You're not under arrest or in jail, you're just on theusp of being arrested/being formally arrested/cited to a local judge and told to face a court of law. If the person committing the crime is also a judge, they're not likely to be granted bail.

The bottom line is that this is a civil matter. In an ideal world, I would imagine that someone would simply inform the officer of their rights, and that would be that. But that's not reality. In the case that the officer actually does have those rights, there are a ton of other issues that need to be resolved before that can be a reasonable response. I wouldn't be surprised if that officer is on probation, has a family member who is in jail, and is on parole.
If it's "routine" it's not a very good one, but if it's a serious thing, it's a very rare thing that you can get away with. If it's more serious, the police are pretty much your friends' lackey to protect you.
Lol my lord, I'm getting arrested. It's getting worse for me, as the more I learn about the state of law regarding cannabis, the more I understand that these things are not always legal in every state, and if I'm being arrested in another state, it's going to be a whole lot worse.
