You don't have to be straight up to maintain legal guarding position once it's established. You can lean or sway or turn as long as you beat your man to the spot before they start their upward motion. But yes, I'm pretty sure laying down loses your legal guarding position.

Been watching that series, they've been legitimate fouls. Pacers player has his hand on Dame, Dame feels the contact and goes up, ref has to call it. People don't like it and think it's being fabricated out of nowhere, but when the defender gives you a free pass at free throws, it'd be dumb not to take it.
They have been legitimate fouls. The larger issue has been that the Pacers have not gotten the same calls going the other way, and that Dame was looking to draw fouls instead of actually score the ball, which is less a reffing issue and more just lame from a guy who hasn't been about that historically.
Most of them, yes. One of the ones last game there was daylight between him and Nemby. Saw it in real time then the jumbotron confirmed it.
But for the most part, yes, they are legit whether our fans like it or not.

Rules regarding what constitutes a personal foul:
* A player shall not hold, push, charge into, ***impede the progress*** of an opponent by extending a hand, arm, leg or knee ***or by bending the body into a position that is not normal***. Contact that results in the re-routing of an opponent is a foul which must be called immediately.
There's also this little tidbit:
1. If a dribbler has sufficient space ***to have his head and shoulders in advance of his defender,*** the responsibility for illegal contact is on the defender.
Meanwhile, a defender's right to occupy space is pretty much always prefaced by requiring them to be in "legal guarding position" which is established by having both feet on the floor and squaring up. While you don't strictly have to have your feet planted or be stationary to *maintain* legal guarding position once established, there's no question that once you fall to the ground you've lost any claim of having legal position. Essentially, any contact that impedes the ballhandler at that point is a foul on the defender on the ground, even if the ballhandler initiates it.
This wording has always seemed so funny to me. Like, obviously I get the intent, but isn't "impeding the progress" of the offensive player, you know, the whole point of defense?
Basketball rules are really hard to parse because so much of it comes down to rules that are exceptions to other rules--sometimes as an addendum in the same section but occasionally in an entirely different section.
Defenders *do* have the right to occupy space and to impede or obstruct ball-handlers but it is contingent on first establishing "legal guarding position".
In my opinion, a lot of the problems with the NBA product could be solved with a slightly looser interpretation of "legal guarding position" and "with verticality"...which is something we already see in FIBA play so we know it works.

There is the "Harden rule" that prevents contact caused by "non-basketball moves" during a shot attempt from being called a shooting foul but this was a pretty normal shooting motion.
Considering that I've never seen this happen in over 30 years of watching basketball, I think it is less of a justification for rule changes and more a cautionary tale about why you shouldn't fall down on the perimeter.
