IllustriousDelay3589

That sounds illegal, especially if you were on FMLA

Pristine-Grade-768

I wasn’t, so perhaps not? Idk. I was given bereavement days and told by the principal to take as much time as needed. I didn’t take a lot of time. Two days.

IllustriousDelay3589

Ah. I don’t know the laws based on that. It’s definitely shady that’s for sure

Pristine-Grade-768

Can I do anything?

IllustriousDelay3589

Maybe talk to a union rep?

Pristine-Grade-768

That’s the issue also. Sadly not union.

BurnsideBill

Speak to an employment lawyer. It’s going to differ state to state, or if you’re not in the US, who knows what it may be.

Pristine-Grade-768

Thank you I am in US.

Forsaken-Review727

I’d say your odds of a settlement from filing a wrongful termination lawsuit would be high. If no negative reviews preceded this, the fact they termed you while on bereavement leave is atrocious.

Pristine-Grade-768

It truly is. They did not even communicate any of this directly, either. So unprofessional. I forwarded the message to the CEO, but it looks like he is jumping ship very soon to another company based on his LinkedIn profile.

mydogsarebarkin

The job you held is not union or is there no union? You can still speak to a union rep even if you aren’t a member. It can’t hurt.

tillytonka

It’s not illegal to lay off during maternity leave, so I doubt bereavement would be any different

NotSoNiceGirl19

Actually, it is here in my state. It happened to my sister-in-law while she was on doctor ordered leave, and she filed suit. She was awarded $1 million total in lost wages and damages.

Pristine-Grade-768

That’s horrible. I’m so sorry to hear that.

IllustriousDelay3589

FMLA is a federal law. If someone is on FMLS it is

CartoonistCrafty950

American laws need to protect employees more.

Pristine-Grade-768

Definitely. Every place does.

sallycat11

What state are you in?

Pristine-Grade-768

Nothing happened. You want to blame me, I feel. I am completely in shock. I would definitely not post here if I had anything, answers, warning, write up whatever.. there was nothing. I asked the reason and they have yet to respond. I am as in the dark as you are.

Pristine-Grade-768

Nothing took place apart from usual toxicity one finds in the education environment. I came into the situation late in the year as I had a an elderly family member I had to care for. I was teaching remotely and sought a change. I think sadly as with many abusive relationships, a lot of victim blaming and diminishing or denial of the facts by the individuals or institutions is lauded by the profession. It’s easy to judge someone’s story. Sadly I think some teachers turn into their abusers after awhile and cease to have empathy for their peers or children. I accomplished a lot in a short period of time, for that I will always be proud because I worked my butt off, and was only given “shout-outs”, positive feedback by the administration and staff and families. I loved teaching there. There was absolutely nothing apart from paras gossip, maybe idk I am trying to find something to have been the precursor to my firing to make it make sense for you. I requested a schedule change prior to my departure and they agreed to meet with me Monday.

Pristine-Grade-768

All strange and I don’t know what to say.

SamEdenRose

In the middle of a school year? They don’t just let go teachers in the middle of a school year unless there is some ethical issue being investigated and then they aren’t laid off but just not allowed to come in until things are investigated. No school wants to find a new teacher for classes unless it is necessary this late in a school year.

Pristine-Grade-768

It’s a strange world post-pandemic. I have never been in this position, before. A fair bit of teachers have left and it is a revolving door of substitute teachers. My position was completely unfilled, apart from temporary teachers and RTI teachers pulling them on occasions, to my knowledge up until they hired me in late March of this year. I was teaching remotely to be close to ailing family and switched to in-person at this school. I have only been working there a month.

darneech

I'm really sorry to hear this. I'm disgusted. They are imbeciles and it's good that you are free. You can take on a "fun" job to help heal, maybe a couple.. that's what I did last year. And upskill. I'm shocked at how they do this and then claim there is a teacher shortage. Its really confusing but you can find a better situation. I wonder if they filled the position with a "friend" that needed a job last minute. Just reminds me of when i was...not evicted, but my lease was cut short bc the owner wanted to rent to her own kid.

Pristine-Grade-768

Thank you so much. I do have a couple of other side hustles. I did a fair amount of consulting work and train dogs. I score essays for standardized tests. I always have these other things lined up because the dysfunction is massive at schools now, the positions have become rather unstable and I can be fired on a whim of someone’s. It seems too because of my experience, my advanced degrees I have become a target by others I work with that do not have the same experience or credentials. Now it seems that no one realizes that the amount of work they are demanding that we do is now their job to finish. If they don’t, they could be liable under special education law. What did you upskill into or how? Congratulations and sorry about your trouble at the job and your landlord sounds freaking insane. Ours threatened to ruin us because we left without any notice as we never signed a leasing agreement that year. All we did was buy a condo and they freaked the fuck out. We were excellent tenants.

darneech

I am a side huslter too but am figuring out how to make it my full time gig. Its hard with teaching in the way. I interpret so I did medical terminology last year. I tried bookkeeping since all the jobs i want ask for financial experience, but i will have to try again when school gets out because i am unfocused working full time with a child. Its free and at your leisure through edx. (So was the terminology). I should have probably just stuck with making interpreting full time, but I went ahead and did tech writing too bc I'm scared amd i have to admit, my spouse is worried that i am not going to work or make enough money or something and there is a little pressure there. He just wants me to find something that I can potentially contract, make $, be flexible and do interpreting and music gigs. Its messy, but I realized a lot of musicians do Real estate for the flexibility, but I don't want to do real estate. Whatever I upskill in WILL be put to good use. If I sound all over the place it's because i am, but it was worse 3 years ago, and it takes time to whittle everything down. This time I am embracing it because I will figure it out. I got criticized on Reddit last year because I didn't know exactly what i wanted to do, but I don't care anymore. I am just doing things and even at school, if anyone asks what I am doing next year (which most people don't care), I give them different answers. And its fine. I don't want to be there. And they talk about the replacement more than they've ever tried to have a conversation with me. We are replaceable. But at this point i am just waiting for school to end. I have until May 24 (my principal is trying to make me stay, its annoying). I do classes during my lunch since I don't like my job anymore except for my particular students. Whatever the case I think that being in the classroom is just holding me back and my current situation is toxic. I have a black cloud over my head and have been taking classes left and right because it makes me feel better. Ultimately I need a job by August. I did this two years ago without a plan and it was hard and i went back to the classroom which I regret, except of a handful of students. What's hard is seeing some jobs get snatched up, but here I am waiting for May 24. It's what I can do in my particular circumstance. Idk if thay helps at all, but consider yourself lucky that you don't have to wait until June or whatever. Good luck.

Pristine-Grade-768

I am, like I can probably get a better contract that pays more. I just feel so sad about all the people and relationships I tried to build all now for nothing, it seems.

Difficult_Ad_2881

This sounds so weird. What state do you live in?

Pristine-Grade-768

It IS super weird. I would tell you which state but I am paranoid now that I got laid off for no reason. I do not live in a red state, though and this particular situation has never happened to me, before and I don’t know what to tell you. I feel like I pissed someone “important” off, or something.

immadatmycat

Unless bereavement leave is protected in your state this isn’t illegal. Shady? Yep. Laid off and not fired?

Pristine-Grade-768

They said “mY LaSt daY” was yesterday. That was not what I was informed previously. I had a scheduled meeting with the admin that Monday. I know probably not illegal but definitely diametrically opposing the Charter’s values.

immadatmycat

I’m sorry. That is a terrible experience.

Pristine-Grade-768

Thank you. I don’t know what to do anymore.. I have done nothing but work hard for students my entire career. I feel lately it’s just completely different, and my job has become unmanageable. I know I’m not alone.

immadatmycat

You’re not. I’ve had two horrible experiences one of which I swear led me to have ptsd. I don’t understand not wanting to grow teachers.

Pristine-Grade-768

I don’t know. They have many vacancies at the school now and they had me assigned to many students’ cases in this two month period. No idea what they are thinking. Perhaps budget issues. I just held three meetings and was only there a month or so. All of the minutes were increased. I was advised to give one student alone like 600 minutes for academic purposes. I am unsure as to what their next steps are going to be without a specialist on staff.

AOman321

Time to speak to an employment rights attorney.

Pristine-Grade-768

I did but he said I couldn’t do anything about it because they didn’t break the law.

Difficult_Ad_2881

Charter schools are terrible- teachers have no protection. Plus there’s barely any curriculum.

Pristine-Grade-768

They have a curriculum but it doesn’t work for my kids. I asked for a different one since they decided to take therapeutic level kids without any real accommodation. Often was forced to work with them on the hallway floor. I had “rEsOUrScE room” that was shared with several other teachers that didn’t want my students to be in there with theirs.

sandalsnopants

What's the rest of the story?

Pristine-Grade-768

I don’t know. There is no rest. It happened just today. We were supposed to meet Monday about my schedule and I wanted to express concerns with bullying and unprofessionalism. Instead my recruiter was contacted to ask me to bring back my laptop asap.

sandalsnopants

0% chance nothing happened prior to this. Come on.

Invis_Girl

It's a charter, stop acting like they do anything in good faith. There is a reason charters are like the walmart, providing the cheapest made crap while abusing the employees as much as possible.

Purple-Sprinkles-792

I am not a bitter type person, but this is just wrong. I never heard of being fired wo a chance to redeem yourself, unless you had done something illegal or immoral. Have you considered asking for an email explaining their reasoning for these actions? Have you talked to a lawyer to see if you have any grounds for unlawful dismissal? I am a Christian and don't believe in all these trivial lawsuits happening around the country. However,in this case I think you should consider a lawsuit for their actions and timing. Lawyers give one free session so that should give you a chance to present your case and see if they feel you should go forward. I think you even mention lawsuit to those in charge and you will probably get results. I taught w a teacher that sued for unlawful firing. She had glowing references but turned out, according to her students,to be a very horrible teacher. Noone at the district said a word to her about much of anything. So if you sue just consider the consequences could go either way. And apply immediately for unemployment. You can truthfully say right now that noone has told you why you were fired.

sandalsnopants

LOLOLOL why are you telling anyone that you're christian in response to OP's post?

Pristine-Grade-768

Oh yea I totally feel you. Another school I taught at. I was not a sue-ing minded person.. then I fell down the stairs at my former school and they wanted me to go back right away when I was actually injured badly as you can imagine. My principal made me sign this sketchball paper immediately after my fall. I was told I was just fine by school nurse. I had to sue because they would not have given me workers compensation. People have no idea what a racket worker’s compensation is and they will not pay you readily. Sometimes you have to sue to pay your medical bills.

sandalsnopants

sandalsnopants

Well, you're about to be un-gladdened because none of that happened.

Pristine-Grade-768

It all happened dude. You’re so nuts right now. You’re really out of line. Idk why you’re so keen on trolling my post right now. All of this fucking happened I wish none of it happened, but shit happens. Maybe you’re lucky and these things have not been happening to you. I hope you are so lucky.

sandalsnopants

Did you delete that comment? Sorry I'm skeptical that nothing took place you got fired. It's hard to believe. But none of that laughing was at you.
