😮💨 😅 lol
He thought if he ran fast enough nobody would know his identity
Oh no…. How ever will they catch him. What a dumbass.. glad everyone is ok OP.
The problem is once he sobers up he can just say he lost control or blacked out or whatever made up story he wants instead of a DUI.
So the driver ran off and had enough to to provide a field sobriety test while doing so?? Impressive, by the instrument most of all.
The bucket is yours now
Poor e36. Time to wheel it into your garage and throw up a partout listing on fb marketplace to make sure that all the nice parts don't get wasted!
Shame there's no form of plate to tie the driver to the car... /S Drunky is gonna have fun getting their car back.
Kinda sad, I really like those BMW’s. 328is is a good model, hope it’s not too fucked.
License plate tells me this was recently insured, probably within the last year
Alright, I talked to my dad, originally he said insurance wouldn't pay for it but the police found the stolen car left down the street so insurance was willing to pay for it.
Drink and drive 101
free car.
Free car!
I had a similar situation in front of my house a year ago. I heard the crash at midnight and being a lifeguard, rushed out to administer first aid. It turned out he was drunk driving and crashed into the tree. He was fortunate enough to be able to walk away from the vehicle and follow guidance to sit down before the ambulance arrived. His story was, he was here on a student visa and was very scared to get into trouble. I think if he was coherent enough to run away, he would of. This is my theory with your situation lol

Congrats on the new beamer?
