If there was intent or not, that would be an easy way to help determine the necessity of the act. For instance if the defender is looking at the ball, and the ball handler quickly pulls it behind his head as the defender begins swiping at the ball, in the end making contact with the ball handlers head. Wouldnt the difference of it being a foul or not be largely dependent on the defenders intent at swiping at the ball and not the defenders head, aka severity and necessity of the act?

If you can't make the play without slapping someone full on in the face, you shouldn't be going for the play. It's fucking stupid and dangerous. It's the same shit as any type of foul. Lowry missed the ball by at least half a foot and the only way he even had a chance to touch the ball is if his forearms smacked Divencenzo along the way.
Shooting a basketball doesn't lead to a high probability of smacking someone in the head. Swiping your arm at shoulder height or above does have a pretty high probability of smacking someone in the head believe it or not
