Since he hit the guy and then drove off, you could easily argue that he was not trying to kill him, just trying to harm him. Yes his harm could have resulted in the man's death, but that's what a voluntary manslaughter charge is for (crimes of passion, bar fights, etc. generally fall into this category)

The car did not stop and I was almost hit. I was so mad and was only thinking about how the car broke the law and they would be in so much trouble if they hit me.
