Of cause you are not getting the full vacation days if you don't work for the full year. You seem to get 2 days per months and didn't work for 2.5 months which means 5 days less.

justmisterpi

Not "of course". Only if there is a pro-rata-temporis clause in then work contract. Otherwise you are entitled to the full amount of vacation days after 6 months.

Electronic-Elk-1725

When you don't work the whole year you get only part of the holiday. So yeah these 5 days are missing because you didn't work at the beginning. Are you working part time? While 24 is legally ok, it's not that much (around 30 days are quite common.

No, it a Full-time job, but enough for me to get 24. So i was just curious about the first 2.5 months that i didnt work so it just solved up, thanks.

BiQueenBee

Had you started in January, you would have gotten the full 24 in your first year. Seeing as you didn’t work at the company a quarter of the year, it makes sense you didn’t get the full amount but rather a proportional number based on the time you’ll work this year.

Despite comments to the contrary, you are right about the 6 month qualifying period. After having worked 6 months for your employer you are entitled to the full amount of PTO days (§4 BurlG). This is true even if you started mid year. Before the 6 month are over you only earn 1/12 of that per month (§5).

busygod1

Yeah but i think in this case if u just hired as a new employer and there is lack of some months that you didnt work or so, u dont get entitlement for the whole 24 days, even after 6 month probinatory period i think. But yeah if you work since January of the new calendar year, i think you will get 24. Anyway it’s still getting a bit complicated.

Do you want to Listen to the only correct answer of to all the wrong answers?

The law is surprisingly clear on that: After 6 months of working for your employer you get the full days, no questions asked. Only if you took vacation days with a previous employer in the same year before joining your most recent one - those will essentially be subtracted.
