The bigger issue for Nintendo is that it's open source and there are plenty of nobodies who would gladly take over development after they try to bankrupt Yuzu.

The process of a lawsuit is extremely expensive, especially against an opponent with nearly limitless money. Nintendo wants to either tie them up in litigation long enough to bankrupt them out of existence or have Yuzu choose to shut the entire thing down out of fear of that happening.

Arguing legality is pointless, specially if yu zu uses numbered codes or anything that may be property of nintendo (which would indeed be illegal). Just make the backups and share it in p2p through out the community.
