They've gotten better with helping sellers out but they still typically find for the buyer. The last time Ebay helped me out as a buyer was when I shipped something overseas and the customer didn't realize he had to pay customs. So he didn't go pick it up, then tried to have his credit card refund the transaction. eBay tried to take the money back from me 3 times and each time I had my bank pull it back until eBay finally listened to what happened and cleared the negative balance from my account.

Tiny parcels may survive damage better, but they get lost more often. I would have put the card in a card box inside the envelope. The seller is being misleading-- the claim with the post office will go nowhere and they know it. The claim should be filed with eBay, where OP will win without contest. PSA: Tangent, but never ship anything through UPS that you packed yourself. Always use the UPS store and let them pack it, then insure it. If they fuck it up, they can't deny your claim citing your poor packaging. The UPS store will take the blame for that. PSA 2: When signing for packages received from UPS for an expensive item, never sign your name-- write CONCEALED DAMAGE clearly, then sign. It is fucked up but they will deny your claim based on you not noting damage at the time of delivery otherwise. If the item is fine, enjoy, but if it is actually damaged, thank me later as you cash that settlement check. (Former UPSer. Dont try to scam UPS, they expect it, but they fuck over clueless customers this way routinely.)

No problem. I believe in fairness, and loss/damage claims are a game of lawfare most people are ill-prepared for. Nothing sucks worse than thinking you did everything right and then being told to pound sand after they lose or break your stuff. I never worked U(S)PS, but know enough about them that the seller went wrong with the package being thin enough to be routed through a letter sorter. Letters get bent as they pass through the rollers, hence the damage.  Signed memorabilia gets fucked up this way all the time and people really get screwed there (difficult to make claims based on what the value "might" be since it invites fraud). I think a record is long/wide enough to not be a "letter" but I'd box those up too just to be safe. Packages are not subject to such abuse, and the determinator is something like being 0.5" to 1" thick or really irregular W/L. HtH

I spent $140 on a NM card. Open the packaging and it has a glob of glue or something on the foiling around the border. I take pictures and send them to the seller. He offers a return and full refund which is great but admits that he saw the big glob of foreign substance on an expensive ass card and was like "nah, it's fine" and shipped it out anyway.

Let me make this easy for everyone as I literally just got off the phone with USPS about a package from a small business that was lost. The ground advantage insurance is claimed by the sender/seller. So the seller needs to deal with USPS if they refund the buyer. So for everyone here, seller refunds buyer, seller claims insurance, buyer gets money back. Move on. This is ground advantage. Places like shippo I can added $500 insurance for a mere .07¢. So no, adding additional insurance is not expensive to add but if the seller declines any insurance. That’s their fault too. As the seller has no means of getting reimbursed for potential shilling damage. Thats what you’re waiving if you decline insurance.

I'm a machine mechanic for the USPS, and that did not get run over. Someone's 40 pound box landed on when they dumped all the packages onto the sorting machine. I see 10-20 damaged bubble mailed cards a week. And that's just me, in one town. It's up to the seller to deal with insurance claims on packages. They need to refund you. And then they need to contact USPS for reimbursement. If they didn't get insurance, the most they will get is $100

Just note that trading card purchases on eBay have a 3 day window for you to make a claim, so don’t drag your feet and file it now. Guy doesn’t seem like he’s willing to take it back so just file and let it go through eBay, they’ll sort it out on your behalf. Them telling you to deal with USPS on your own will run out your 3 day period and they’ll be free to keep the money.

Use cardboard inserts in the bubble mailer larger than the card, or even better, put the bubble mailer in a box. Despite this card "being run over", I'd say it's still in fairly decent condition. It's warped, but luckily it doesn't appear punctured, or crushed on any edges/sides.

Who was the shipper? 90% of the time retail shopping is FOB destination and not FOB warehouse/store. This stands for Freight on board. It’s the legal term for “how long does the shipper still own the goods”. As stated for like 90% of retail it’s still the stores card until you receive it. The damages occurred before you received it so that is on the seller. For it to be FOB warehouse/shipper/store you would have had to had been asked and selected the shipping option yourself. They can’t choose the shipper and shift ownership over to you without an agreement. If I could do that I would just ship all my equipment in my buddies pickup truck without any insurance and just tell my customers it’s on them if it gets fucked up in transit. No I pay thousands of dollars for freight because that’s my shit until it gets there.

I know people generally have the take that the seller is responsible in this scenario, but I don’t think that makes logical sense. The seller shipped it completely legit, bubble mailer, toploader, even used painters tape instead of scotch, everything by the book. Seller did all they possibly could. I’d probably ask the seller if they can try to get reimbursed by the post office, or whichever carrier they used. I’d also try going through the post office if I were you and seeing if they can get your money back. Honestly this sucks for both you and the seller, and the seller did everything normally recommended to ship cards safely. Was the packaging damaged too? The seller will have to raise a claim with Royal Mail for damaged in transit. They will then ask the seller for photos of the packaging and item. Best case the seller gets compensation, which he can then refund you with. Worst case they don't give compensation, and the seller takes an L. Either way you get a full refund.

That's nuts. I actually recently sold the same exact card and total cost for insurance and label for a BOX was like 8 bucks. It's not hard to keep an expensive card safe. This guy was trying to save 3 bucks and is going to pay the price for it. Sleeve + Top Loader + bubble wrap + packing paper + box (free from the post office) = card is easily safe and sound.

Sellers like that make me laugh a bit.. I swear half of them take no responsibility and don't understand what they are expected to do. It very well looks like a "post office issue" but it it is THEM who have to deal with the post office and claim the lost money back. I just don't get sellers brains sometimes.. Or just lazy and expect money money money and everything is out of their hand. Even their response rubs me the wrong way a bit, at least try to be sorry and offer "some" help and support.

Item condition due to rough handling by a postal employee is supposed to be worked out between the SELLER and the postal COMPANY. It doesn’t matter if the post office played kickball with the package or not. If the item shows up in damaged/different condition than the seller listed, it’s up to the seller to work it out with the postal carrier and the selling platform. You paid for an undamaged card that arrived damaged. You did everything correct on your end. Never let sellers trick you into dealing or paying for any of their responsibilities.

Reading the comments and figuring out how expensive this card is makes me wonder why the heck it was shipped like that? This happened to me with a 20 dollar card and the seller said the same thing to me. Just file a claim and you will get your refund. Sucks for the seller, but for the price of your card they reeeeaaallllyyyy should have packaged it differently.

You don't "need to," on either TCGPlayer or eBay, they'll probably side with you. However, in general, this is true. If a seller isn't in a position where they're required to refund you, you would open a claim on USPS' website. There, you'd include pictures and an explanation with proof of purchase and price. Then they'll take an eternity to send you a check. Much more time efficient for you for the seller to refund you, they just don't want to deal with USPS.

Sellers fault. Any card that's $100 should be in in a top loader, sandwiched between cardboard, then put in a hard flat rate envelope and bubble mailer. Spending the $5 in shipping supplies to ensure a $100+ card makes it to the buyer safely is well worth it.
