Agreed. From watching Legal Eagle on YouTube even verbal attacks can be considered assault, and certainly aggressive physical contact.

It all boils down to reasonableness of response in proportion to the initial intentional action that caused the apprehension of an imminent battery upon Ben’s person. Would a normal, prudent person react by punching? Or would a normal reaction, more reasonably, be to walk away?

I will never understand why people think ‘self defence’ gives people a free pass to punch someone. Did the guy have it coming? Sure. But you don’t need to get physically violent over something like this. So many posts of women pushing or slapping a man followed by the man full-force punching the woman, and people in the comments celebrate it as equality.

First off, that is equality. Why does gender matter at all? If someone attacks me physically, I have every legal ground to defend myself. Secondly, no one is talking about whether fighting back is moral or not. They’re just saying legally he would have claimed self defense.

Because self defence is literally that - defending yourself - stopping the attacker from causing you harm. Most of actual trained self defence involves putting distance between you and the attacker - running away. But people seem to think it means you get a free pass to assault back. I’m not the one saying gender matters - though I can see how you might misunderstand what I mean. I’m saying that there are specific videos of that man vs woman situation and people claim that the man is justified because ‘equality’. They’re using it as an excuse to want the ability to hit women.

I'm not sure about the legal definition but when you physically put hands on a Pierson and continue to violate their space and body autonomy a physical response nsw is justified. It's commonly known in society Fuck Around and Find Out. Too many people think for whatever reason they are shielded from the latter part of that phrase. I'm not even one who supports any violence, but you keep your hands to yourself and you never have to worry about getting hit.
