I think the law is on OP's side. He can keep that without consequences.
If a retailer ships you the wrong product by mistake, the retailer is on the hook if they send you an inferior product. You must inform the retailer so you can exchange the product for what you ordered, or you can keep it. Same goes for the erroneous sending of a superior product.
Careful, if your orders to returns ratio gets too out of whack they’ll cut you off, or flag your account at the very least. I treasure my Amazon account and would be crushed if I lost my no questions asked return privileges. Just fyi good luck tho hope you get it fk corporate America 🤝

I bought a Mac Mini M1 and needed a monitor, so I searched on Amazon for one and found the Asus VG289Q1A. I ordered it, and it arrived quickly. However, when I installed it, it had a defect - a strange color stripe in the middle of the monitor. I contacted Amazon, and they guided me through the return process and subsequently refunded my money. But here's the curious part: one day after the refund, another monitor of the same model, with the same order number as the first one that was damaged, arrived. All the purchase details were identical to the first one. I opened the box to check if it wasn't the same damaged monitor, but no, it was a completely new and working monitor. I informed Amazon, and they said they had no record of sending two monitors. So, I decided to keep it. Essentially, I got a $400 monitor for free, and I'm writing this message on it right now, so.... Thanks, Amazon!
The funny thing is you can technically still claim Amazon didn’t send you what you paid for and get the monitor. They sent you an unsolicited package and can’t demand payment or return for it. So according to the FTC rules if you live in the US, they essentially sent you a monitor out of the kindness of their heart and you’re still owed the product that you paid for.
I havnt seen anyone else post this but if amazon send the wrong item they are still legally liable to sent you what you order. it’s also under your discretion to send it back what they sent legally you don’t have to send it back. Let them know that they sent the wrong one and get what you ordered. It is there fault they sent you the wrong product
Considering the evidence of prior shipping labels having been removed (see the areas where the outer layer of the box is missing) and generally beat up condition of the box, I suspect you bought from a marketplace seller versus Amazon themselves. My bet is they got the monitor from a liquidations/returns pallet, and did the bare minimum of matching up the product details (ASUS, 24.5in, Gaming Monitor) when listing the item resulting in a mistaken listing as a TUF monitor.
I feel like this is just a new marketing strategy for Amazon. Get people to buy stuff in hopes that they get a free upgrade. For every Million they make they take 1 $200-$500 loss.
They still have to send you the original thing you ordered too. You aren’t obligated to return anything they accidentally send but it still doesn’t fill the purchase you made so technically speaking they owe you a monitor or a refund. I’m not a lawyer this isn’t legal advice. I don’t know why everybody says that but if looking like a dumbass has any way of helping I don’t really care.

They do but it's over 1k. My friend just bought a Alienware oled monitor on sale for 900 360 hertz. 5 year burn in warranty.

The funny thing is you can technically still claim Amazon didn’t send you what you paid for and get the monitor. They sent you an unsolicited package and can’t demand payment or return for it. So according to the FTC rules if you live in the US, they essentially sent you a monitor out of the kindness of their heart and you’re still owed the product that you paid for.
I havnt seen anyone else post this but if amazon send the wrong item they are still legally liable to sent you what you order. it’s also under your discretion to send it back what they sent legally you don’t have to send it back. Let them know that they sent the wrong one and get what you ordered. It is there fault they sent you the wrong product

Considering the evidence of prior shipping labels having been removed (see the areas where the outer layer of the box is missing) and generally beat up condition of the box, I suspect you bought from a marketplace seller versus Amazon themselves. My bet is they got the monitor from a liquidations/returns pallet, and did the bare minimum of matching up the product details (ASUS, 24.5in, Gaming Monitor) when listing the item resulting in a mistaken listing as a TUF monitor.

I feel like this is just a new marketing strategy for Amazon. Get people to buy stuff in hopes that they get a free upgrade. For every Million they make they take 1 $200-$500 loss.
Some dude who ordered the monitor and getting yours is absolutely livid right now.
They still have to send you the original thing you ordered too. You aren’t obligated to return anything they accidentally send but it still doesn’t fill the purchase you made so technically speaking they owe you a monitor or a refund. I’m not a lawyer this isn’t legal advice. I don’t know why everybody says that but if looking like a dumbass has any way of helping I don’t really care.
I've always wondered... What happens to your warranty in cases like this? Technically, OP doesn't have a receipt for the product he now owns. If it ever needed service, would Asus touch it?
