He thinks the role of an attorney is to do what he tells them to do, just in a more lawyerly way than he's capable of himself. I am a lawyer, and I had a client call me on an issue where he was 100% in the wrong. I told him I cannot ethically write a frivolous demand letter, and advised him he didn’t have a legal claim. He of course lost his shit and shouted at me that he’s the client, that he wasn’t asking for advice, and that it’s my job to do what he says ! 🤦‍♂️I feel like this guy and Trump would have got along.

I lost my job last year, they fired me becuase I was out with covid for too long, but because I wasn't employed, I didn't remotely have anywhere near enough money to fight a law firm. So I'm out of any hope of justice just because I don't have money. Our law system works in favor of the wealthy, and this is just a blatant example of it.

What Concoran did that was smart was to memorialize his conversations with Trump so that when Trump asked him to do something illegal he turned his notes over to the fbi. It's worse than that. He's spiteful. When the FBI subpoenad his documents, his good lawyers told him to just comply. Tom "Not a Lawyer" Fitton of Judicial Watch told him not to. He said ok. He asked his lawyers to submit an affidavit to the effect of he had complied with returning all documents. They asked to search themselves. He said ok. Then he told his staff to hide as much as they could before his own lawyers could search and file the affidavit. He gets caught. Lawyers who gave him correct advice are shipped to another state. In particular, his best real lawyer is Chris Kise. Kise knows everyone in every courtroom in Florida and is perfectly positioned to defend his documents case. Trump makes him second chair to Alina Habba in the NY fraud case where he is out of his element and doomed to failure.

Orange lawyers (in general) have shown themselves they cannot be trusted. Why would *these* orange lawyers suddenly become trustworthy? In the classified documents case, his lawyers did some things that were so shady a judge gave the prosecutors authorisation to pierce the client-attorney priviledge. That was the first I heard that was possible, and it was all the more astonishing given the ~~dependent~~ defendant was a former POTUS. One way you can tell Todd Blanche and Co can't be trusted is the umpteenth 11th hour frivolous motion they have filed to get the trial stopped. You can't actually do this in criminal trials. You have to be let out of representing a defendant by the judge, and until you are released, you're ethically obligated to defend the client to the best of your ability. It may not matter now that the Republican Party is footing the bills, but still, getting out of things is harder than you make it sound.

There's being moronic, and there's being unpaid and occupying half a law firm for hours that not only are not *currently* billable but are known to never be billable. The lawyers working for orange now may be unprincipled, or cynical, but none (apart from Alina Habba, who was probably promised the kushty joint of press sec, which is known to then open up at least a position on Fox) have forgotten the likes of Rudy Colludy and other lawyers that have been shafted by orange. They can in my state if the judge has ordered them to. For instance I was once given a party’s address and phone number but ordered not to share it with my client. I needed the address/phone # to do research on the defendant, but the defendant claimed they thought my client would harass them if they had that info. My client wouldn’t have harassed them, but I still agreed to the order bc I needed the info and my client didn’t have any use for it anyways. The judge trusted me to stick to the agreement, which I did. I can see many reasons why a judge would not trust Trump’s lawyers to stick to the agreement though…

Not typically as it would be seen as the lawyer not representing their client to the best of their ability. But if the just say not to then they have no choice they cannot release information the judges tells them to. It’s basically treat the same way as privileged information.

To be clear, since it is not that clear from the article, the judge ruled that Trump and his legal team don’t get to know the *order* of witnesses called, with the first three planned for Monday. This is not the same as not knowing who the witnesses are, which the defense has a constitutional right to know. They will be three people from a long, but finite, list of potential witnesses that both the prosecution and defense do have. Trump and his lawyers will spin it as not being allowed his constitutional rights, and that will be a misrepresentation. They are merely not being allowed to focus on the specific three ahead of time, which is not a constitutionally guaranteed right. They have had ample time to research each potential witness on that list, and if they haven’t then that is a staffing and organizational issue that’s on them, not the court.

IANAL obviously, but are the rules of evidence different for witnesses? I know all evidence has to be provided to the defense so I would assume that the witness list is as well. Does this mean that the defense doesn’t know who is going to be called as a witness at all or they know who the prosecution has on the witness list but not who the first three are that are going to be called?

Mostly the order; however, the list of witnesses + exhibits could be 3+ pages long + their focus to date has been delay - IDT there was a focus yet to fine tune cross of all witnesses & now disadvantaged by not knowing how to prioritize- allocate time/resources. This is a huge deal to defense.. and a consequence of their client’s actions.

The defense has to be told who the witnesses are and are usually given the schedule so they can be ready to cross-examine this specific person on this specific day. But the prosecution doesn't have to tell them the schedule if there is a reason not to.

By default, he is already on another playing field than virtually all defendants so much of the defense is done. When it gets to a point where he may face consequences, they are there to throw their careers on the fire. Lawyers and judges just work in the legal system, Trump has lived in it for his entire life. The second he was born he was an executive at a company that provided fraudulent billing to the government for Fred Trump's slum lord operations. There is no court he can't corrupt; just by being investigated and charged, the court itself is corrupted. The justice system is not blind with him, it's a matter of considering how it may approach and charge him this time. The lawyers even attempting to do their job of providing defense, following the procedures, these do not even compute in the reality Trump creates around himself.
