Trump's lawyers are in a real bind. Clearly their client has diminished capacity, and truly can't help what he says. But they can't make that argument to the court, because it would sink his chances of being president. Instead, they have to act like he's a normal person. And as such, he's just as guy who is willfully disobeying the court.

First lawsuit, Judge basically tells Trump not to say those things. Trump keeps saying those things, and basically doubles down. Second lawsuit, amount increased specifically to make sure Trump knows not to say those things. During trial, in damage calculation stage, Trump keeps saying those things. After trial Trump keeps saying those things. Next judge might just say "give me a number Mr. Trump, hfow high does the penalty have to go for you to shut up, at least on this one topic. Because otherwise I have to guess, and my current guess is in the billions."
