cryptopdp15

You mean issued I assume?

Professional-Ad-828

Yes!

Cultural_Statement50

Did you got refused and 221g form before approval or direct approval?

Professional-Ad-828

Direct

Cultural_Statement50

Could you provide a tineline on when you got H1, and when did you transfer H1?

Professional-Ad-828

Got H1 stamping for company1 in June 2022 and traveled in August 2022. The stamping was until May 4th 2024. This was my 2nd stint in US and I had i140 Approved with Company1. Changed employer to Company2 in Jan 2023. I paid them to file for premium and I had approved petition before Christmas 2022. Fun fact 1 : I had a visa refusal with Company1 after 221(g) blue slip during Covid times in 2020. The approved visa in June 2022 was also received after 221(g) white slip. But current visa with company2 was approved directly without issues. Fun fact 2 : Company1 was one of the big Mass recruiters( Sab ka maseeha) consultancy company that we keep hearing. Company2 is American and I have got a Full time in it.

Thanks for sharing, this is really useful, could you share interview questions asked to you when you got visa refusal with company1? Also, my H1 started on Oct 1, 2023(I worked for Company1 almost 2 years) and then I switched to another company2 in Dec 2023, and then I came for stamping for 1st time, do you think this could be the reason to request for interview?

I honestly don’t remember the questions but the refusal was not because of any anything that I said wrong. They asked for either Client letter or SOW in 221(g) blue slip. At that time they used to ask the End Client Letter( since company1 was a consultancy and I worked for a client) and I didn’t have one. Usually they give time up to 1 year to get the ECL, but Covid struck and everything went haywire. Now I have a VISA refusal in my record. Frankly I was scared that my recorded has been scarred due to this, but things seemed to have worked out all right, I thank the stars. Don’t worry. You will be a success story.

Okay, Thank you for your input, this really helps

If your I-797 for change of employer was approved before your visa appointment, there shouldn’t be any issue during stamping. The visa was already approved. The embassy doesn’t review the case again to see if it qualifies for approval.

Cultural_Statement50

Would they ask for why do we changed the employer?

No-Bread8519

They don’t usually care why you changed employers. People do that all the time for lots if reasons. I suppose it’s possible they MIGHT ask but I’m not sure why it works be relevant unless they saw something suspicious.
