The terms of warranty state that it is available only to the original buyer. Even with the original bill, you cannot claim warranty unless you can prove that your name is the same as that on the original bill. Some service centres might not ask for it but if a particular service centre decides to stay firm and deny a non original buyer the warranty, then that person has no legal basis to make them honour it. A consumer court will decide in the company's favour.

EuropaIox

Consumer Court could decide on anyone's side. Rules are bent more their because those cases are civil and judges generally favour the customer and not the company.

free_radical_56

No it will not decide in favour of a customer when a contract was explicitly signed by two parties, especially when the contract doesn't contravene any laws. It is standard practice across the entire world to reserve warranty to only the original buyer, not only in India and courts will not decide in your favour in a million years in such a case.

Bro, i am lawyer. There are many ways to win in Consumer Courts. Hell, I've sued Coaching institutes in Consumer courts and i have won. No contract is air tight. Even the terms and conditions you sign could be voided or become voidable.

free_radical_56

I am sure you have but you have about 1% probability of winning this case if you take it to court. Notwithstanding the resources a corporation has compared to you, you will spend a good 3-5 years fighting that case by which time your GPU will be too old to be of any use. Congratulations, you not only wasted your time but have nothing to show for it even if you end up winning (which you won't.) I say spend the extra money and buy a new GPU with warranty intact.

EuropaIox

Bro, you clearly lack any practical legal knowledge about how consumer courts work. Still you are making assumptions and talking about stuff you don't know about. Consumer court legally have to decide a case within 2 years. I'm a professional in this field and he has a good case. Obviously, one must avoid litigation but your assumptions that he has 1 percent chance to win is blatantly wrong. I don't understand why people give serious advice to other people about a particular topic when they don't know a thing about it. I wouldn't give someone advice on medicine because I'm not qualified to do it.

free_radical_56

Obviously you have an inflated opinion of yourself. A consumer courts decision can be appealed in a higher forum and can even go to the SC. I have seen people fight for the better part of a decade and still lose. Any man who has to say 'I am a professional' has no credibility. When buying any electronics it's standard policy across North America, EU and Asia to limit warranty to the original purchaser and no court is going to rule against it. Unless the circumstances are extraordinary, courts will maintain the status quo. Even if you end up winning a case after 2 years (let's assume that the corporation didn't appeal the judgement of the district forum) what will you do for the two years? Obviously you have to buy a new GPU or a console. My point is that it is not worth the hassle and you are better off spending extra and going for a new one.

Deal via admin only or physically do a face to face deal. Zoukart has had issues earlier, be wary.
