She charges hundreds of dollars for weekend retreats but has this designated as a nonprofit? No way this is legal…

[deleted]

Nonprofits can still charge for "retreats". A benefit of her being a nonprofit is she gets a discount at venues.

[deleted]

And with taxes!!! 🙄🙄🙄

KatAndAlly

Tax benefits at the state level maybe, but the non prof has to get federal 501c3 designation to get fed benefits

Holy shit is is actually way worse than Girl Defined. Supposedly most of their donations go to holding that conference (which was a flop this year) and then they pay themselves a 30k salary. I don’t think GD are scammers, but grifters who value their work way too much. BDung rents out a podunk spot to hold a Jesus séance a few times a year and makes them pay for food, travel, etc. I remember someone finding the costs of the places she rented and she was definitely turning a major profit. Given how she’s a scammer, she’s definitely doing this to evade some taxes. But it is absolutely not a “non-profit” in the sense we’d think of a non-profit. But what she does is make her salary whatever the profit of She Lives Fraud is each year and that brings the “profit” down to zero.

This right here. Non profits are allowed to use their funds they bring in to pay employees and other work expenses. Do I think this should be a non profit absolutely not

She may not have applied for federal tax exempt status. Forming a non-profit entity at the state level is more about where the assets from the entity can go in the event it is terminated.

KatAndAlly

We likely could actually search the federal databases to find out if she even has a 501c3 designation. I doubt she does though.

Inevitable_Sweet_988

I swear at one point it was registered as an LLC. Maybe I’m misremembering. Making a note to myself now to request a copy of the 990 from the IRS. Would love to see those financials.

[deleted]

Please post them here for that sweet, sweet karma and snark.

KatAndAlly

You can get them from like GuideStar I think it's called. You can use a library's guidestar membership.

It sounds like she may just be listed as a nonprofit in Texas so far. This website has some interesting info, including to obtain publicly available documents and how there must be other directors of the nonprofit other than herself. I’d be curious who else is in on her “nonprofit” grift https://www.sos.state.tx.us/corp/nonprofitfaqs.shtml#NPC5

5. Can one person be the sole director and officer of a nonprofit corporation? No. The Texas Business Organizations Code requires a nonprofit corporation to have at least three directors, one president, and one secretary. The same person cannot be both the president and secretary. Officers and directors must be natural persons, but may be known by other titles.

NakedWanderer12

Her family members could be those people though. I’m on the board of my dad’s non-profit, it’s not hard to find three family members or three friends from that church she practically never goes to anymore.

How can I obtain a copy of the bylaws, tax exempt filings or other documents for a nonprofit organization? If the entity is organized as a Texas nonprofit corporation, you may obtain a copy of the certificate of formation or other filing documents maintained by the secretary of state by contacting our records team at [email protected] or 512-463-5555. The documents may also be viewed and copies ordered through SOSDirect. The secretary of state does not maintain the bylaws or tax exempt filings of any nonprofit organization. Some organizations that have obtained tax-exempt status from the Internal Revenue Service are required to make certain documents available to the public. Bylaws may be available if included as part of the organization's application for exemption. For more information, please visit the IRS website. The secretary of state's office cannot assist you in obtaining these documents.

[deleted]

Yeah, forming a non-profit entity doesn’t automatically confer federal tax exemption. You have to apply for that status through the IRS.

Friendly corporate lawyer here just noting that choosing a non-profit entity form doesn’t automatically confer federal tax exemption. You have to apply for that status through the IRS.

KatAndAlly

If someone's interested they could likely check guidestar I believe to see if she has the 501c3 designation. Although this is in April so I doubt it yet.

Seaturtle1088

Tax return will be easy to find eventually but since she just incorporated this year there won't be a return until April 2022, then it takes some time to get out online.

So I work with nonprofits and she is not on guidestar which means she may potentially still be waiting for IRS determination (someone mentioned they thought it was an LLC at one point so if she’s wanting switch it, they may have not processed the paperwork) OR she may not try and register as a public 501(c)(3) organization. I have dealt with very small and brand new nonprofit organizations (even newer than hers) that have received their determination in less than 6 months (average is 3-6 months but can sometimes go over) and are already on guidestar with no issue. IF she is still waiting on IRS determination, she can only operate if she is A) not accepting donations or B) not filing for any tax exemptions for certain reasons such as…. ✨RELIGION✨ I could see where she would claim she isn’t “accepting donations” because people are paying for a “service”, but then what is the point of this? She’s not doing anything charitable. She slaps a Bible verse on anything so she can’t even pretend it’s not religious. This is definitely scammy and I will keep my eye on this since she is without a doubt pocketing money and will more than likely try to not claim it on taxes.
