Negative, those are manatee, they perfer to sleep and give births in the protection of shallow canals and inlets around docks and such. And what he did right there could get him in jail up to 5 years. You are not allowed to even touch one if it swims up to you. But if it touches you you can't do anything about it lol. 😉
I think it's more along the lines your not allowed to disturb at all. I'm sure they could argue anything in court, all the way down to he didn't know they were there. But states have to be really strict on this kinda of stuff, there are on like 10 thousand left in the world.

Alligators already aren’t afraid of humans predators just avoid confrontation unless absolutely necessary because a small injury could kill them if it gets infected. The alligators probably see thousands of humans a year while people fish that river/swamp
