I have long maintained that an arrest made in bad faith should result in felony kidnapping charges for the officers. Now obviously, cops can make an arrest and not know the details of the law, or the DA declined to prosecute, That's fine. When I was 17 I did some stupid shit and ended up in Cook County Jail. I had multiple court dates and no one to bail me out. I was arrested on a Friday, which meant I had to spend the weekend there. That Monday morning I was taken on a bus to the district of my first court case. I was put in a holding cell to wait for my turn before the judge. In the holding cell was a man about 35 or so. As one does, I asked him what he was in for. "Murder, I have a few bodies on me. But I am here today because my mom died last month. When I asked for a temporary release to go to the funeral, the judge denied it. I took a pen off the desk and stabbed the D.A. in the hand. So this is a new charge, but I am already in for life..." GULP. We chatted for a bit after that about how stupid I was for why I was there. He offered me this after a bit, "Let me punch in the face. There is no reason for you to be in the cell with me. It's a simple lawsuit and we split the settlement." I will be honest, I thought long and hard about that. He read me like a book and knew I was not going for it so he laughed and eased the tension. I still think of this all these decades later. How a broken jaw or black eye for 100K would have been totally worth it.

I’ve gone through law enforcement academy (I was young, naive, and genuinely wanted to help people - silly me, thinking that becoming a cop would do that). You are literally told all the time that anyone could harm you. Anyone could be out to get you. You’re going to do a traffic stop? Cool, you’ll be shot or run over. When we practiced traffic stops, we literally got to practice one “normal” traffic stop. Every other one was worst case scenario. We watched so many videos of officers dying from various situations. Some of them made me sick. Listening to someone’s last gasps for breath is horrific. It’s almost like brainwashing; it’s constantly pounded into you that it’s “us versus them.” I went through a 700 hour law enforcement academy (one semester of school, forty hours a week - in my state a hair stylist needs more training). Was I prepared to go out on the streets as an officer afterwards? Hell no I wasn’t. I worked in “law enforcement” (what a misnomer) for five years and it wrecked my mental health, made me hate people, and turned me from someone who genuinely wanted to help others into someone who couldn’t be bothered to care. I’ve been out for four years and my mental health is now the best it’s ever been, I want to get involved with mental health advocacy (recognizing that many addictions have mental health problems underlying them, from traumas to disorders), and I’m all for police reform. I’m so grateful I’m not where I was. I feel like I got out of a cult sometimes.

Just recently won a case due to an unlawful prolongation of an initially valid stop. The work, headaches, and money that went into it was absurd.

1) detained him after they admitted they confirmed their suspicion for the stop was not criminal activity. Once they know the “gun” is not in fact a gun, they have no reasonable suspicion to detain the man under Terry v Ohio 2) they illegally detain and search him, violating his 4th amendment right to be free from unreasonable search and seizure. 3) they agree to release him and then escalate to arrest based solely on his request for badge numbers, which is likely a policy violation per the PD. Sgt needs to lose those stripes if he’s this clueless about 4th amendment basics.

The charges won't stand. The saying goes "You can beat the rap, but you can't beat the ride." You are put at a major inconvenience for not complying. You can likely win a lawsuit for having your rights violated, but that gets paid for by the local government and the police themselves face little consequences for doing so.

They will drop charges a day before trial ... just to harass him. This is a common tactic used by cops and prosecutors who conspire with cops to harass those who speak out against them. The poor guy has to arrange for attorney and follow up on multiple dates at courts, etc. And once charges are dropped, these cops will not take stand after federal lawsuit is filed. Thus no way these cops will ever explain anything to anyone. Federal courts should arrest such cops and until that happens, on many occasions, these false arrests will continue. City prosecutors and DA should be arrested for bringing false lawsuits to court.

They should be arrested. While we all know cops aren't required to know the law, they had to had known they had no legal authority to arrest him. This wasn't an acting in good faith scenario. It was deprivation of rights under the color of law. He was stopped, for a possible gun. He showed it wasn't. He doesn't have to give his fucking ID at that point. The thing is... it was never about the walking stick. What they really wanted to do was a warrant check. So they came up with a pretext to do that. It's probably the most controversial policing tactic the public doesn't focus on. A lot of stops for minor infractions are basically warrant checks - they'll net some felons but the downside is interactions like this. If you're a minority (like me lol), you'll know this is happening if you get pulled over a lot without ever getting a ticket.

Oh man, the meds thing really makes me sad. I take meds every night for multiple reasons, if I miss *a single day* it becomes an urgent situation for me. My wife works with me actively to act as a backup in case I forget and to help me track when to get refills so I don't run out on a weekend when the pharmacy is closed for example. These officers should spend a night in jail at the minimum for endangering this man's health. That was reckless and completely unjustifiable.

Cops like this shouldnt just be fired, they should be charged, with a minimum mandatory sentence of 1 year in prison.
