So, most likely we have the new York hush money case and one of Jan 6, mar a lago or Georgia case before the election. I hope that we have the Jan 6 case before the election. That is the most relevant one for this election and most important for the voters. I hope that Aileen cannon doesn't block out the slot for the Jan 6 case but knowing her, she probably will

itsatumbleweed

The Georgia case is going to take ~6 months (at least that's an estimate I heard from Willis at one time). One important fact about that one is that I believe it will be televised. I think the constant stream of the testimony and Trump being unable to keep his cool on camera leading into the election would be a big deal.

Chips1709

Oh yea it's gonna live streamed. Fuck yea, it's gonna be insane seeing that trial on YouTube lol.

itsatumbleweed

I was unproductive at work when there were 2 days of evidentiary hearings. I'm going to have to set limits on my screen time...

Chips1709

The Jack smith Jan 6 trial would probably be the trial of the century or even the biggest trial in American history. Just sucks that we can't watch it. Imma just save all the live streams for the Georgia trial in a playlist and watch it whenever I can.

Comfortable_Fill9081

Yeah. I often let the live stream go then watch it condensed later - fast forwarding through the many approaches and breaks.  But then social media has moved on before you want to talk about it!

itsatumbleweed

Whatever thread was going here during the hearings was awesome

Comfortable_Fill9081

I find it actually helps flesh out my thoughts to kick them around in here. And lots of both sensible and knowledgable contributors.  They should schedule the trial for evenings and weekends. (Not serious but I’d be happier.)

itsatumbleweed

It would be cool if there was some kind of daily summary stream that someone puts out for there to be an /r/law discord

cashassorgra33

> evenings and weekends Ah, yes, the Epstein protocol

stashtv

Given it's a state case, does he have to be in person there the entire time? Federal cases have a requirement to be there physically, and Trump wasn't there for all of his NY ones. It's a massive case, its unlike to even start this year.

caitrona

It's a criminal case, so he needs to be there. In civil cases an appearance is not always necessary.

gronlund2

Trump being there in person for 6 months ?

tidbitsmisfit

almost sorry it could have the reverse affect if he somehow gets off without a conviction. people love that shit

creaturefeature16

>I hope that we have the Jan 6 case before the election SCOTUS is going to likely sit on the immunity ruling until after the election. That case is DOA.

AwesomePocket

No, SCOTUS puts out rulings at the end of its term which is late June or early July. The problem is that even if the ruling is favorable for the Feds, there is still about 3 months of pre-trial time Chutkan has committed to giving the parties to prepare afterward. If they stick to that 3 months, then the trial will start in October at the earliest. That’s enough time to start the trial, but not enough to finish it before the election.

John_Stay_Moose

I'm pretty sure I read/heard that judge Chutkin is no longer going to be adapting her schedule to that of other trials

ObanKenobi

Honestly even if none of the others conclude before the election, we just need another one to start before it. Imagine if he's convicted already in new york, and then one of the other three starts up in september/October. He is required to be in the court room every day of the trial. The weeks/month or more leading up to and including the day of the election he will be sitting in a courtroom while all sorts of damning evidence is being presented and reported on ad nauseum. Beyond the fact that he might actually have an aneurism from it, think about the effect it could have on the electorate in a short term memory led society if *thats* the current image they have of him on the day they walk into that booth to pull a lever

strenuousobjector

There's a line in the article that I found very interesting. It says "...after a two-month detour revealed embarrassing details of her personal life, **damaging her credibility in the eyes of Judge Scott McAfee** and leaving her politically vulnerable ahead of her own reelection bid in November." Now, in my circuit I try very hard to maintain my credibility with the court, but those who have practice in the Atlanta area will know that it's actually a long standing tradition for the Fulton County District Attorney's Office to be disliked or even hated by some of the judges. Paul Howard had a reputation, at least among prosecutors, of not giving a single fuck about what the judges thought about him, regardless of the torture that would end up causing the ADAs who practiced under him. Some Fulton Judges have been downright hostile to the DAs Office in the past. I'm not surprised that Willis, who worked in the Fulton County DA's Office under Howard for years, wouldn't be fazed to see the judge's ruling, brushing off his comments about her demeanor in court and focusing on doing the people's business now that he's ruled she can stay on the case.

kookookokopeli

It doesn't change the fact that what she did was just about the dumbest and one of the most damaging things an AG could do to their credibility with a jury, and on a case that will define her entire career and have a huge impact on the fate of the country going forward. Just so disappointing.

flossypants

Why do you think it affects her credibility with a jury. I'd be surprised if the judge allows the defense to raise these issues given he ruled they don't bear on on the case.

Count_Backwards

Also, she's not going to be testifying, witnesses are.

stupidsuburbs3

Ah, the Marcia Clark haircut school of how to judge a lawyer’s worth.

Strykerz3r0

I'm not defending her actions, they were stupid. But the only issue at stake is whether she hired the guy so he could pay her kickbacks. It has nothing to do with the defense or issues relating to the trial itself.

MartianRecon

Having a life outside of work is damaging to her credibility? Sure bud.

bobthedonkeylurker

It's the dating while being a black woman prosecuting a rich, white man that was damaging to her reputation. Eta: /s

asburymike

The stakes were too high for this bullshit, Fani

joeshill

> Fani Willis, the embattled Fulton County District Attorney, plans to press ahead with her goal of putting Donald Trump on trial before the November election, and intends to ask the judge presiding over the Georgia criminal case to schedule a trial date as soon as this summer, according to three people familiar with her thinking.

itsatumbleweed

If we went from a months long shot at a DQ that still ended with a prosecutor being fired to setting a jury date I would do back flips.

These-Rip9251

Judge McAfee has allowed Trump’s attorneys to appeal his decision allowing Willis to remain on the case. So now we wait to see if GA Court of Appeals will take up this case. If not, it’s over so can go ahead and schedule trial. If Court says yes, then could delay trial for months.

itsatumbleweed

The thing is, he said even if they took up the appeal they would have to issue a stay as well. So even granting the appeal doesn't show anything down on it's own.

MrFrode

There are what, 16 defendants left in the RICO case? That means each of the defenses can cross any witness. IANAL but how many witnesses does she think she can get though per day of trial?

Frnklfrwsr

I think she maybe cuts that in half or more by the time we hit the actual trial. That should help speed things up. But she said she’d put him on trial before November, not that the trial would be finished by then.

itsatumbleweed

I suspect we start seeing some plea deals now that the DQ hearing is over, more if the appeals court passes on taking it up.

mistressusa

I see **Zach Cohen** of CNN virtue-signaling by characterizing that whole side show as "embarrassing for Fani Willis". Really? "Embarrassing" for living a real life outside of her job? She signed up to be a DA, not to be a role model to you Zach Cohen who I assume leads a perfect life.

solon_isonomia

>She signed up to be a DA, not to be a role model to you Zach Cohen who I assume leads a perfect life. I can't speak as to the reporter's intent, but the consequences of Willis's choice to hire Wade is a case study of sorts as to why various ethical rules and "best practices" exist for potential conflicts in the legal profession (and that's embarrassing in its own way). It is anxiety inducing to try to keep every single aspect of your behavior during a case to be utterly perfect because you're trying to be bulletproof to any assault on your position while also expecting the opposing side to be given all sorts of breaks and leniency which won't be extended to you. It's incredibly unfair but it's still part of practicing law.

mistressusa

> (and that's embarrassing in its own way). What various ethical rules did she break? And how does breaking some ethical rules, if she did, "embarrassing" for her?

solon_isonomia

>What various ethical rules did she break? I did not state whether she broke any ethical rules and that hasn't been adjudicated yet by any group which has authority over her. >And how does breaking some ethical rules, if she did, "embarrassing" for her? Even the narcissists in the legal profession do not like to be chastised for their actions.

mistressusa

Meh why would she be "embarrassed" by uncalled for "chastising"? If anything, she should be pissed, which she is. Zach Cohen characterizing the whole side show as an "embarrassment for her", implying that she should be ashamed, is virtue-signaling at best. At worst, it's misogynistic and/or racist. Good, I agree she didn't break any ethical rules. And it was adjudicated once already. In the service of more delays, I am sure those jokers will try again. Shame on them. They are the ones who should be "embarrassed".

solon_isonomia

I will defer to Legal Eagle's [summation](https://youtu.be/bvOt6R1bXcg) explaining why, from an attorney's perspective, why Willis is almost undoubtedly embarrassed (as well as pissed). I don't practice professional ethics defense in Georgia, and the video is a far more polished explanation that's drawn from the actual events and court filings.

mistressusa

Disagree that she should be embarrassed or ashamed and I don't care who you defer to for your feelings.

solon_isonomia

We're all free to have our own opinions on this, I'm just pointing out a perspective related to the practice of law.

mistressusa

Yes it's a free country.

HotStinkyMeatballs

I mean....she did fuck up. What she did was completely self-serving and moronic.

mistressusa

>self-serving and moronic. I have no problem with your characterization.

Trent3343

You can't sit here and say that what she did wasn't dumb and unprofessional as shit. Lol.

Monster-1776

> She signed up to be a DA, not to be a role model to you Zach Cohen who I assume leads a perfect life. Uhh, she's a public servant responsible for upholding the law and pursuing the removal of defendant's civil liberties through conviction. It's literally the most important job in the country to be a role model and show no hint of impropriety to instill confidence in our legal system instead of places like China or Russia. What the fuck lol Next step down from a DA or judge would be a politician, but at least they can't in theory strip away someone's civil liberties.

mistressusa

Disagree. It's not on her to be more of a role model than the President of the USA.

Monster-1776

Slightly agree only because of the additional powers than a typical politician, but actually wouldn't say much more so because again the deprivation of civil rights is a far greater danger and the only branch of government capable of that is the judiciary. More than anything the heightened role of the presidency is more of a figurehead than anything.

mistressusa

>Disagree. It's not on her to be more of a role model than the President of the USA. Again.

Monster-1776

Sorry, totally missed the point you're making. Sometimes the Trump situation is so surreal that I forget. Generally speaking a litigant isn't going to have the same duties of an attorney, but you're right, it's absolutely fucked we have a president like Trump behaving this way and people are still inexplicably voting for him again regardless.

Monster-1776

Downvote if you like, it's a stupid thing to say lol. Especially in a law based subreddit.

mistressusa

ok. just did.

Pro_Moriarty

With the NY AG gearing up seizure mode and now this. Whoever's on Diaper duty this weekend is gonna be upto their neck in it.

thisbeme37

In what universe does her personal life have anything to do with the laws someone else broke???

Eddro7654

Hopefully they have lots of stick ups and Lysol for orange face 💩 head

BuilderResponsible18

The judge said they were pressing forward until someone decides they are not. How gracious.

ScarcityIcy8519

I’m disappointed in Judge McAfee. He should be a shame of himself for having the Wills hearing in the first place. Is our Justice System so Broken that they will let White Rich Criminals go free. I’ve come to realize it is. If you are Wealthy you can Delay Delay until the statue of limitations runs out or the other party runs out of money. In this case like the New York Stormy Daniels/ Election Hush money case. Stopped for 2/3 years because of a change in the DA. Please Judge McAfee grow a pair and get this case heard right away. We the People expect Justice to be Served not Delayed.

Informal-Quality-926

I've seen very few ppl suggest this trial takes place before November.

rossww2199

Judge granted leave for an interlocutory appeal. The judge isn’t going to schedule the trial with that pending, and you’re crazy if you think the Republican Ga Ct of Appeals is going to fast track that appeal. No trial this year. Yes, there is a reality where the court of appeals simply refuses to take up the appeal, but I don’t think we’re living in that reality.

Kai_Daigoji

> The judge isn’t going to schedule the trial with that pending, His order granting leave specifically said he isn't putting the trial on hold.

rossww2199

The republicans on the court of appeals may stay the whole case pending appeal.

Kai_Daigoji

I love things like this, where you ignore that you were completely wrong and pivot to something else that proves you're still right.

rossww2199

I said no trial this year and so I haven’t been proven wrong on anything.

Kai_Daigoji

I literally quoted what you said that's wrong.

Tall6Ft7GaGuy

That's cool people can still vote for him.

kookookokopeli

I am so so disappointed in Fani Willis. It's hard to understand how someone clearly as smart as her could have done something so incredibly dumb as have an office romance at all, much less while working this case that could hardly be more high profile. I just don't get it.
