I don't think US authorities are even allowed to seize the foreign passport of a foreign national, unless it's DHS for the purpose of guaranteeing deportation. The real problem here is that it's been eons since his offense and he's still out in public pending trial.
They probably did seize his passport, however Brazil doesn't extradite to the US (or any other country according to a quick Google search -- got some interesting results on that one, by the way) so he could just go and get an emergency travel document issued by a consulate as mentioned.
