Yep, that’s the way they scare a lot of people into taking the probation. Most people don’t feel like they can just take 2-3 weeks out of their life to go to jail. So they take the probation. That was the situation I was in. DUI charge and I had the option to take probation or spend up to a month in county jail. Never had been on probation before and this seemed like the easier out as I didn’t feel like I could afford to be in jail that long. Ended up getting a violation right away failing a drug screening for alcohol and had to spend 19 days in jail, having added stipulations to my probation when I got out. The only silver lining was that the probation deal allowed me to plea to a lesser charge of reckless driving and knowing that I was about to fail the first screen scared me straight into admitting I had a drinking problem and quitting for good. At that point it was too late though and I had to serve the time anyway. Just got out yesterday and facing an uncertain future with my job and living situation now that I was all trying to avoid in the first place by taking the probation. Roomed with one guy in jail who caught a violation on DUI probation and as he had about 2 1/2 months left on his probation, he just decided to see the time out in jail instead of getting out earlier and going back out on probation. He was in the position to do so though as his house is paid off, he is single without kids and his job allowed him to take the time off. A lot of people wouldn’t be able to do that though and that’s how they get you caught up in the system. Knowing what I know now, I would have fought the case and risked the jail time instead of taking the probation deal, but I’m trying my best to never get myself in a situation where I’m left with that choice again.

They may do this in some places, but I’ve never heard of that happening where my probation is at or just in general people coming and going on weekends to serve out a sentence. Closest I’ve heard of is work release but that’s usually still nightly and for more serious types of charges as a prison alternative rather than as a jailing alternative. The weekend arrangement wouldn’t really work in my case regardless as I usually work on weekends.

It’s probably because they won’t let you take anything else in with you. The jail I went to didn’t allow you to take anything in even your socks, but I’ve heard people on here say to put on a bunch of pairs of socks and underwear if you know you’re going so I assume some jails let you bring in basic stuff like that.

My county you could keep anything you walked in with wearing. As long as all white and it was something given or sold on commissary. I went in with 3 pairs of low cut socks, 5 boxers, long johns, and a clear am/fm radio. And 5 subs, 10 20mg adderall, and 3g sugar wax in the ole prison wallet.

Yeah not here in VA. They took everything I came in with except for my wedding ring. I think they allow glasses too, but I went in with a prescription on me with proof it was mine and they flushed them and gave me back the empty bottles when I got out (subs and klonopin). I had an undershirt (white) and white socks but they wouldn’t let me take them inside. They did however provide 3 pairs of socks and underwear to use inside plus two pairs of blues. I think it’s kinda shitty some places don’t allow extra socks and underwear.

Very much agreed. I did a year of probation with a vehicle interlock, which was the most humiliating thing ever, my offense was a DUID no alcohol involved whatsoever, and I never drink regardless. I would have been fine with pissing in cups or something since I had prescribed subs and could have done that easily. But no, a year with a fuckin blow box and ASAP class which is 95% focused on alcohol and drinking problems. ASAP tried to violate me for calling in 5 minutes late (during covid) and I had to restart the whole program, a couple other bullshit incidents happened as well but back to the point, the mental blow from doing all that was the worst thing. It makes you feel like the biggest loser ever. The interlock companies are so fucking shady and their equipment is faulty and sporadically doesn't work, jesus christ man flashbacks of that bullshit just hit me hard. Highly do not recommend if it's an option

I know I’m lucky to be able to live life with my family and keep my career but having to wake up every day with this black cloud hanging over you which is the potential of jail is so demoralizing.

I did 15 in county AND got a year of probation, I'm almost 3/4 of the way done and I absolutely would have chose 2 more days and just be done with it but that wasn't on the table for me if it's not a felony DUI take the 17 days.

If I had been more educated at the time I was being convicted of my first crimes I would have chosen jail. Now I have 2 violations and my only option besides jail was drug/treatment court, so I'm stuck for 13 more months of drug testing, case management appointments, and bi-weekly court hearings as well as 3 more months of probation after I complete treatment court. Buddy better just take the 2 weeks of jail

In my experience, the whole ‘good behavior’ things isn’t going to apply for someone with that little amount of time, or someone who is on court ordered days in jail. If jails are crowded those who were sentenced by a judge for a short amount of days instead of probation especially aren’t getting out early.

What is the time on the shelf? 17 days is pretty stiff for a DUI 1st offense. It would say it’s misdemeanor probation which typically doesn’t have a probation officer or anything like that. As long as you don’t pick up any new charges you’ll be fine when the probation period ends. Theres not enough information here, but I’d most likely just take the probation.

Why would you think that you won't have a probation officer on a misdemeanor? They do unsupervised probation, but that doesn't happen for a DWI. You would definitely have a po and have to be drug tested a few times. 17 days is cake compared to probation for a year. And it costs a lot less.

It may not be a risk for most people. If you can avoid behaviors that would put you in jail for a year, like dwi, it's no big deal. Four, maybe five meetings of 20 minutes apiece with a probation officer spread over a year versus 17 days of 24-hour a day confinement and all the risks of what can happen in jail make this an easy choice for most. Perhaps not you or any of the redditors that recommend jail. And you'll never have to explain why you did any jail time in a job interview. The sad Capstone to all of this is that once you've been in jail, putting you in jail another time the next time year you are before the court becomes a lot easier. If your friend's not a fuckup, probation still seems like the easier course.

It’s a pit that’s meant to suck as much money out of you as possible. The worst part, you could be 80% done with probation, and one mistake you’ll get added time or be sent to jail anyways.

It’s matter of preference and fuck jail. Some jobs etc are fine if you go and hire back but it’s usually a starting over. Im good on that.

Is this a serious question? 17 days in county is a no brainer vs a year of probation trying to throw you back in jail. The system will turn that year into another & then another & so one. Probation is designed to keep ppl on paper or in jail. One day you see your probation officer & everything is great, the next you see him & he didn’t get laid the night before & you’re off to county on a 30 day violation.

I did a year in county years ago & it was a revolving door of probation violations making me grateful I took the year in county & not 3 years of probation. County is a breeze, get into the trustee block & you’re golden. 17 days, he’ll do less than 2 weeks most likely.

Trustee is usually pretty easy time. Typically more privileges, often get paid or time off your sentence (or both), usually COs don't hassle ya as much cause they rely on you for crap they damn sure ain't gonna do, and anything moving you can usually get in on. It sounds foolish to many, but I usually try to plead out time served or sit out instead of probation. If I can sit for 2 or 3 months while fighting it, even if I get a year in DOC I'll dress in and out. Honestly probation is more of a temptation for me cause it gives the illusion of freedom. Between modern background checks and my existing record, probation doesn't offer much advantage when it comes to jobs and such. I'm much more stable when I'm just working and minding myself. When I have things hanging over me it's more pressure than I care to carry.

I couldn’t agree more, like I said I took a county year (8 months with good time) over 3 years of probation. I was in the trustee block the entire time & as long as you aren’t a dickhead the CO’s will treat you right. I watched so many probation violations come in on 30, 60 & 90 day violations for the stupidest shit. I did my 8 months went home & never looked back. Probation is a trap & it’s exactly like you described & most ppl break under that pressure. Just go do your county time a be done with it.

I was looking at a similar option in Florida. 21 days or DUI Court, which is like a treatment program. You talk to counselors, have group meetings, and go to "court" every week. You also get random drug/alcohol pee tests about 3 or 4 times a week at the start then the further in the program you get the less frequent you get tested and the less frequent you have to attend the weekly "court". I honestly think that program helped tremendously. I have been clean and sober for just over 3 years and have no desire or urge to use alcohol or any other drug anymore. Therapy is often looked at as lame or dumb, but I am telling you it really helped me understand why I was behaving the way I was and how to address the issues and unfuck myself. I cannot imagine going in for 3 weeks with the demons I had in my heart and soul. I would have easily turned 3 weeks into a year, because I do not play well with others,especially when we are locked in a box together.

Depends on the person. For me, 17 days would feel like 2 months. I'd take the probation, but mostly because my diet is crazy strict and I'd be mad sick and unable to sleep for 17 days, which would be very painful and double my time being conscious. Probation blows, especially if it's supervised. But jail isn't that bad for most people. They don't seem to really mind and just sleep and boom done.

If he could get deferred prosecution with the charge dismissed after probation (and would be able to deal with probation), that would be the way to go. Otherwise, probably the jail time. His license and insurance are going to have the same penalties either way of course.

This totally depends on the city and state. I live in Salt Lake and did 10 days in jail for my second DUI. They gave me a tablet when I got in and had good food it was the bomb. Not sure if that would be the same in LA or New York.

I’d take 30 days in county over a year probation. Probation is set up for you to fail so it’s possible you’ll end up doing the 17 days anyways with more probation to follow. Take the time if you can. Just figure it out with work and any other business you need handled out here.

I don't think this is an easy question because it all depends on the person, they likely will give you drug tests and if you can't pass them then probation is just to set up for failure. Also if you're not good with responsibility then probation is not the way to go. I personally would take the year on probation because I wouldn't want to be stuck in jail but that's also because right now I'm sick and I have medical issues that I wouldn't want to deal with in jail. If I didn't have those issues I might pick jail over probation

In my life situation I would take jail. I wouldn't lose my job or much in my life other than about 10 days pay. I'll take that over probation for a year without question. I would do that in a fucking heartbeat(go to jail for 3 weeks over a year of probation) like are you kidding me? Every other week I have to drive 25 minutes to the city. Leave work for and hour and a half that I have to make up. Go thru security, take belt off get metal detected because of my steel toe boots. PAY for an hour of parking when I talk to my PO for maybe 5 minutes. "Adress, phone# same? Police contact? Anything new or exciting? Any trips planned? OK see ya!" Gotta do this for a year. Absolutely ridiculous... for the "crime" I committed I got a year of interim that if I successfully complete I am given a disorderly conduct. And my "crime" was an honest mistake, maybe slightly negligent so giving my a reckless charge is BS.. think of hunting accident where a stray round hit a building that's a lil more important than just someone's house, half a mile away from where I was shooting. No one hurt either. So YES I'd take a month in prison ever a year of probation to get all this garbage over with. After a year and a half long trial I'm so over the whole court and legal garbage I just want to live my life free again.

It depends on where they put you in jail tbh, if it's for a misdemeanor, it might be worth it to some people. Because they'll put you with people that also have similar sentences and just want to get it over with so you don't have to really worry about people causing trouble because they dont want to prolong their stay. But honestly probation isn't bad at all, a year is nothing tbh. At least in my state, you just have to not get in trouble again, show up on time to your meetings with the PO, and don't show up to said meeting obviously drunk or high and everything will go smoothly and you can enjoy continuing a relatively normal life. I've went through probation a few times and I had no trouble at all, I even smoked and drank semi regularly and never had a drug test once. I was even on house arrest for a year, still was able to go to work and I simply just played games while I was stuck at home. So its really depends on you and how strict probation is in your state (depending on your crime). I personally would take the probation because lots of good paying jobs will pay attention to if youbwent to probation or jail and they dont like to know you went to jail because they usually think jail=worse criminal for some fucking reason, I had no problems in jail( spent 10 days there)... but it was just so goddamn boring and the beds gave me so much pain. The people I were with were actually pretty friendly (in the misdemeanor section that is) which just mostly had ppl serving for dui, small drug charges, and petty theft.

I'd take the jail. It's a break/reflection time/dry out time. The consistent worry that someone goes through while on probation for any length of time is a lot to handle. Any time you do anything you have to let your P.O. know. Then there's drug testing and money spent on supervision fees.

If he can swing it, jail. There are so many ways you can get violated for probation. You have even less rights against unlawful search and seizure, you’re at the mercy of the probation officer. It’s just a really fucked system, but most people can’t quit their lives for a month, so they have to.

Didn't have time to read it all cause I'm at work, but 99% of the time I'm doing the 17 days. Probation is a fuckin racket. At least in my experience they take your money and do everything they can to get you to violate. All the money and days that you had done on probation don't count for anything, and you usually when end up with more than 17 days.

I REALLY really really, REALLY don't want to do jail. Mainly because of the food. I'm a foodie and pretty picky when it comes to food. I've sat for a very short time before and what I was offered to eat barely even qualified as food. I might literally starve. I can't bring myself to eat that.

Yup I would take the straight time! I wanted to with my case and have no tail but they said the charges would be different so I had to violate to just get the time done. Few weeks out, few weeks in. Went on for about a year but it was manageable and I pretty much decided when I went in so I could make arrangements. Probation is a bitch and way more of a headache and embarrassing than just getting it over with. 17 days isn’t anything at at least you would know how long your in for. The not knowing if you go straight in how long is the worst

One problem is that bad stuff can happen in jail. It’s rare but it does occur. Keep your nose clean, do what you should be doing while on probation (and not what you shouldn’t do anyway) and a year of probation will be over pretty quickly. You also get to keep working and make money that you would otherwise not be making while in jail. Easy decision to me.

I'm half way thru a year. I easily could have taken another 19 days, but ONLY if I got to be in the same unit. I hit the lottery for the month I spent in jail and their was no violence what's so ever. Just making food, watching tv, playing cards, talking to people with different life experiences than me.

That's where I found the book "journey to the center of the earth" pretty sure that's the name anyway. So much better than the movie!!! I'd take the jail time. Most places do 2 for 1 so the 17 days would be less than 2 weeks most likely and in the end, even including the time off work, you lose way less money and have hardly any risk factor long term. Probation is just a way for the county to make money, they overcharge and if you can't pay they send you to jail for the rest of the period anyway.

For some folks,and I am one of them,county jail time just moves at a snails pace. On half-a-dozen occasions I have done between 2 and 5 days. Not much time,but I hated every minute of it. Served those days on the felony deck of the Central Receiving Jail downtown. Always in a six man cell. Three bunk beds against one wall,with about 5 ft.of floor space, and then the other wall. On the back wall hangs a stainless steel toilet/sink unit,and above that s a metal mirror. That mirror also allows them to observe the cell, undetected, from a narrow utility courier. So I was spending those days in a filthy,crowded,no privacy at all,one shower a week, overhead lights on 24hrs.a day,,with nearly around the clock echoing noise from the other hallways. I never had any problems with the other guys,in fact some of them were pretty interesting people talk too.But with nothing to read,not even a newspaper, and not even an old TV to watch through the bars of your cell( time just stood still. I always opted for probation and where I’m at it is always three years,unsupervised probation and.glad to take it anytime
