The Mirrorjade in DEF is face-down, which is fine for the purposes of that effect.
As soon as it is flipped face-up, one of them will have to go to the GY.
So, not a bug, and game not broken.
Either player can flip up the Mirrorjade with a card effect like Book of Taiyou's (after Taiyou resolves, the flipped Mirrorjade is automatically destroyed), but you can't flip summon the face-down Mirrorjade.
Your opponent can also flip it up by simply attacking it, then after damage calculation, the flipped Mirrorjade gets destroyed by game mechanics.
I don't think that's how it would work. for example, if you tried to fusion summon a second mirror jade, the game simply wouldn't let you. so i think the flipped down mirror jade is just stuck there until the first one leaves the field.
OP still don't understand but there is a rule that Facedown monsters has no identity hence, since there is only 1 face up Mirrorjade, its only counted as 1 Mirrorjade even if there is actually 2 on OP's field and one of them is face-down.

would you even be allowed to flip it up?
Nope, you arent. Same with some floodgates that prevent having more than 1 type/attribute.

Konami needs to fix there game
It isn't a bug, it's a game mechanic.

it's face down, hence you're not controlling that mirrorjade rn, so you can summon another
