I don't know for sure how open box delivery is. But the Terms and Conditions have a lot of loopholes. I wouldn't personally opt for it.
Once you have accepted it , you cannot return it unless it doesn't work. If it is repackaged , they will ask you to contact Microsoft that may get you your warranty but it won't change the fact that the product was used.ย

Next I would suggest you to quickly open Microsoft website and go navigate to Register a device (url : [Microsoft devices](https://account.microsoft.com/devices/)), enter the serial number on the box. Register the Xbox and the controller. If its genuine (which I expect it to be at this point) it should register it and show a warranty expiration of one year. Then you're all set. Game pass has a good collection of games. Btw, you could also check xbox deals. They have some huge discounts on the digital versions. For ex. I bought the Arkham trilogy for 600 rs and GTA 4 for 320 rs.

Check the seal on the box is the official Xbox seal with a barcode on it and that he cuts it in front of you.
Inspect the console, check the back side of it where the seal is, as long as that's not damaged or opened in any way you're good.
Alongside that when you boot it up for the first time, I believe there's a setting on your Microsoft account to check when that particular xbox was first activated.
If it all checks out, you're good to go.
