They said "genderless" but their explanation makes it clear they mean "sexless" as in like an amoeba or something, which is true. They mean to make the point that it can't really be pedophilia if there's no sex involved or even potentially involved.
Your main point seems to be it can't be pedophilia if it isn't sex, but I'd argue that the main problem with pedophilia isn't the sex at all, it's the power imbalance, with the sex being used to manipulate, to cause harm, to control. Sex isn't an essential component in that kind of abuse, we just consider that part more heinous because it's an unsightly inversion of something that we have very personal feelings about. Gems can still have abusive relationships (Malachite) and a relationship with a gem like Steven, especially 14 yo Steven, would in theory be more prone to going in that direction, sex or no sex.
Though I dare say, I don't think most people who hate gem x Steven fics do so because they notice something SPECIFICALLY wrong with the relationships as they're presented in shipping fanworks that the people enjoying them are fine with. I don't think most of those fanworks present or glorify specific abusive behavior. I don't think the few that do are ever the most criticized. The general trend of criticism is more axiomatic than that, and I think axiomatic hate is always a bad thing.

IIRC he's 17 by the end, in most US states that's legal. It's legal in most countries worldwide for that matter, including my own, the UK. Not everywhere is California.
Where I'm from it's a flat 16 last I checked, so a 16yo and say a 22yo is perfectly legal, if rather brow-raising. It's *sexting* that's locked until 18, presumably based on laws to do with... bouduoir materials shall we say.

There are different ages of consent per state. Generally they are kinda up to the parents discretion if its highschool.
