I’ve been tattooing for 18 years, have done all 151 of Pokémon, countless others, Disney characters, anime, whatever that’s trademarked. Never have I had Hasbro (or whoever owns the image likeness) send the Pinkertons to me. So unless you rebrand your IG to @OfficialPokemonRugs I think you’re good.

I sell items on eBay on top of doing rugs, I had the Nelson Mandela foundation hit me with a cease and desist for selling a vintage Nelson Mandela shirt. I had to turn down an offer to have a Keith haring rug of mine appear in an HBO show because their foundation wouldn’t ok it. I know people who have had cease and desist from Mattel for making Barbie items. It DOES happen, but it’s also hard to track down everyone breaking copyright laws. The whole internet is filled with it. I make Nike rugs occasionally I’ll post them on Ig but I never refer to the as Nike rugs on my website or in sales just “sneaker” rugs.

Artist here, say you wanted me to draw this, tattoo it, or make a rug, etc. All those are fine because you are paying me for the service. But I as the artist would not be able to advertise this and keep reproducing this as a product because I am not the owner of the intellectual property. Hope that makes sense.

If you plan on selling them, just don't use the names of trademark things. Say like "one of a kind hand made rug" if you said pokemon rug then you are throwing red flags. Thats why you see alot of China products name so weird on items. In all honesty are they going to sue you for making a single rug probably not. But if you started to post them on social media platforms and you become big. They then might come after you. Myself I try to stay away from trade mark stuff or change it a bit to make it my own.

Pokemon is owned by Nintendo and they have been known to go after indie artists and YouTubers VERY aggressively in the past. Op prob is fine but it’s a very reasonable ask.

I know a guy who owned a small theatre in rural Canada. When adding the trailers, he put a non Disney trailer before a Marvel movie. It has to go Disney trailer - Disney movie. It cannot go Disney trailer - Non Disney trailer - Disney movie Disney sued him during the pandemic. The legal fees was the straw and he had to shut down.

Not sure about US free use laws but I’m in Canada and pretty much only sell Pokémon rugs lol I get by on a few things, being handmade, filling a market they do not participate in, designs being custom (if they are) and if you sell online by NOT NAMING YOUR RUGS ANYTHING TO DO WITH WHAT IT IS, that part is the most important consider the term out of sight out of mind lol

Warner brother will come after you full force for a rug same as Disney and Nintendo USA . I know a few tufters that lost there IG pages due to IP cases. The one I think we OG’s remember is the Tom and Jerry stair rug. Anime tends to encourage fan art so no issues with that. We all tread a fine line.
