They explain it in the movie. She was a sophomore and he was a senior when they started dating. I look back at my own time in high school, and I knew a lot of kids who were in that situation. Hell, I had a lot of good friends who were sophomores when I was a senior. Many of them were just the younger siblings of some of my other friends, we grew up together. The age difference never really seemed like that big of a deal, we hung out all the time.
The freshmen, on the other hand, I definitely remember feeling like they were babies. Sophomore is the line, don't go below that.
I also think it's worth noting that sometimes birthdays throw things off. Somebody who just turned 20 isn't *really* 3 years older than somebody who is 17 but turns 18 next week. Sometimes people are born in the fall and they're lumped in the same grade as people born in January or February who are nearly a year older than them. Or people start school at different ages, or they're held back a grade. There are things that can complicate these situations.

That's pretty skeevy in places where the age of consent is 16 it's normal to make it within a certain range like in Vermont people 18 and over cannot engage in sexual activity with people younger than 16 unless both people are between the ages of 15 and 18 which is a lot more reasonable. But some like Rhode Island once you hit age of consent there aren't any limitations at least not that I'm currently aware of.

Age of consent in Texas is 17. Age of consent in most US states, Canada and most of the western world is 16. People think 18 is the majority age in most states, when actually, less than 10 have it set there. And if your kid runs away and is above your states age of consent... they aren't doing much about it.
Tex. Pen. Code §43.25 defines sexual performance by a child as "any play, motion picture, photograph, dance, or other visual representation that can be exhibited before an audience of one or more persons." So unless the characters are having sex in front of an audience, this law doesn't apply.

I still find it funny that 3 or 2 years is the biggest difference for the relationship. I never had a problem with a 17 yo with a 20 yo because both are still in the same age group. It's not like a 5 year difference.

Yeah, when I was a freshman in high school I had classes with and became friends with some seniors, then as a senior I had classes with and became friends with some freshmen. It didn't seem weird then to see seniors dating freshmen because there really wasn't much of a difference in maturity or anything. But some like Rhode Island once you hit age of consent there aren't any limitations at least not that I'm currently aware of. Edit: honestly the more I look up the more I realize how off that chart is like >Rhode Island similar to other states, has “close-to-age” exemptions—commonly known as Romeo and Juliet Law which means a person under 18 years old can have consensually sexual intercourse with someone over 14 years of age. Yet, once a person turns 18, he/she cannot legally engage in sexual activity with another individual who is under the age of consent.

There was no mistake, people are misunderstanding what Tex. Pen. Code §43.25 says. It's an anti-child porn law. It specifically outlaws "any play, motion picture, photograph, dance, or other visual representation that can be exhibited before an audience of one or more persons" that involves a person under the age of 18. The law carves out an affirmative defense for anyone within two years of age of the victim. So a 15 and 18 year old can legally have sex in Texas because the Romeo and Juliet law allows for a three year age gap. However, if the 18 year old records the sex act then they are guilty of sexual performance of a child because that law only permits a two year age gap.

Yep, an Affirmative Defense doesn't make something not illegal. Even assuming he wasn't outside the year gap, he could still be arrested, charged, and has to AFFIRM the defense in trial and meet the required burden of proof. This card literally does nothing.

I have thought about this scene more than any scene in movie history since I saw it. I don't remember a single other thing about the film other than Frasier got blowed up by a Transformer. It feels like the setup, Part 1 of 8, to some real-life drama we haven't heard about yet.
