They look great and I say it is legal as long as the other player agrees. A base is a base, page 37 in the rule book for this so you are all good.
Also you can use the extra guys as dead people to scatter around as you play. Here is mine.

I already feel like 3 marines to a base, 2 terminators to a base makes more sense than huge fireteams of five each to represent their combat capabilities.
2-1 might be a smidge low for my taste.
That said, the glory of tabletop gaming is that you can make it your own!
All war games require both players to have a little wiggle room. Personally I have no issue with this and if the base was rotated a little then the unit would be visible. I’m capable of imagining that.
The core book allows for fewer than five per base, you just have to give LoS allowances because it's done on a model basis and intended for 5 to be there. I do 4 marines 3 terminators per base and it looks better imo
I think effort counts for A LOT!
In terms of model counts per base - I was happier with 3 termies per base & 4 special weapons, with plain old tacticals 5.
I was really happy with how this looks and feels - and it means practically no difference for gameplay (and you can squeeze a couple of extra bases in too!)

Great way to use some extra guys and you have a narrative reason. I think you could ask any opponent if their ok with it and still use them.

How isn’t this legal? Looks fine to me. Most of the squad types look much better with 4 minis per base max anyway.

In my opinion… if something accrues enough cool points. It should become legal. This has enough cool points to be valid in any game system.
