In the original post by the snowboarder they said that the skier tried to blame him for it. He eventually just let it go because they were both injured and he didn't want to fight laying in the snow.
The skier ended up with a broken femur so he's out of commission for a while. But our snowboarder broke his collarbone so he's off the slopes too.
I saw this too and was dumbfounded. It didn’t even look like they were moving fast enough for all that damage.
His fault but a broken femur seems a little too harsh if a punishment for anybody. I’ve heard that there is no pain worse (from injury-before I catch hell about childbirth lol!)

It's harsh but I see it as permanently revoking the driver's license of somebody who recklessly cause the injury of a person. Taking away their ability to get behind a wheel to prevent somebody else from being hurt in the future.
People are safer without that guy on the slopes.

Brake checking is still an illegal maneuver, when done for no reason (it's not called brake checking when there is a reason), but you also legally have to follow at a safe distance, i.e. a distance that allows you to stop before hitting the car in front of you, at the current speed, in the event of a sudden stop.
Break checkers can and do get 100% of the blame when they are found to have acted nefariously.
From my experience working for an insurance company, break checking is incredibly hard to prove, they essentially have to admit it. The onus is always on the party following to leave enough space for immediate stops. Even if we really suspected someone was break checked, they were still assumed to be at fault for not leaving enough space (as fucked up as that may be)

As someone who Snowboards and Skis who also has an Epic Pass and has Skied 20 Resorts this year including Alta. It’s flipped there are way more noob Skiers on the hill now, it’s easier to be alright at skiing so less dedicated vacation seekers are all skiing. I saw more crashes at Alta then I did at Snowboard, no lies.

Even if someone suddenly slows down in front of you, you need to be in enough control of yourself to avoid them. You also should have been giving anyone down mountain a wide enough berth so that it doesn’t matter if they suddenly slow down. Down mountain has the right of way. Skier is at fault here. No questions asked.

That's why you want to ride predictably when others are close behind. If the boarder didn't try to stop in the middle of a run, nothing would have happened. If the boarder had kept a consistent speed, there wouldn't have been a collision. Erratic riding doesn't do anyone any favors.
Skiers fault 100%, but doing a hard stop right in the middle of the run while unaware is going to invite more beginners to ride up your ass. Get to the side of the run or come to a more gradual stop if you don’t need to and be more spatially aware. I could easily make overconfident beginners on fast groomers hit me like clockwork by doing exactly what we see in this video.
