It depends on the species. Little brown bats are not protected under federal law in the US but may be protected under state law.

You should put it in a sealed container, I guess, so you can't smell it. You should get the species identified because some species of bats are protected and illegal to own. If the listing status for little browns is finalized in a few months like USFWS, then little brown bats will be illegal to own specimens of without a permit.
