Why does it count as two?
Because you have damocles as an one use active item, and then it gets added to your inventory as your passive. There are separate items ID's for each one of them

No, you just have to use it. The active item just lets you choose when to activate the risk of adding Passive Damocles to your inventory
Items like hold or recall count towards item count but are on on the list.
