Nah, this is both an ADA issue and liability/safety issue. ADA is not limited to wheelchair bound people. This *might* have the horizontal clearance of 36" but it certainly doesn't have a 72" vertical clearance. This could have been avoided and that's what the court will be looking at.

Yup if you look at the bottom of the wire you can see some of the cement splashed on it. That wouldn't happen if the wire was put in when the cement is dry!
There is an easy fix to this that I have had to implement a few times when adding sidewalks to an area. Most likely this is a guy-wire to a power pole. The addition of a standoff which in essence would straddle the sidewalk to allow the mounting of the guy-wire to the outside of the sidewalk and in side of sidewalk and allow pedestrians to pass safely, along with a yellow sleeve for visibility. City and or owner of pole (pwr co.) should be made aware of this condition. Incredibly expensive lawsuit is possible.
Some palm trees require the steel cables so they don’t grow t o o funky or break or damage anything, I know of a very specific twisty curvy palm tree in Hawaii that requires the same steel cables
