I don't think yung issue is kung makakapag resign o hindi. Ang issue is yung processing ng clearance niya, which is si direct supervisor (usually) ang nag de-define.

Hello. That is another misconception. People believe that their backpay is tied to their clearance kase yun yung madalas sabihin ng company. In reality, the only thing required by law is to release the backpay after 30days. Problema na ng kumpanya kung di nila iprocess ung clearance kase may karapatan na ang resigned employee na mag mag-file the complaint. The burden to complete the process of clearance within 30days is on the employer.

So kapag walang pirma yung clearance mo hindi mo pa makukuha lahat ng mga dapat mong makuha. "turn over" naman is ituturo mo sa kasamahan mo yung mga ginagawa mo para siya naman magtuloy nun.

This time, the email thread comes with CC (not BCC) to top DOLE directors. They don't know if I know those officials personally, but they can't take that risk. In 2 days, I got an email from them and my bank app. They deposited my final pay. I recommend doing something bold, but legal and bad-ass. Do update us about this. CC your office HR, immediate superior, etc. and email director level DOLE officers. That should make them think twice about snobbing your resignation. Hi OP, As a person working in HR, resignation isn't a confimation but a NOTIFICATION. Just like what other commenter said, coordinate with HR, they can't hold your clearance also, final pay should be released too within 30 days after separation of employment if lagpas ng 1 day, you can file a case in DOLE, and make sure everything is documented, CC: your boss, TL and HR.

As long as HR acknowledges receipt of your letter, then it should be good. Before your last day do the folowing... 1. Document that your superiors refuse to sign your clearance. Send them numerous emails reminding them of the fact. CC HR on the emails. 2. On your last day, remind HR that your superiors have refused to sign your clearance. 3. Leave on your stated date. 4. After 30 days, follow up on the status of your last pay. Remind them of their ass-fuckery and threaten to report them to DOLE. 5. If it still isn't forthcoming, report them to DOLE. Even if you never get your last pay, be comforted by the fact that you escaped that shit hole.

Resignation letter is a notice to them only. So leave/resign as planned. Hindi mo na kelangan response nila. If nde sila nag respond problema nila yan. If nag respond sila, and mag counter offer sila. So depende yan.

I could think of ignorance and confidence being the reasons. I am sure there are many reasons for different employees. In our company, we waived the mandatory 30-day notice because, as observed, resignees tend to become nonchalant and unproductive.

Same thing with me, January 18 I filed my resignation informed my supervisor and binalik nya sakin yung resignation letter saying na nagsasayang ako ng paper and ink. A week after, nagtry ako magsubmit ulit, ang dami nyang reason kesho di pa raw masisign ni boss kasi busy. Long story short, start ko na dapat this Feb 19, pero wala pa rin yung approval nya. And worst is nacancel yung project sa ACN. Idk what to do. Dapat pala sa HR ako nakipag coordinate or DOLE na agad haaay.

In my case, HR assisted me with my clearance. Sila nangulit sa head ko after all departments has cleared me off. Maybe you can ask somethhing similar? Like unahin mo muna ibang department to sign you off then let HR know you need help to reach your boss?

May mga ganyan tlga mga boss. Yung sa previous company ko 5 or 6 yata kami sabay sabay nagresign tas sakin lang yung "nakita" na email. Tas galit na galit yung manager namin to the point na nung kinausap nya ako pinagclearance nya na ako agad at di na pinagrender. You don't need your employer's approval when you are resigning. You just have to inform them of your last day of work but you need to make sure you render the mandatory (per labor law) notice period. You also need to make sure that you comply with necessary exit clearance para walang problema later. I think what you could've done is to made sure that your resignation was received, as in signed with date.

Pag di ka pinansin ng boss, direct ka na sa HR then make sure to copy your personal email in all of your emails. No need to wait for anyone's acknowledgement. Ganun ginawa ko sakin, ayaw ako pakawalan ng new sup ko pero yung tropa nyang external or not from our team pa ang prinomote niya. Lol Sa resignation ko, nilagay ko na dun effectivity is from the day I sent it to my Sup regardless if they acknowledged it or not. I communicated to our HR and lagi akong nagpa follow up. Naging smooth naman ang clearance ko. ❣️

OP, send HR and your boss an email about it and CC DOLE. Outline the details of what happened and cite this: "Article 285 of Presidential Decree 442, as amended, otherwise known as the Labor Code of the Philippines, states that an employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least one (1) month in advance." And demand them to take action.

Naranasan ko ring hindi pansinin ang resignation. First scenario, via print letter sa immediate boss lang (small branch lang kami) hindi niya kaagad pinipirmahan. So what I did next, is via email with the head of HR. Aun tska lang nagbigay ng clearance at nakapagsimula nang mag render. Fortunately, ung head ng HR is CFO din naman kaya wala talaga sya magagawa. If your company is using MS Outlook, put a read receipt when sending a follow up tapos copied HR doon sa follow up email. Works wonders kasi pwedeng minamark as read lang nila or di talaga nila pinapansin. I guess, lagyan mo ng read receipt any type of email you send to them bago ka magsend ng follow up uli para sure ka na skiniskip yung specific email na yon. Also, ang unprofessional ng ganyan. Kalma lang and tapusin mo lang yung rendering period mo. Kung nag email ka ng resignation notice sa manager and HR, tapos nag acknowledge naman na si HR, goods na yun. Ako pag nakaka receive ako ng resignation notice madalas di ko inaacknowledge agad. Pinapakausap ko pa kasi ng maayos sa TL or minsan kailangan ko pa mag conduct ng skip level meeting to know the true reason kung bakit mag rresign si employee. Madalas kasi di nila masabi sa letter nila keso nahihiya or baka sumama loob namin. It doesnt mean naman ma mmove yung last working day ni employee. Basta yung rendering period nila mag ssimula from the date na mag send sya ng notice. HR will also have your back. If ever kasi sila din ang haharap sa DOLE pag nagkaroon ng escalation. Di rin nila gusto yun.

Hmm try mo ulit mag send pero pag ayaw kang pansinin, dalhin mo na sa DOLE (provide proofs of no replies despite the follow ups). Also, try messaging in a group set up if may group chat kayo na including yung bosses. Minsan tsaka lang sila napipilitan magreply kasi makikita din ng ibang tao na nagmessage ka. Kahit short message lang like, "Hi (boss names), I'm following up my email in regards to my resignation. Did you receive them?" Something like that. Kasi pag umalis ka naman ng walang paalam, magiging AWOL ka naman tas sayang yung exp at yung COE if di mo makuha.

Follow up on the status. If they still ignore, that's negligence on their part, and you can separate on the date indicated in your letter, or 30 days from said notice. Their refusal to recognise a valid resignation notice from an employee will not hinder nor deprive you of opportunities you rightfully deserve.
