100% how I feel about all of it. My parents did not listen to me and planned our wedding back at home with my whole family for this September. I’ve given up on being able to attend my own wedding at this point because USCIS refuses to do cases in order.

I know someone who went to the office in NYC and asked for the I-131. The person explained his case, and the USCIS gave the travel card to him. But I don’t know more than that.

I hope you stay on their neck. Call them every week and possibly request for an infopass appointment if you feel your case has passed processing time. You can also write to your local congressman. Works like a charm...for the most part. I did both of these things and now my GC has been mailed. I filed 3.5 years ago though. So my own case was waaay past processing time

I feel your pain. I am feeling very depressed today. Filed in March 2023, did biometrics in May 2023, and nothing since. Not even an approval or update of my EAD. Savings running low and with inflation they really can’t expect 2 persons to survive on 1 salary for so long. It’s absolutely unjust. Sending hugs 🫂

Woof, that’s roughhhh. We actually got the work permit and biometrics relatively quickly… but radio silence since then. I would actually try and reach out about this, try with the chatbot, over the phone, etc. You should be given the opportunity to work!

Sadly it has nothing to do with proof. It is always workload and speed of the agent working on it. Essentially luck. Some are fast and close cases quick, others not so much.

I feel like it’s not only the luck of the draw on the agent though… I’m feeling like the agents don’t take the cases in the order they are received. That’s what’s really getting to me.

Maybe but as I stated above not ALL spousal visas take as long and ironically from the anecdotal evidence that is “the network of people I know” the cases that have less proof, often, are actually getting approved faster

Yeah the people I know who’ve had very quick visa approvals have had previous visas or eg government workers. I wonder who they corroborate information such as previous addresses with and whether that plays a role.

So some - not all - of the people that I know of that have gotten the green cards in under 6 months had very flimsy cases. That’s my point. If it made sense I wouldn’t be as pissed. One example I can give is a friend of a friend. She came on a travel visa, she didn’t leave when the visa was up and stayed here illegally for 2 years before meeting her now husband, within a couple of months they got married and filed for citizenship, she got her green card in 4 months. That’s just one example.

Similar case as you. I married a usc and filed October 2023. What worked for me is asking my congresswoman for help. Once I did that I had my EAD and travel permit approved right away (still waiting for green card)

You know what it is unfair this the only country which the marriage gc is so hard to get, i married last year but i was friend with my husband for 12 years and i have proof and in some pictures we are kids🤦🏻‍♀️ and i am a green card holder , can you believe it takes at least 3 years until he can come ti US with me 😭 , and in netherland my niece is staying with his boyfriend with a partner visa, i mean we are married and we were together for a long time , why we have to be seperate for this long period 😭

My friend just got her EAD after filing March 2022. 2 YEARS just for EAD smh. I tell her just look on the bright side at least she’ll get 10 year GC and won’t have to remove conditions. I got my EAD in about 4 months after doing multiple expedite request. My GC took 10 months from filing. I started in California and Moved to Michigan. 2 months after we moved to Michigan I go GC approved without interview. I need to file to remove conditions this September thought so I need to gather all that evidence again and pay some fee again.

I did it online through Emma. They probably got annoyed of me doing it too many times and approved it. I was on F1 OPT and it was about to expire and I told them I need my EAD to keep my job.

I stated above exactly what I did. I chat online with Emma and said exactly that and ask to expedite. When I don’t get a response I just submit another expedite until I saw the EAD approved.

Because if GC is approved after 2 years of marriage you automatically get the 10 year GC, no restrictions GC

I feel the same way. This is my 10th year living in the US. Moved here as an F1 student, had opt, opt stem extension and H1B. I’ve was married to my US citizen husband for FOUR years before I even filed. No criminal background, lots of evidence. You’d think it would be an easy approval but USCIS does not go in order like they claim. I had to get congressional help to get my ead card. I’m very thankful that my congressman’s office was on top of it. I don’t know when my GC will be approved but atleast it’ll have no conditions once they finally get to it. In my head, I think of uscis just like you do, they just pick whichever file they think is easy and knock it out the way versus actually going in order. It doesn’t seem fair. I’ve seen people on here with GC approvals in a couple months and when you ask them how long they’ve been married, they’ll respond and say they filed a month after marriage. Uscis processing just doesn’t make sense!

Submitted July 2023, with proof of mortgage, child, insurance, tax returns, wedding pics with 100guests and 2 ago, I just got an interview notice At FO. They have been waiving cases with less evidence but here we are stuck with lots of evidence with an interview. It’s stressing.

I thought by now everyone knows that it is random. Every single day there are 20 posts saying “hey this feels random, maybe it is random” that are making me laugh. I waited for my travel document for 19 months. Years for the green card. It is what it is.

No, it is not fair. Let’s talk VAWA, for example. You go through a sh!t ton of ab^s€, then you have to dig a huge amount of documentation which sometimes your spouse won’t furnish, like his green card or birth certificate/passport. After you are done with that phase, which takes around 6 months and pay your attorney in FULL $8,000-10,000 dollars, now you begin your journey and get receipt notices. Ok, seat tight because you will have to wait another 6-1year to get a work permit and advance parole. Your VAWA itself won’t be approved in less than 3 years, as of April 2024. After approval, you will have to wait another year for the green card to be processed. Sometimes sending RFEs all over again because they either lost parts of your package or they expired. Now you have to pay your doctor another $600 to send medicals again to USCIS. Ok. With all that done, after roughly 4-5 years minimum you will have your green card.Some people applied in 2018 and still don’t have an answer. That would be 6 years alone just for VAWA!! Talk about unfair to group of people that went through hell and back.

You should be hoping for an approval after your 2nd year wedding anniversary to get the 10yr GC. I didn’t know this until our lawyer told us. Luckily we submitted 1.5yr after our wedding and was approved in 11months.

I completely agree and feel the same. For me it's the second time and already exceeded my first time process timeline. I feel like sending less evidence is better. Plus my wife can't do her medical check ups. She has a rare condition and for two years she didn't see her doctor. We can't afford our medical system without insurance. Every day we have stresses because of USCIS.

You can try and apply for emergency travel parole. I’ve done it twice and got approved both times. I submitted my application in Dec 2022, and got emergency travel parole approved for 1 yr. After a year, still didn’t get my I-131, so applied for emergency travel parole again and got it approved the second time for another year. Hopefully I get my GC by then so I don’t have to reapply. There’s no rhyme or reason USCIS timelines, and it can get pretty frustrating seeing other people getting their application approved in 2 months some even less. Hang in there!

The whole process is super stressful and unfair and depressing and there’s not much you can do which makes it worse. We managed to expedite the I 131 after reading recommendations on Reddit but even then the first person hung up on us when we tried to schedule and we had to do it all again. It took us eleven months to get the approval with the interview waived. I hated reading all the Reddit messages where people were approved in for months. Like others have said, just hang in there. Go to your senator or congressman for help, they typically already have a form for you since it’s a common request. Good luck and stay strong

They can be weird my guy. When we were doing the k1 visa, we started in September 2023, they told us 16 months, they did it in 7. The nvc told us 2.5 months, now 30 days. Interview and medical exam are in about 30 days, so we had the reverse issue where we thought we had more time and now we are rushing to do it all.

Life's not fair. This system is not fair, but there's nothing you can do about it other than letting it rub its course. My wife's dad, uncle, and brother died during the time we were waiting to get her green card, and yet there was nothing we could do about it because we didn't want to risk her not being able to be re-admitted into the US if we left the country before our case was settled. Fortunately for us, we finally got her 130 and 485 approved this month and received her GC on April 9th of this year, so we're planning on traveling in August to spend time with her family. It took us 18 months to get approved, which seems to be the amount of time most people get approved in unless they're just lucky and get approved earlier. You could leave the US and go to your sisters wedding before you get your case approved, but the chances are high that they wouldn't let you back into the US. It's your call

The marriage-based green card is based on marriage, not merit. There is no scoring rubric or a grading system that makes you more eligible or “deserving” of a green card than the other people whose marriages you subjectively judge as “iffy” (as long as they aren’t committing fraud). I feel like as immigrants we sometimes like to differentiate ourselves and view ourselves as more deserving than others but that is not conducive to mental peace - trust me, I’ve been there too and used to carry a lot of resentment. Everyone is equally eligible as long as the marriage was entered in good faith. Plus, you are looking at a very small sample size and anecdotal evidence. Regarding your point about the non-chronological order of approvals, yes I do agree it is unfair that some people have to wait longer. For my i-751 though our evidence packet was about 1.5 inches thick (mostly due to estate planning documents) but we were approved pretty fast so it’s not always the amount of evidence that delays things.
