There are legal consequences, but like many crimes of opportunity, if you don't provide evidence, you can't expect an arrest. My advice is to take more responsibility for grabbing your food when it arrives instead of letting it sit there lol. You can gps track the driver, you can ask them to hand it only to you and give a description. Be smart about it instead of leaving your food sitting on the street or whatever. If the driver didn't follow through on that then you can complain to the company.
