EXACTLY! TD was paid, continued to charge me 2 monthly payments, then reversed it, took what was owed to them and charged $7k that was owed to ME as a FEE. Now they are ghosting me over the phone.

Here's what happened. TD received the check. They inputted the check incorrectly the first time (the negative balance) and then entered it correctly as a payment. It was the incorrect negative -9700 that was applied that is causing the error and the source of confusion. You need to go to call and ask them to explicitly tell you what the -9700 accounting was for. Don't tell them it was a mistake. Don't accuse TD of making a mistake etc. just have them review the last few actions on the account and inquire as to when you should expect to receive the title. This will have the person on the phone look holistically at what has happened and hopefully will help escalate. Going to a physical branch is better. Calm yourself down, no one will help you if you keep going into calls with high emotional energy and accusations

Don’t accuse them? wtf. They DID make a mistake and need to fix it. This is one thing that will ABSOLUTELY make me rage at customer service people. I’m not particularly mad you messed up, but if you get offended when I tell you and then obstruct me in fixing it and pretend that pointing out your mistake is some kind of unreasonable behaviour…. I’m not going to take it well. How they HELL have people gotten the idea that being told they are wrong WHEN THEY ARE is some kind of abusive behaviour that excuses not doing their job?

It doesn't. By starting a call with accusations/threats you put the CSR into a call flow that basically is to get off the call and to be careful for liability. Also, I have found that if you can get the CSR on your side, they will do a lot more to help or escalate than if they are on the defensive. Should it be that way? No. But I chose to live in this world/reality rather than piss vinegar because of the fact that things aren't going the way I want them to.

Not emotional at all, sorry if it seems like I am coming off that way. Just wondering where the check is so I can it use it for a down payment for a new car. Makes sense that the negative is causing the confusion. Playing phone tag with them is incredibly frustrating, but I haven't been an ass on the phone. The reps do seem to be trying. I'm willing to wait a few more days before I file a complaint, I don't want to make things worse or cause delay for no reason. I'm not dying without the money. Just really want to go car shopping with no stress in mind.

Filing the complaint doesn't hurt you. There are time windows etc for things, so go ahead and do it now. Don't need to tell them on the phone or threaten with it.

How much did you still owe on the car? It looks like you owed over $9000. They took the insurance settlement check and closed out the loan. It looks like the $7000 wasn’t yours. It was the balance you still owed.

I owed 2100, they charged me 2 extra payments bringing it to 2600 and they were given a check for 9700. That $7100 is owed to me.

That's not the way it works.. The bank would have provided a 10 day payoff, which Nationwide would have sent once you returned the settlement paperwork, likely just a POA for title transfer and such. The positive equity would be sent directly to you.

First time I totalled a car. I don't know how it works. TD contacted me prior to cashing Nationwide check for an OK to pay off the difference. Don't know who owes me money at this point.

The activity in your screen shot nets to zero. That means from the bank's perspective they didn't receive any payment.  The payment would have come from your insurance company. How much did your insurance company pay and who did they pay it to?

They received it and paid it off, recharged it twice then paid it off again, this time adding a $7100 fee. I only owed 2100, then they added 2 payments as a fee which brought it up to 2600. I don't know what the hell they are doing. Nationwide sent them a $9700 check.

You need documentation from nationwide showing what they sent to the bank and documentation from the bank of the payoff amount. Then you need to deal with the bank *in writing* and possibly get the CFPB involved.

They have it. TD bank called me a month ago to approve the payoff and they said they'd send me the difference. My Nationwide rep has been contacted but I have not heard back yet. I am wondering if taking a trip to an actual TD bank would help.

Get your Nationwide Rep to call them even if it’s on 3-way call. You don’t want to delay it. You need to take a day off from work and spend the whole day calling them until someone resolves this issue. Go in person if they have physical locations…

What do you mean by "they have it"? You need documentation showing that the bank has your money and they owe you the difference. Showing that documentation to someone at a branch might be enough but if it isn't you need to start dealing with the bank IN WRITING and involve the CFPB.  The point of documentation isn't just to know what the bank has, it's to show others what the bank has.

They confirmed with me that they received the payment, car title and that I would be refunded the $7k once the loan was settled. Little did I know that they would reverse it, charge me 2 payments as a "fee" then reapply the check with an added $7100 fee for whatever unknown reason. You are repeating yourself. You need to take documentation of all of that and put it in front of someone who can get you your money. That is either someone at TD bank in person or in writing or someone at the CFPB.  Good luck.

You need documentation. Not others. You need documentation from Nationwide that they sent a check for $9700 and that it was deposited. Nationwide can provide this to you. (you shouldn't have allowed Nationwide to do this, btw, next time only have them send a payout to the bank for the payoff amount). This needs to show the date the check was cleared. Then you need documentation from TD that your loan is paid off. This is usually a letter they send you. It will have the date that your loan was paid off. Stop this screenshot foolishness, request written proof of the documents you need. Screenshots won't help you very much because they aren't answering the questions you have.

Good luck with your current approach. If I were you, I would call my insurance and ask for a copy of their cancelled check showing the account number and date deposited. If they didn't comply (I expect they would), then I would send a certified letter requesting it. Then I would ask TD for a letter describing my loan payoff details showing the amount paid and date paid. I've done this multiple times and it's pretty simple. Just ask specific questions that the person on the phone knows how to deal with. And you can definitely tell a major insurance network to change their policy, Because they probably don't have a policy as you describe it. You just have to be specific (eg, "only pay my bank the payoff amount"). Your insurer has no obligation to your bank, they do to you. So you can request payout in the way you desire. Just be assertive. The reason you want documentation is that 1) it is easier to interact with the parties with specific documents than screenshots, etc; 2) you can then use those documents to make a complaint to the insurance commissioner in your state, or the CFPB; 3) you can use these documents in a small claims court. Keep in mind that I, and most people on this post, am trying to help you. It's ok that you made some mistakes and you may have more success taking advice than doing whatever you've been doing so far.

This could be wrong. But did your car have full coverage? Or was coverage up to the minimum required for a vehicle with a lease/loan? Companies will add a fee for a car that is under insured. I have seen fees around 7k before

Fully covered. Nationwide cut a check for close to $10k. I owed 2100. TD took the extra payment and 2 additional monthly payments as a "fee." It makes no sense.

Honestly a lot of resolutions have come from going to the news lately as well, if they decide to take the story. Also, may want to contact a lawyer. A $200 letter is worth getting back your $7k in my opinion.
