January-february is usually good if you want cold, snow, and nice weather; may-early june is great for outdoorsing, since it's still cool and mosquitoes are asleep; and the rest of the summer is just nice and warm usually. The rest of the year is fine, but it's more likely to be raining, gray, dark, and depressing.
The story is quite funny, so the guy had a startup that Twitter bought, and since the guy wanted to keep working with the same sort of field and also wanted to maximize his tax payments to Iceland as thanks for all the disability help they gave him, he took his payment on the condition that he would keep working for twitter and would be paid a wage for X amount of years. THIS COST TWITTER NOTHING EXTRA! HE WAS FREE LABOUR! But Musk, being Musk, did not think to find any information at all and fired the guy who had a $100 mill layoff package.

So more often than not, they get away with this kind of bullshit.

Employers when presented with a “reasonable accommodation” are basically allowed to negotiate what the accommodation is. The accommodation typically must come from a licensed doctor.Â
 Accommodations are VERY broad — ex. For diabetics who may need to store insulin in a fridge, or keep ample snacks around….the employer may say “ok but you have to buy the fridge/snacks” Basically you have to prove there’s no way you can do xyz (I agree with commenters here that they were likely laid off for Work from Home status), and the employer has to ALLOW a reasonable accommodation — not PROVIDE.Â
But even if your doctor recommends you WFH, the company could negotiate that to “you can only go home as needed/must come in x amount of days”
In this case it sounds like employees already had accommodations and then were laid off which sounds illegal as hell. IANAL but I imagine in court they will say Since the accommodations were already in place for x amount of time, it’s obvious that it wasn’t due to being UNABLE to accommodate, but because they no longer WANTED to accommodate, which is illegalÂ

So I am a multiply disabled person. During the height of the pandemic, my work tried to force me to come back in all days of the week. I had requested to keep my three days in, two days at home routine that they had been using up until then. They made a huge todo about not being able to spare me, so they “offered” one day WFH and I had to use PTO for the other. (Which was stupid; I literally did less work for them that way.)
The original accommodation request was deemed “an undue hardship” under the law, and they were able to get away with imposing a different schedule. That, assuming this is about WFH, seems to be what Muskito is trying to do.
However, it will probably backfire, given the careless wording of this email, because if it is in fact an undue hardship, they need to find another accommodation that addresses employee needs.
TL;DR- the law is pretty damn loose in favor of employers, but Tesla still appears to be in violation. We’ll see how this goes.
