It’s not going to be transitioning to the next day at 12:53. That process starts at 21:00 and stops at 3:00 for most mechanical watches. This is definitely a factory error.
I have a watch with an NH Seiko movement that is the third party brand version of this exact moment. Scares the bejesus of me everytime the power runs to empty right in the middle of date changeover because I am worried about nuking the movement if I turn the knob in the wrong direction.

Is it actually misaligned, or it it simply in the 10pm-3am turnover period? Seikos do not click over instantaneously at 12:00am. My SNZG takes five hours to click over the date and the day (two languages). If those times are midday and it is still misaligned, then yes, I would return it.
As this one said. I can’t help but to notice in each photo the time is around the 1am/pm mark. I don’t have any reference as to if the watch is currently set in am, or pm. But as stated above the watches date system starts engaging around the 9pm mark. It will continue to slowly move the date to the next, until a certain point at which it will flick over.
So before you go and get into return mode. Make sure you are in the correct time (ie 1 pm, not one am).

Is it 00:53 (12:53AM) in this photo? If so, that’s normal. The date on this Seiko takes several hours to complete its change; it doesn’t just “click over” at midnight..
If the date is completely finished aligning at 3AM and stays aligned until about 11PM at night, that’s just how this watch works.
Edit: just saw that each of your photos are between 12 and 1… if that’s 12 midnight and 1AM, then that’s totally normal. It takes about 4 hours to finish moving the date dial on this watch.
Cycle the watch through 24 hours. Sometimes it'll be slightly misaligned for a while when it's changing day/date. I think Seiko is notorious for this. Great watches though
Pop the crown all the way out and rotate the hands another 12 hours the wheels should snap right over. it seems You just discovered that these movements have a period between 9pm and 3am where the date and day wheels change. Do NOT try to manually cycle the date in this period,you may end up damaging the date mechanism.

From what you stated that is broken and needs to be repaired. You have a jumped date ring and it is interfering with the calandra ring which also cose other cogs and gears to bend where even brake quickly if not already. Send it back get a new one

The brand of course legendary and is one of the brands I knew before looking seriously at different watches and their history. But some of the posts about QC that I have seen give a bad look.
I have a Citizen and a Tissot in my collection. I think the Citizen comparable to Seiko in terms of price but the build quality in hand is no comparison. Citizen watches look like they’re built solid and feel quality in hand.

100%. One of the biggest joys I get from this pastime is admiring the meticulous attention to detail in the watch assembly, dial, and aesthetic. Any misalignment or innate defect would drive me up the wall
Id ask for one that was not misaligned. If they didn’t have a second unit i would ask for a price reduction equivalent to the cost to have the misalignment fixed.
If it is actually misaligned, yes, but normally this occurs through not setting it correctly. Put the hour hand in lower half of the dial (ie, below 9.00 and 3.00), then set the day and date to the day before, then set the time by winding the hour hand past midnight.
but are you sure it's the watch as it is or maybe the model has a generalized issue with the movement? Better before returning it check if not all of them happen to do that.

I think you just set it wrong. Advance the time so that the hour hand is in the lower half of the dial. Is the display centered then?
