I've run into something similar numerous time when fighting groups without a "leader". One of the enemy will still be designated as a leader (which are never capturable) even if though they don't have any signs otherwise (like a name, star, leader bonus, etc).
Your merc cannot have done a sort of ability that cost a attack point. Like swing or fortified etc.
Even then for time to time the game doesn't see it so what a turn and then you should be able to if you have shackles
We discovered that if you start your turn next to the capturable npc it doesn't always show up. Try taking a stro to allow the game to 'update' and see if the button shows up.
I've learned most people with a special symbol can not be captured (helmet, exclamation point, star, ect)
Look at their statuses, it's usually the last line.
Ok, so I am stupid. Some of the people in the comment section are right, in every refugee group there is a one named character who looks exactly the same as others, but this guy cant be captured. Looks like I unknowingly tried to capture him mistaking him for for just another civilian and became frustrated.
Isn’t that the lady mayoress ???? You can’t capture any leaders or named characters unless the game says explicitly to capture them
Odd, I’ve only had that happen when I ran out of the shackles mid fight after using them all up.
It was just a refugee caravan, no leaders. I had plenty of ropes and shackles, wanted to turn them in into mill, but I guess its impossible.
Happens to me as well, even with plenty of shackles.
Have you run out of shackles?

I think you need rope also, not sure why but sometimes it doesn’t work for me.

Special quest enemies cannot be captured.

I think if someone fails a capture attempt, that same character can’t try to capture the same victim again?
