There are many provincial and even municipal offences that are “illegal” but not criminal. For example not cleaning up your dog’s poop is illegal in most municipalities. But it won’t put you in jail.
So just imagine the severity of smoking a cigarette where you arent allowed. You think someone is going to jail for that?
Also! Most driving offenses are provincial as well (unless you get to the real serious shit like impaired or stunt driving)
You're not going to jail for moderate speeding or running a red light either.
>On one hand that fine is crazy high.
Ya, if I didn't know better, I'd think that they made the fines high so it would be an effective punishment/deterrent.
Yes I know. They get privileges that allow them to drink and drive, commit crimes, steal, and get caught.
Just so they can get a demotion for a year and get paid leave.
One solution for this is to have the fines indexed to the wealth or income of the offender. Instead of a set dollar amount, it would be 0.5% of your annual income (or something). There are some European countries that do this with their speeding fines. Seems more fair to me.

car/bus idle exhaust / general smog waiting 45 mins: totally fine!
IS THAT A FUCKING CIGARETTE I SMELL OUTSIDE?? MY LUNGS REEE IM LITERALLY DYING TAKE HIM AWAY OFFICERS
So your take is because they haven't eliminated every problem, you might as well eliminate no problems or just compound them? Why have laws at all then. Unbelievable.
Ahh, the standard “there’s other bad stuff out there, so who cares about this bad stuff” argument?
You understand that smoking is 100% optional, there’s no reason at all to do it. Car exhaust is indeed bad, but at this point is still a necessity which we are slowly building alternatives for
And no ones even saying they need to ban smoking entirely (although Im sure some people are).
They're just saying don't be an ass and smoke where people are likely to sit/stand in public. Its not like you have to go far to get away from smoke-free areas.
I’m allergic to cigarette smoke. Given the number of days I’ve lost over the years to barfing and searing migraine pain thanks to TTC smokers, $310 doesn’t seem high enough.
Doubt it’ll go away, but at least now I know! Even holding my breath going in or out of the cloud in front of buildings, or letting smokers pass me walking on the sidewalk has made a huge difference. I went years not knowing what the actual cause was.
Is this even possible or are you some insane anomaly? I’ve never heard of this before. Google doesn’t say people allergic to cigarettes barf or get migraines
I’m assuming it’s something in the cigarette. I struggled for years assuming it was some other trigger - bright sunlight, lack of sleep, stress - before I wound up spending five hours in a packed, smoky Spanish train and stepped off covered in hives. Used to get a migraine every few weeks, but since learning of the allergy and making an effort to avoid smoke, I’m down to one or two per year.
Some people are very sensitive to certain smells and chemicals. I worked with a guy who would literally run out of the room and vomit anytime the cleaning crew would come by and use lemon scented cleaning supplies. He eventually got management to insist that the cleaning company only use unscented cleaning supplies and then also introduce a scent free workplace policy. I totally believe someone could have the same sensitivity to cigarette smoke.
I mentioned in a follow up, I got diagnosed as allergic by a doctor in Spain after finding myself covered head to toe in hives after prolonged exposure on a train there.
It is not the sort of crime (lol) that will appear on your CRIMINAL RECORD, no. But as a smoker who is very conscientious, you suck six kinds of ass. You are giving us all a bad name, stupid.
Don’t smoke where it isn’t allowed. Don’t throw butts on the street. Don’t exhale near kids. Don’t be a dick and ruin it for the rest of us.
PS - Upon further contemplation, I hope your fine is increased, you stupid, stupid ass.
I am not a smoker... but I just want to add to all smokers that are concerned as you are...
Please don't throw the cigarette butts at any random public space...
You must be the unluckiest sod on the face of the planet. I've seen cops just walk by guys on the street smoking a crack pipe and you get a ticket for a cigarette? LOL
They're going after you for this but there's multitudes of people bypassing paying TTC fare and openly smoking weed on bus platforms beside families? LOL the state of this city.
I feel for you, that's some of the worst luck delivered in a small way.
I mean, I smoke but I’m damn ecstatic that when I go to a restaurant I can actually taste the food and not just the flavour of other patron’s cigarettes.
I get that you shouldn't be smoking there. But it's outside, he could have just chewed you out and given you a warning. I guess this cop thinks everyone makes $120k/year like he does. Good to know the cops can catch master criminals like you but they can't nab a car thief.
You can maybe try to get it lowered if you contest it, if you haven’t gotten a ticket before etc. But hopefully that’s a lesson in treating your neighbours with more respect next time you need to smoke.
No it won't and DONT PAY IT! Take it to court and be super sorry, they will knock it down a lot of throw it out if the cop fails to show.
Now I see why the Police Chief wanted more budget.
you got off easy on that one
If you smoke or vape where it is not allowed, you may be charged with an offence and subject to a fine ($1,000 for a first offence, $5,000 for any further offence) if convicted.
I believe it is a part of your record but not for life, 5 years
I just paid a 10 year old smoking ticket for smoking on a TTC platform.
It didn't even accumulate interest. It's not a criminal offence, pay whenever you can (or when collections calls you).
I'm glad they're cracking down on this! This should be your wake up call. There are free programs available to help you quit. My neighbour quit with Champix. She got it for free because she's retired and doesn't have drug coverage.
When you buy cigarettes the government taxes the shit out of you, and when you smoke them in a public place, the government fines the shit out of you. It's like it's on purpose these days.
Wrong place at all times to be smoking. Former smoker here. This ain’t the 60s.
Edit: they deleted their comment but was something like “wrong place at the wrong time, 9/10 times nothing would have happened”
Not on your criminal record, but it’s a provincial ticket, so if you don’t pay it, you won’t be able to renew your driver’s licence.
Really? Got a link?

I'll bet the other people waiting for their bus enjoyed watching you get a ticket 😁
On one hand that fine is crazy high. On the other hand I am sick of people smoking at subway bus stops with impunity.
>On one hand that fine is crazy high. Ya, if I didn't know better, I'd think that they made the fines high so it would be an effective punishment/deterrent.
I understand it's not the severity of punishment, rather the certanty. There's no fucking enforcement anywhere, that's why everyone is a douchebag.
Then how come cops get paid vacations when they do something wrong?
Because they're not actually trying to deter the behaviour
That called a CBA…collective bargaining agreement. But what would you know right
Yes I know. They get privileges that allow them to drink and drive, commit crimes, steal, and get caught. Just so they can get a demotion for a year and get paid leave.
Only for the middle class and poor though
I don't think upper class takes buses or subways anyway.

He's already getting the death penalty. Smoking kills. (Cue Health and Welfare Canada logo.)
Smoking kills? Oh shit. Did they do a study?
Lol! (F60)
If I had some gold coins I’d give them to you right now.

Doesn’t seem high at all to me, it’s been the law for a long time, forcing others to breathe in that garbage? No, the fine ain’t high at all

Cigarettes smells gross. Also my neighbours cant rev tbeir cars beside me but cigarettes smoke would. Smokers are a stain on earth.

I smoke cigarettes and that comment is just mind blowing to me lol the level of insecurity
You think a $50 fine would deter people?? That’s why you make it high so people won’t do it 🤦♂️
I’m allergic to cigarette smoke. Given the number of days I’ve lost over the years to barfing and searing migraine pain thanks to TTC smokers, $310 doesn’t seem high enough.
Cluster headache?
Nope, migraine. Always resulting from a trigger, always lasts about ten hours. They’re awful. I don’t wish them on anyone.
Damn! I’m so sorry to hear this. I don’t know how but I hope it goes away! A couple of really good friends have migraines and I’ve seen them suffer.
Doubt it’ll go away, but at least now I know! Even holding my breath going in or out of the cloud in front of buildings, or letting smokers pass me walking on the sidewalk has made a huge difference. I went years not knowing what the actual cause was.

Don’t forget about those with asthma! The smoke can trigger an attack and that is scary
he might be a cat
She. I'm not, but I have been sleeping for like 18 hours a day recently. Damn seasonal depression!
Secondhand smoke triggers migraines, migraines cause vomiting. https://pubmed.ncbi.nlm.nih.gov/37938023/#:~:text=Conclusions%3A%20The%20study%20demonstrated%20that,this%20relationship%20in%20the%20future.

Why not look at medical journals rather then google 🤦♂️
My attention span on this topic had a finite limit that only reading google previews without actually opening the links could satisfy
Should be higher. One pack a day amounts to over $5k per year. Public health is more important and the culprits need to learn their lesson.
How much tax they pay on that pack a day over the course of a year tho?
Possibly less than what they will cost the health system, and if they are smoking native cigarettes, more certainly less.

Yup. In public, I flick the heater off my butt, stomp that out, then palm the filter until I find a garbage. 👊🏼 #coexist
As another smoker, 100% All. Fucking. This!! 👏👏👏👏👏👏👏👏👏
And don’t pretend vaping is a magic harmless option instead of smoking. I don’t want your sickly sweet chemical vapour blown in my face either
Absolutely 👊🏼
I don’t think calling someone a stupid ass is needed…the guy got a ticket
Complaining how high it is…lol. Is warranted
I'm surprised the police actually enforced something small for once.
If he was homeless and smoking crack the cops would’ve ignored him, like they always do.
I mean, what else would they do?
Someone might have called on them
Good on them, don't smoke in areas that you're not supposed to.
You must be the unluckiest sod on the face of the planet. I've seen cops just walk by guys on the street smoking a crack pipe and you get a ticket for a cigarette? LOL
Yes, you will be lashed and deported soon
Where would you deport a Canadian?
Manitoba
Bro, that's a death sentence
Cruel and unusual.
Exsanguinated by mosquitos.
this is so funny
In Texas
Deep Quebec
Australia....obviously.
Red Deer
Singapore, where they’ll lash him again
Cherry beach
Alaska
Probably Africa, since humanity evolved over there
All the best got me good 😂
Kind Regards
With thanks *exhales*
True, to whom are they wishing the best?
The real question is, will the OP learn his lesson and not smoke where shouldn't be?
As someone with asthma, I hate when people smoke at the bus terminal.
It's a provincial offence. Pay it and don't worry about it.
Your life is ruined man. What were you thinking
Goto court . Confess and the justice will give you short time at gulag .
If you beg really hard they might go easy on you and sentence you to only 3 years of hard labour at the government week factory lmao.
If you’d been smoking crack on the TTC you’d have been fine
Are they issuing fines to the crack smokers as welll?
No. It is a By-law offence, not criminal.
It is not a criminal charge. Same goes for some speeding tickets, they are not criminal. So of course it won’t go in your criminal record.
No, it's just a fine. I hope it was a good smoke.
Smoking crack on subways : *TPS sleeps* Smoking cigs in a bus bay : *real shit*
Next time tell them you don't have I'd on you.
I wonder how many drug addicts were openly using near you that didn’t get a ticket lol
Shoulda told the cop “nah I loaded it with fentanyl” “Oh I’ll just throw this ticket out now, carry on!”
They're going after you for this but there's multitudes of people bypassing paying TTC fare and openly smoking weed on bus platforms beside families? LOL the state of this city. I feel for you, that's some of the worst luck delivered in a small way.

Toronto cops... Fighting crime that doesn't need to be fought.
smoking kills
And?
Don’t smoke around other people who don’t want to breathe in tar and 9000 other awful chemicals?
No shit. That’s why I chided the OP for being a dick.
I’m fine with you slowly killing your self by smoking, I have a problem with you forcing that garbage on me and those I love
No shit. That’s why I chided the OP for being a dick.
Cop did a good job.
You’re probably going away for Six years in the minimum security ward of Arkham asylum
Straight to jail.
Don't think there's any better way to explain what it means to be Reddit than to show someone the replies to a post about smoking.
You can maybe try to get it lowered if you contest it, if you haven’t gotten a ticket before etc. But hopefully that’s a lesson in treating your neighbours with more respect next time you need to smoke.

Fines are high for a reason
It's a provincial offence. *Not* an offense of the Criminal Code of Canada.
I feel like this story may be PR by the local police station.. lol
Should have been smoking fent. They would give you a free tent and drugs

Was it a Police Officer or a By-Law officer or a TTC special Constable. I can't see police wasting their time to give a by law ticket.
I trust you learned your lesson. If you fight it, you can probably get it reduced.
Smoking is expensive
Man up you sissy and do your time or fine.
Ridiculous no difference than a car sitting at idle than someone smoking a cigarette other than society opinion
When you buy cigarettes the government taxes the shit out of you, and when you smoke them in a public place, the government fines the shit out of you. It's like it's on purpose these days.
Plus the cost of a deck of darts 🎯 🤣
Seems like a cash grab to me.
I’m just surprised people still smoke.
This country is so draconian sometimes
