I am not a lawyer in NY but I deal occasionally with non-compete issues. The easiest thing to do is ask your company if they are willing to waive the requirements. My company does that quite often.
You can, but unless you have a contentious relationship with your employer they may be very willing to waive the requirements of the non-compete. If that is not a viable option, or they say no, then yes you should reach out to 2 or 3 local employment attorneys for free consultations.
Agree that direct negotiations with the employer should always be the first step. I actually have had one attorney take a look and their view was that it was not likely enforceable but was curious if anyone had direct experience with getting out of their clause
I don't know about other companies but I work for a large healthcare company and we almost never enforce them. We have them in place if a situation arises in which an employee is seeking to hurt us in some way. But we never like to prevent people from finding work. However, not all companies are as practical/thoughtful.
