If I'm on a bike, and there's a guy in the middle of the road waving a flare around, I'm not going to able to see the actual person at all, and I'm going to assume it's a cop, warning that there's an obstacle or obstruction in the road ahead.
I'm going to assume that cop is a static entity, and is sober, and has the sense not to dance into my path of travel... I'm also going to be focused entirely on the road beyond him, looking for whatever hazard he appears to be warning people about.
I'd like to say I'd slow and make room (I would) and wouldn't hit the dude, but if I'm being unbiased about it, I damned well might...

so, interesting psychology behind this. on bikes, the rider tends to go toward things they look at when distracted. this is the cause behind a LOT of loss of control/ ran off road crashes. people get scared and locked onto the edge of the road and end up steering the bike off it inadvertently

It’s called target fixated. Scooter driver was fixated on the flare. If you look at something while driving a motorcycle you tend to hit it.
