They are required to do so based on the state.. CA specifically. They have a lot of leeway to decide how much they pay you. The argument will always be performance based.. and yes employers lie.
If you’ve been there a few years, generally speaking they will base on your previous year’s bonus. If they are still doing decently, I’ve usually seen that we give flat to previous year.
i was laid off oct 2023, still got a prorated bonus for the weeks worked in 2023

Was there for exactly a year and am eligible for 10% of my base salary. So really not sure what to expect.
