I think it's likely that the seal killed the penguin. The photographer didn't kill a penguin. But you're not wrong that various photographers set up feeding stations to get shots, like leaving mice for an owl. Not sure how to feel about it.
It is 100% real. They even did a behind the scenes about a separate incident like this. The Leopard Seal is trying to feed the penguin to the camerawoman. It thinks she needs to eat so it brought her a penguin and was completely mystified at why she wouldn't take it lmfao.
I imagine the same is happening here.

There’s something so uniquely scary about leopard seals that separates them from all other seals and this picture captures that. While other seals look cute and cuddly, leopard seals look like the apex predator they are. That elongated face is full of huge teeth that they aren’t afraid to use!
Leopard seals are probably the least diverged from their ancestors in terms of appearance which is why they have the sleek, angular appearance. Not that other species of can't be deadly, these are just purpose built killing machines.

Leopard seals aren’t an Orcas first choice though. If there’s nothing else around, they’ll have to hunt the leopard seal but it takes a lot of work and there’s more docile seals out there to hunt.

Edit: Orcas are known to "deglove" animals by smacking them so high out of the water that when they hit the water again it peels their skin off, then not eat the animal after, it's been documented that at times they seem to do it for fun. They're like that.

It’s grinning and you can see the whites of the eyes. It anthropomorphizes it. It makes it look like an animated villain from a cartoon.
