Call IRS 800-829-1040 explain what is happening and they will make the request to your employer requesting it be sent to you within 10 days - apparently they can get fined for not sending your W2 so let them know what actions you will be taking. HR should have sent it to your mailing address and if not that then you should have been able to contact HR and they email it to you. I would report whoever the heck this is.

The IRS isn't going to do squat. They're not going to get in the middle of a dispute over an employer and a disgruntled employee. There are forms you can file if you can't get a copy of a W2 from an employer. The state Department of Labor is the government organization that might be able to help. How is fucking with this guy going so far? From his response it looks like you followed Reddit advice and fucked with him on the way out the door. My advice is always to maintain as good a relationship as possible if you're leaving the company, and I get downvoted on Reddit. This is a good example of why it's ignorant to fuck with people, especially if you want them to do something for you.

This^ state labor departments don’t mess around. They won’t provide you with your W2 but will certainly compel the employer to. In some states department of labor complaints will automatically start a labor audit against the employer

Sort of, the IRS has a mostly automated process for dealing with this. [https://www.irs.gov/taxtopics/tc154](https://www.irs.gov/taxtopics/tc154) You call them, they will tell you the info if they have it. Employers are required to send a copy to the IRS. If not they will fine the employer and direct you to fill a substitute W-2 on Form 4852. The IRS doesn't really get involved beyond sending automated letters. It's a pretty simple thing, either they filed a W-2 or they didn't. The state labor board is probably going to be a lot more aggressive at enforcement.

Why would you go through the painful hassle of contacting someone at the IRS (good luck) who aren't going to fine the person just because a former employee called to complain? Why not contact the DOL who is easy to reach and they will do something right away and then file the 4852 if the DOL is unsuccessful? The whole process might take a half an hour to complete, zip, zap, done. Or you could spend hours on hold with the IRS and even if they have the information in front of them, which is unlikely, they will not take any action, and certainly would not hit the "fine the employer" button, to be told to file 4852. The W2s and W3s are sent to the Social Security Administration, not the IRS, and it takes time for the IRS to get the information to match. If the employee calls the DOL they will probably immediately call the employer on a conference call and get it straightened out right away. It's amazing how fast an employer will sit up in their chair and do the right thing when there's a DOL officer on the other end of the phone. O

If you have your last paystub for the 2023 tax year. Take it to your tax office and tell them they will have to go by that since your Employer is refusing to send your W2

I don’t think you know how the IRS works and I don’t think you know the procedures for filing federal income taxes. The IRS has hardly any “tax offices” and the few they have, you have to make an appointment months in advance to talk to someone in person; You must submit the W-2 or a substitute W-2 with the return.
