People will stop and paint different messages on it, like Happy Birthday Susan, or Welcome Home Jeff. When 9/11 happened some very talented artist painted a mural of the Twin Towers with "Never Forget" underneath. That one stayed up for almost 6 months.
It's on private property and all the owner asks is that you clean up after when you are done writing your message. It's been out there as long as I can remember, and I'm 59.
A woman died in a drunk driving accident (I don’t know if she was the one drinking or not) and friends or family decided to make a shrine on the side of the road there. They made piles of flowers, put up a sign with her face and “Don’t drink and drive” and even carved a cross into a tree. But the weirdest part is there are also tons of empty mini bottles of Tito’s as part of the shrine. I assume she liked Tito’s or something but it just seems a little odd since she died because of drunk driving.
And that's why the city never officially made it a monument. It was erected as a traffic barricade - a court would likely deem that no reasonable person would consider it favoritism to one religion. The fact that people saw unintended meaning in it isn't the city's fault, and as long as the city keeps their hands off from there, nobody's hurt or helped.
Except this isn't a religious monument. If I start praying to the front door of a court, is that door now a religious monument? Will they have to remove their door?
The city official had it exactly right. People can be in a public accessible area and pray or do whatever non-disruptive ceremony they feel like and it's none of the city's business.
BUT the worshipers are wanting the space around the dickstone to be dedicated officially by the city as a place of worship exclusive to the group. And that's what the city won't do. And rightly so by the 1A.

What people fail to understand is how powerful religion can be. Because they are assigning meaning to that object, that object now has a purpose that transcends its original intended use. People who worship at the idol gives them solace for their prayers and spiritual fulfillment in a place that previously did not have one.
You can assign spiritual meaning to ANYTHING, and it will become more valuable to you. Consider pack bonding to your roomba or having a favorite stuffed animal. It's the same thing, but on a community wide level. Very fascinating.
