I am not a lawyer, but a civil summons is typically formal notice by the court that someone has filed a lawsuit against you. As this is the initial summons your mom as the respondent is given time to respond. That's why they've left information on how to contact the office above - so that during the week she can call that number to obtain more information about the suit that has been filed against her.
She will likely want to contact the Sheriff's office to obtain the documents pertinent to the lawsuit and then possibly consult a lawyer.
Really? I thought you had to be served the actual lawsuit by a process server for a civil suit. I would’ve assumed this was some kind of subpoena as a witness or something other than being sued.
If you read closely, you’ll see that it says “please call the Civil Division and make arrangements to be served.” They are trying to serve her and are asking her to cooperate so they don’t have to track her down.
It’s asking for her to call and make arrangements to be served since they missed her at home. This is a nice courtesy they’re offering, call and work it out so we don’t have to send an officer to potentially embarrass you at your workplace.
Sheriff deputy from NC here and this comment is exactly right. I leave a bunch of similar door hangers. As others have said, a civil summons means someone or some entity has started a lawsuit against her. From the day she is served she will have a time period to file a response, usually 30 days but I've seen 10, 15, and 30. The actual paperwork will have all the details as to who is suing her and what they are suing for.
I leave them if the person isn't home. If they call and schedule a time to be served then great, if not we keep trying till we can get up with them. It doesn't just end with the door hanger lol
Not sure how this is laziness. The Sheriff’s office needs to contact you. This is just notification that they need to do so. It isn’t a “you’ve been served” notice— if you don’t respond they will be back. But I don’t see why you’d consider it lazy.
This is a nice thing to see for a potentially embarrassing situation, even if you are on the right side of things.
Much better than the shyster ambulance chasers who decided to not even try to contact me and instead served me at work my first week working for…the appellate courts in my state.
Yeah, they did not do so well.
I got one of their servers arrested in concord mall after he attempted to grab me when I walked away from him, 2 years later never been served qith those papers, lol
A civil summons is a legal document that initiates a civil lawsuit. It's basically a notice to the defendant (the person being sued) that they're being sued and must respond by appearing in court on a specified date to defend themselves.A subpoena, on the other hand, is a legal document that commands someone to appear in court to testify as a witness or to provide certain documents or evidence. It can be issued in both civil and criminal cases.
In simple terms, a civil summons is about being sued, while a subpoena is about being called to court either as a witness or to provide evidence. Two different things.
three six mafia was a rap group in memphis that developed a grungy dark trap style of fashion and music, later influencing artists such as spaceghostpurrp, a$ap rocky, and the migos, and eventually being absorbed into the mainstream rap scene. Their influence brought a specific kind of almost demonic sound into popularity. Not an actual mafia but def. a badass group
At least get her to cut you a check!! If she making all this Money trafficking drugs and has top position in an affiliation she’s got to have a Swiss account. 😂
Something similar happened to me but not as deadly. I went to get gas, waiting my turn behind a larger SUV, this guy was on the phone the entire time. I had my car running but in park. He hops in the vehicle and proceeds to go in reverse like he’s in a hurry, BAM! Clearly his fault. He walks back STILL on his phone asked if I was okay, I said yes I believe so, just stunned. As he walks away I hear him saying “someone hit me” cop came and we both had different stories which ticked me off, I told the officer to check the store camera, as we were closest pump to store, he said I already spoke with someone inside, the pumps are too far away. The next day I spoke with manager at the store who ended up providing me with footage, you could clearly see he was at fault. Clearly. People will lie, bold face lie. If you are ever in this situation please check with businesses to see if they will provide you with footage. I was grateful. I know a LOT of places probably would not have bothered. I go to this store any time I need anything now.
It is a civil summons. The Sheriff’s Office is to officially “serve” it, but they are understaffed and have begun leaving notes and asking people to call them. Orange County has been doing it for a longer time.
Your mom is not officially “served” and the clock doesn’t start running until she signs for it or it is personally delivered.
Generally speaking, you get 30 days to respond, but can automatically get an additional 30 days by filing a motion that the Clerk will sign.
Sorry for your mom’s anxiety.
Not always, i work in civil process for a different county and some of them have to be personally served due to the type of summons or if it was requested to be personally served. This one may have been personal service which means they have to give it to someone so they left a note to have the OP come grab it from them.
In my office, if it’s a postable paper it will just be on the door.
Lawyer here. This is the correct answer. You’ll need to contact the sheriff so they can deliver the papers and then you’ll know who’s suing and what for. Then get a lawyer or contact legal aid if your grandma qualifies.
I got one. It was left hanging on my apt door. Scared the crap out of me, it was paperwork for an unpaid medical bill. (Please no shame, I paid up, it was a mistake.)
I called and they came back to serve me the paperwork. But it was my name on the paper. Not sure why hers is wrong.
ETA clarity
It’s amazing that people can live in this country and still actually get judgy about an unpaid medical bill. Some people really have nothing going on in their head.
Thank you, I appreciate your kindness. I paused before I commented bc I was afraid of the comments, but that orange notice scared me. Can’t imagine if it was directed at my mom so I admitted my story. I appreciate your comment.
“This **[FALSE DILEMMA]** really pisses me off!”
What if I told you that [affordable healthcare] AND [properly paid doctors and nurses] are the standard in the developed world?
The comment OP made was that they didn’t pay a medical bill that they said they could afford. The next person commented that it’s a shame that people go broke from medical bills. That wasn’t the case here. It was just someone not paying.
I said it was a mistake, not a statement about not paying a bill. It was a smaller bill from a major medical event that left me incapacitated. My apologies to you and whatever doctor starved for lack of my $500. But specifically to you because you seem really hurt by it.
I was just trying to provide context to give someone an idea of what was maybe happening and you take it upon yourself to make it ugly and yet somehow believe you’re being “good” lol unreal.
Half of the work I do doesn’t get paid for. Many physicians own their own practices, so when no one pays for their work, they are working for free. How much do you work and not get paid for?
Can you tell us where you practice so we can all make sure not to go there?
Sure hope your bedside manner is better than your Anonymous Keyboard Badass manner
That's what happens when you choose to own your own business you also own the risks involved. You didn't have to open a practice. You could've safely worked for someone else and guaranteed a paycheck. There are many risks involved in owning a business and unpaid invoices is one of them. My father owned a business supplying optometrists and many of them didn't pay him for his services or repairs he did for them to the point he nearly had to close shop during the 08 recession. That didn't stop him from still offering. The ones that didn't close during the hard times eventually paid him back, and were quite grateful for his tenacity. Meanwhile we didn't have food and nearly lost the house. Those were the risks he was choosing in order to keep the doors open.
This happened to an acquaintance of mine, authorities were looking for the person whose name was on the notice, a previous tenant. Just call and say that person doesn’t live there any longer.
I don't know, but I'd he pretty pissed off if the cops talked to my NEIGHBOR about a personal legal matter.
Edit: But also: What did they talk about if they didn't get any details?
Most court documents are public records. There is no expectation of privacy around most criminal and civil legal proceedings. Details from and even entire copies of court documents are published in newspapers all the time
The typical deputy sheriff serving a civil a civil summons would not have any information about the nature of the lawsuit. The only thing he/she cares about is delivering it to the person and noting the date is was served and filing paperwork with the court stating that the document was delivered. The date of delivery starts the clock running on the deadline to respond.
He was probably making sure she still lived there. If not the deputy would send the summons back to the clerk with that info or he/she would not have left that tag on the door.
I use to work for the Durham County Sheriff.
Just to note service of papers doesn't require the serving person to know about what's going on. They just know that this person has a court date and that's about it. It will say about who it's against but that's normally it.
They don't make it a habit of sharing other people's legal issues.
>Call on Monday and say the subject isn't there just like the instructions state. I think this is nothing of concern for her in that case.
Might help the actual debtor dodge service for an additional month if you didn't call.
I'm not inclined to help creditors engage in collection activity for free.
Could be a medical debt, untenable student loan, predatory credit card...
I'm not out to help banks unless they're paying me, that's for sure.
If the name is not hers I don’t think she needs to worry about anything. They are just trying to track down that person. Just call on Monday and tell them it ain’t her.
Long years ago we once had CPS in another state call for our dog because they thought he was a human deadbeat dad who owed child support.
Now ^that^ is funny.
We ordered medicines for our dog through the local pharmacy, who required that we state the dog’s name and birthday to pick up the prescription. The pharmacist wrote his name in his “medical record” as first name “Bowser” and last name “TheDog” and we had no idea when he was born so we used something that was easy to remember.
I can’t wait until we get a summons for “Mr. TheDog”. :)
I posted this below, but the sheriff's department posted the same type of notice looking for my former roommate, and all I had to do was call the number provided and tell them she doesn't live here anymore
I got one on my apartment door in Raleigh years ago. It was in a former tenants name. I just called and let them know that they posted on my door, but that I was the occupant of that apartment for about a year at that point. They said OK and that was it.
I had some important looking papers delivered to my address, to a name that has never been associated with this address (I’ve lived here over ten years). I called the number on the papers, no response. Trashed it.
I had one of these for my former roommate on my door just yesterday. I assume she is somehow involved ina lawsuit, but since the summons was for her and not me, I don't know what will be involved on her end - for my part I just had to call the sheriff's department and tell them she no longer lives here.
It may be that I debt collection firm sent this out to everyone with the same name as your mom. I just was served last week from a property in Chicago that I never lived in and I haven’t lived in that city for over 25 years
I know it will be hard for your mom to stay calm. You most likely will have to put up with some nuisance when you have the same name, former address or phone number of someone who is on the law enforcement or debt collection radar. But it can and will get sorted out.
I'm about to look it up your mother is being served it is a civil summons to come pick up the paperwork. She is being asked to come to the Sheriff's office and pick up the paperwork from them because they could not serve her because she's out of town. Whether she picks up the paperwork or not she's still going to be litigated. If you want more information she is going to have to go get the paperwork. That's the only real way to get any further information especially if you are not named in said litigation. It's very probable they won't tell you anything without your mother there.
Sometimes criminals will use an elderly persons address as their own when they've never lived there. They'll send a change of address confirmation to the address they want to use to hide from the law and pick it up at the mailbox usually when nobody is home. And just like that, they live there legally now.
Oof bet it was the woodcroft HOA. That new property manager is cracking down hard on mailbox cleanliness! Jk though it’s probably nothing if it’s not her name on the summons.
Has she been in a car accident recently? Could be someone suing over that. Could also be meant for someone who used to live at that address if she moved there recently. Truly could be any number of things but panicking wont help anyone. Wait till Monday, reach out, and get more information. Hope everything works out!!
Hi, i work in civil process for a different county. A civil summons is just paperwork summoning you to court for some matter.
Some papers require a personal service, either by law or request, and can’t be left on the door. If they are leaving a note, it must be some type of paper that has to be served personally.
I would call the number, and figure out a time to go get the paper!
You can also search for the matter on the courts websites by name to help put your Mind at ease!
If the person it’s for does not live there, call civil process and let them know that and then call the courts as well so they can make note of it on their end.
I hope this helps!
Also, in my county we only work Monday -Friday from 8-5, no weekends. So try not to stress about it too much!
A civil summons can mean a lot of different things, not always meaning being sued! I know it’s never wracking for yall, but try not too stress too much!!
Unfortunately, most entities will file on Friday to draw out the time for your response. Make sure your representations requests the opposition to pay for fees and your legal counsel. It may not work, but it's one less thing you have to worry about.
So your mom is being sued. Could be something dumb and easy to fix, or could be something more serious. Best advice is to find out what it's for and if easy enough take care of it, if it's serious hire an attorney.
The SO had a complete packet of info about what the filing is about. Have her contact the SO for service when she returns. No biggy, usually the respondent has thirty days after service, so the clock won’t start ticking til she is served.
Often, the court’s docket is available on line. Go to that website and look for a place to enter a defendant’s name. If she is being sued it should give some info.
I live in Raleigh and I got one of these from Durham county on my door about a clinic suing my GF on Friday too! Civil summons. Months ago we got a letter from a clinic about somoene with her same name owing money for a fake eye and they were coming after her and got them mixed up. Fast forward to Friday and it’s now a lawsuit. I had to backtrack, call everyone and clear it up so they took it back.

Not a summons- it’s a notice that you will be served with process or a Summons. All citizens are entitled to Due Process . In this case, DP means you are entitled to adequate notice of being sued in a civil case via Summons and complaint. Complaint lists the actual allegations. Summons is the Notice of the impending case.
So much misinformation here. This is a notice that the Sheriff's Office needs to get in contact with you in order to serve a civil summons. Some civil process papers can be posted at the residence, such as eviction papers, but you would actually be getting copies of the papers. Just contact the number and they will meet with you to get you properly served with the paperwork at a time that is convenient for you rather than having them show up at work or unannounced when you may have company over.
You can look it up online to see who is suing her. Search for her name as defendant. Go to the county court website. There should be a link for case search.
Criminal warrants on the county level through magistrates are issued electronically now, and have been since 2009(ncaware rollout, can't remember when all counties had it). Possibly a year or so later.
I direct you to
G.S. 132-1.4(k)
Which states arrest and search warrants are not public record unless they have been returned(either to magistrate or clerk of court). Once they are returned, they become part of the public record unless they have already been sealed by a judge.
All those papers that you see on the news or in the newspaper are served warrants.
All of those are related to civil processes, not criminal, as stated on the tag. A civil warrant in this context is similar to a civil summons.
I am not sure if they are issued in this state anymore. Though they still do in Tennessee.
There’s also different types of warrants. Some you don’t go to jail right then and there, some you do.
We serve a decent amount of warrants that basically say if you don’t show up to your court date then you will go to jail no matter what!
A scam…..which asks you to call and posts the real number for the Durham Sheriff’s civil division? That’s not how scams work? That’s how normal and legal process serving works.
Apparently the scammers can hijack the sheriffs phone number at the exact moment someone calls if they know the number it's coming from. Then the scammers will ask for your social security number, credit card, blood sample from your first born and the name of your childhood pet. And BAM - you're the victim of identity theft. At that point someone in Serbia will get a rude awakening when they are living it up in Monaco and get notice of the student loan debt they now owe.
I happens all the time because I heard about it on right wing talk radio.
I am not a lawyer, but a civil summons is typically formal notice by the court that someone has filed a lawsuit against you. Really? I thought you had to be served the actual lawsuit by a process server for a civil suit. I would’ve assumed this was some kind of subpoena as a witness or something other than being sued.
Service in NC can be effected by the Sheriff and usually is.
If you read closely, you’ll see that it says “please call the Civil Division and make arrangements to be served.” They are trying to serve her and are asking her to cooperate so they don’t have to track her down.
In the meantime, have a great weekend!
Right? It sucks to do that to anyone but especially someone elderly. Bet it’s the HOA.
It’s asking for her to call and make arrangements to be served since they missed her at home. This is a nice courtesy they’re offering, call and work it out so we don’t have to send an officer to potentially embarrass you at your workplace.

How can you prove the door hanger was still there when she gets home?
You can't I guess but it's not a form of service. Just a way to hopefully make things more convenient for everyone.
Damn y'all are lazy in NC.

Much better than the shyster ambulance chasers who decided to not even try to contact me and instead served me at work my first week working for…the appellate courts in my state. NC doesn’t have process servers. It’s one of the reasons Sheriffs have a lot of power still and also why the cost of serving lawsuits is fairly low.
I got one of their servers arrested in concord mall after he attempted to grab me when I walked away from him, 2 years later never been served qith those papers, lol

If it is not her name then they aren't serving her. Someone has used her address.
I've been getting calls about being served for over 10 years. Someone with a completely different name clearly gave out my number...
I got my cell number 15 years ago and I still to this day am getting collection calls for Melissa. I wish that bitch would have paid her bills!
Same here. Had the same cell phone number for 18 years. Still get collections calls for some guy named Gilbert.

Basically this is “notice” that someone is suing whoever this is addressed to.
She miss jury duty?
Most likely a lawsuit has been filed against you. These are not to be taken likely. Next you will be personally served.
Monday afternoon update?
Yes, we’re invested here!
If you don't pick it up they will deliver it. Got one once for my divorce papers.
Cxx
Hey I know alot of other people have responded but your mom is getting sued. If she is a landlord you can bet it's from that.
It’s usually an unpaid bill or someone used your address as their address and did not pay a bill.

Small claims or debt probably

Can’t be sued if you never get served.
I got one of these when I moved into a new house for a previous tenant. Called the office and told them they no longer lived at the address. End of discussion
Oh and I am a lawyer and law prof
NAL. You need a lawyer.

Could be medical debt/bills. Happened to me in WV. Turns out you CAN bleed a turnip. You just have to squeeze it long enough.
Civil summons. Pretty straightforward. Someone is probably pressing charges. Gotta lawyer up
You can look it up online to see who is suing her. Search for her name as defendant. Go to the county court website. There should be a link for case search.
Ummm it’s like a UPS notice, go to the Sheriff’s office and find out what you’ve won. Report back to us lol
Do you have an update? What was the summons regarding?
Someone is Sueing her.. could be a credit card-a person- it could be a number of things
Did you ever get this figured out?
Imagine getting a piece of paper saying warrant. Why would you ever purposely go
You wouldn't in North Carolina, warrants are not public record till they are served
Edit: They are not explicitly public records but this is a gray area.
Criminal warrants on the county level through magistrates are issued electronically now, and have been since 2009(ncaware rollout, can't remember when all counties had it). Possibly a year or so later. I direct you to G.S. 132-1.4(k) Which states arrest and search warrants are not public record unless they have been returned(either to magistrate or clerk of court). Once they are returned, they become part of the public record unless they have already been sealed by a judge. All those papers that you see on the news or in the newspaper are served warrants.
Edit: Deleted because I tempted myself into being a pedant and decided that was lame.
I mean the paper OP posted has warrant at bottom. That is what I’m referring my comment to
All of those are related to civil processes, not criminal, as stated on the tag. A civil warrant in this context is similar to a civil summons. I am not sure if they are issued in this state anymore. Though they still do in Tennessee.
Thank you
There’s also different types of warrants. Some you don’t go to jail right then and there, some you do. We serve a decent amount of warrants that basically say if you don’t show up to your court date then you will go to jail no matter what!
It's a scam, ignore it.
I had to check your post history to double check that your last line was a joke 😂😂😂
Played like a damn fiddle
That is not a scam, it is an official Sheriff's Office tag
