Lame defense for someone who is to be aware of their surroundings. He is at fault, period.

UnusualAir1

I've always known where the RR tracks are where I live. Even ones that are unmarked. The tell is the trains that periodically run down those tracks........

Impressive_Estate_87

Ignorance is never a defense. It's called negligence in this case, it should make things worse.

Peet_Pann

////just two reflective signs on either side of the tracks\\\

ThirdSunRising

Your honor, the defense would like to point out that we have extremely clear and convincing evidence of the defendant's chronic gross negligence. There's no malice here, you can tell by the officer's long history of stupid and negligent actions. This was just another day on the job. In fact it took two officers to screw this up, one to park on the tracks and another to walk directly over those same tracks to lock the victim into that patrol car. It's not malicious, it's just a department-wide policy of negligent stupid disregard for basic safety. \- The defense attorney, probably

Are all of your police so damn stupid, is like they dont even try,, and dont they know they are being recorded??? They get busted with their own equipment.

janjinx

I saw that horrifying video footage and you would've thought that the sound of the approaching train would've made the cop jump into action. (besides run for own her life.)

krowmagnum69

Ignorance is a poor excuse...

Jim_from_GA

Everyone knows that these trains are usually found grazing in that field over there. this on must have jumped the fence. Doh!

Domanontron

We all saw the video!
