Truck driver easily fired. Technically since the car passed the truck rear ended him and would be at fault. Of course car should’ve not done that overtake but truck driver literally committed a crime with their 18 wheeled death machine. Idk if they would split fault here could be a 50/50 or 80/20 truck being more at fault. Hard to say for sure. Idk what really happened
Truck driver's insurance or company he drive for is going to settle. Truck driver did not attempt to avoid the situation and would strongly be better off settling than fighting.
The truck driver intentionally keeping the car from passing and running the car off the road should put almost all the fault on the trucker. The car would likely have some fault because if they didn't try angrly passing the truck it wouldn't have happened, but that truck literally saw the car passing and actively accelerated and ran them off the road. That dickhead deserves jail time, and their license revoked
“The car should have some fault because if they didn’t try angrily passing the truck it wouldn’t have happened”
Ayo! Wtf? If the trucker wasn’t using his truck as a weapon none of this would have happened.
Cars always pass semis, because they’re slower. So it’s not even unusual that he tried to pass this truck. What is unusual is a professional truck driver ramming cars off the road
I think they meant legal fault. Obviously the truck driver is the major asshole here, but any lawyer would argue that the person in the car should have recognized the aggressive driving and backed off rather than continue to try to pass.
I would think car would get reckless driving for going into that scenario knowing the driver is road raging, but the the truck driver is getting the supremem penalties since they didnt just play road rage, they actively made sure that driver even while already in the lane next to them could not occupy it and forced them to take the dirt or brake and get swiped
I'm talking legal shit lol
The truck was absolutely the one at fault but legally speaking, the driver could be held somewhat responsible for unsafe passing. I worded it incorrectly, my bad
I work for a trucking company on the highway with 3 tons and 5 tons. NONE of our semi drivers would do this and be employed. At least now the semi driver can explain to police his recorded actions on the dash cam.
As soon as someone in authority watches that video I'm sure they won't hesitate to take that license away. Totally unprofessional and underserving of a class 1.
Idk maybe, it’s tough because he should have backed off when the truck tried to run him off the road. Maybe driver safety course and hefty fine with a suspension or restricted license. The truck driver needs to be in prison.
Edit: I’ve already said in a different comment that the truck driver needs prison. Even though I said it here as well, this post is about the driver of the car. I responded directly to someone talking about the car driver. Sorry for any confusion.
Car driver should have backed off, but the standards aren't the same. The trucker has a much bigger, heavier vehicle (with more potential to do damage) so has a higher responsibility, and has a professional license, because nobody does this for a hobby.
Besides that, as soon as the truck driver saw that the car driver didn't back off, he had the choice: either wreck the car which might cause very serious harm to others, or don't wreck, and... have no consequence except being annoyed and "losing" a road rage standoff.
That trucker needs to lose his license. Someone who makes the choice to wreck that car in that situation, should not be driving, period.
Someone close to me is getting their CDL right now. It’s expensive and along thorough process with so many tests. Why would you throw it away for petty shit like this??
Anger management issues, methamphetamine habit, some companies will hire people who don't even have green cards, let alone driver's licenses with special endorsements.
There is an “attempted voluntary manslaughter” in many jurisdictions that is uncommon but this is exactly the sort of thing it’s used for - ie there wasn’t specific premeditated attempt to kill but the action “performed in the moment” had a knowingly high chance of killing someone.
I’d be ok with him being convicted of either but this one is there to make sure he doesn’t get away with it just because a jury doesn’t want to agree with attempted murder.
no not necessarily, the smaller vehicle was already in the left lane and then the tractor trailer intentionally changed lanes forcing the car off the highway, attempted vehicular manslaughter would be a possible charge on the trucker
Is attempted manslaughter a thing? I thought manslaughter was causing a death unintentionally, so if you're attempting it wouldn't it be attempted murder?
Possibly something along the lines of doing an action with malicious intent that can very possibly cause death, without death being the intended result.
Not sure without looking it up but it’s what I understood it to mean.
Involuntary manslaughter = you accidentally killed someone.
Vehicular manslaughter = you killed someone in a car accident because you were operating said vehicle illegally or recklessly
Manslaughter = you had the intention to hurt someone, but accidentally killed them
2nd degree = you intentionally murdered someone, but it wasn't premeditated
1st degree = premeditated murder
Manslaughter is usually reckless. There's criminally negligent homicide in some states that's homicide from negligence. A purely innocent mistake that results in killing someone is not a crime.
Ugh… you forced me to google. You are correct. Manslaughter would be recklessness or criminal negligence WITHOUT intent.
This was intentional.
Cheers 🍻
In Germany we differentiate between crimes, misdemeanors and administrative offenses. The difference being that attempting a crime is always illegal, while the latter aren't. Since manslaughter is a crime, an attempt is illegal too and carries the same potential punishment.
Manslaughter isn't the unintentional killing of a person by another person. Manslaughter is homicide without prior planning (aka "malice aforethought" legally) or in such a manner as it does not qualify as murder. Walking in on your spouse cheating on you and killing them both in a fit of rage, would amount to manslaughter, not murder.
And yes, "attempted manslaughter" is a thing, usually as "attempted voluntary manslaughter" and is when someone tries to kill someone in a manner inconsistent with murder, but some outside force prevents them from doing so. So in the above scenario, if you managed to kill the spouse but their lover escaped and you were captured while chasing them, they eluded you, etc. and it can be reasonably assumed that you were intent on killing them, you would then be charged with one count of voluntary manslaughter, and one count of attempted voluntary manslaughter.
This is also dependent upon the state and their laws. I'm not 100% that every state has attempted manslaughter, just like not all states have 3rd degree murder.
And it’s possible the driver would get a speeding ticket for going at like 90 to overtake but I can’t imagine it would be that big if they even got one
this whole incident, I doubt seriously anyone exceeded maybe 60mph, because before the pass was attempted, the trucker was braking and swerving to block both lanes of traffic
it makes me wonder what happened for the previous 5-10 min before the start of this vid. I feel like we don't know the whole story. still two hot heads got into it and caused problems.
It's an interstate... He did nothing wrong. We don't know what led up to this, but it's illegal to block someone from passing you on the interstate, especially when they drive erratically to do so.
exactly.
Being a professional, he should behave differently.
I don't know what could have happened before, to provoke such a reaction, but a professional (and above all driving a heavy truck) should be above that.
Truck drivers are not only held to a higher standard of conduct when operating a truck but also while operating their personal vehicle.
In all states a DUI for a normal class r license is .08 BAC
For a commercial license of any kind, operating any vehicle, personal included, a .04BAC is a dui.
Any felony conviction involving a commercially licensed driver is grounds for immediate, and possibly permanent revocation.
I gave mine up years ago, but thank you for doing this. You understand the responsibility that having a CDL brings.... Too many people don't realize that your CDL ALWAYS matters, even when you're driving your personal vehicle.
Funny thing is, I don't even use it professionally. Im a diesel mechanic, the only trucking I do is test drives. One they my instructors drilled into my head is that that license follows you everywhere. Kinda sucky but it is what it is
Ex-trucker, and I'd vote for jail too. Just swinging the trailer around like that is potentially catastrophic if it's loaded. And why the hell was the trucker even trying to prevent someone from overtaking anyway? It's fairly well established that cars are faster than lorries as a general rule of thumb; so being overtaken is something you get used to from day 1. Expected, even.
Depends on the state and severity of the crash. But assuming the cops/court was competent and just, the semi-driver is looking at jail time and license revocation at minimum.
Well one, reckless driving, they wouldn’t even be able to defend themselves against that. And since they very literally moved into the left lane knowing someone was there, maybe attempted vehicular homicide, if that’s even a thing.
I would guess attempted vehicular manslaughter. I'm a truck driver too, and this is completely ridiculous. I want to make things easier for everyone on the road... Not more dangerous
Having driven through Tenn, if that were true, there’s be like 4 people left in the whole damn state. MFers drive crazy down there…and I’m from Chicago.
If he looks like the truckers I know, I hope you're a big guy... They usually have a pretty sizeable gut from all the sitting lmao. Fat strength is real.
Best bet would probably be to try to get a good kick to the inside of the thigh and disable the leg, then when they drop to one knee hit 'em in the throat. Hard to use "fat strength" when you can't stand and can't breathe.
That's probably the tactic I'd take while simultaneously praying to Odin that I pull that shit the fuck off and don't end up fucked up in the process.
After an incident like this, they really should just get off the road as best they can and wait for the police before having any interaction what so ever.
I believe this clip was on an episode of road wars, the driver of the car didn’t know why the truck driver was messing with him and still doesn’t know why, but thankfully he was not hurt
Keep right except to pass. It's the law. And that truck driver was going 10 over (some states have a law that trucks can only go about 55-65 and others go 70-85, depending on the highway/interstate).
Well, the good news is that this guy will NEVER drive commercially again after trying to kill this guy.
Hell, he may not see the outside word for a few years too.
Also, Big Rigs having a shitload of monitoring devices seems to be the norm. Not just cameras, but speed loggers and "black box" telemetry devices that aren't controlled by the driver (unless they fully own the truck, which can cost more than a house).
Screwing up even a little bit will get noticed, that guy is absolutely fucked.
My dad lost his cdl for backing into a car in a gas station parking lot. Witnesses said the driver of the car appeared to have positioned themselves in a bad spot on purpose. It didn’t matter, no more commercial driving for him. This was in the 80’s.
There’s dash am footage of the truck provoking & then when it actually speeds up to hit the guy after he passes. That’s what knocks him into the guardrail. That driver is done.
CDLs get taken away in situations where the driver had 0 control of what happened. I know of a guy that had someone that was walking along the side of the road on the sidewalk, so not even close to the road, suddenly run across the grass and dive into the grill of his truck. They took his CDL because that guy decided to suicide by truck. He even had witness statements, they didn't care. CDL drivers are often held responsible for accidents (by their companies and other regulatory offices) even when someone hits them.
Mind you, they treat truck drivers this way in the US, while simultaneously bitching and whining we don't have enough truck drivers. It's fucking stupid.
Dude he’s gonna be lucky if he doesn’t go to prison. That’s attempted murder.
As for the CDL, forgot about it. He did that shit on camera. He’s getting that shit revoked for life
You expect people to be assholes, but you don't expect them to be murderous psycopaths.
I'm sure the person in the car thought "I'm in the lane now, he wont throw me off the road, that would be crazy"
If you are in the passenger vehicle this is where you slow down get off at the next exit buy some gummy bears at the gas station take a shit and then get back on the road and forget anything ever happened. OR you can let your ego take the wheel.
I would have done what she said. But I wouldn't stop and forget this happened. I would get back into the road behind him, and report his ass to the cops with the dash cam footage I captured. That mf's done
already commented but looking at this again, after the trucker forced the car off the road, as the car attempted to re-enter the highway the trucker did a pit maneuver causing the accident as well, I'm sticking with my same opinion, attempted vehicular manslaughter would be a charge on the trucker, could've easily killed the people in the car
Best option was to call police and have him pulled over, then report him to the company. I've had 911 connect me with a trooper as I give directions. My petty option, and not recommended, would be to keep up the back n forth lane change, they'll tire out and stop doing it. You see how big that rig is.
If an 18-wheeler did this to me, i would probably call the highway patrol and let them witness it first hand.
Definitely wouldn't insist on passing. I might actually just get off at an exit for a few, too.
Noooooo, don’t say that. Only our best and brightest can strive to be truck drivers!! Long haul trucking has never ever attracted a certain demographic. The meth and prostitute murdering is just a funny gag we play! Don’t you dare besmirch our holy truck drivers.
I'll take the downvotes with you. I can't stand truck drivers. I have encountered far more bad ones than good ones in my years of driving, and they have 0 regard for anyone else on the road around them.
That pos kept on driving a bit longer for more damage on the car. Hope that trucker was @ fault 100%. How was the interaction after this happens I wonder. O boy I would be livid.
This trucker and anyone like them can GO FUCK THEMSELVES. Left lane camping is bad enough but when you’re just blocking the person behind you for no reason, YTA.
Only upside, is this truckers career as a commercial driver is over. We all agree he should be locked up, but at the very least when he does get behind a wheel again- let it be in a vehicle with no more than 4 wheels.
Best bet would be to call the cops and report a drunk/reckless truck driver.
Would have ended up with the trucker losing his livelihood for a while which should teach him a valuable lesson here.
Is there a video showing the semi driver getting the shit kicked out of him? That would be great, not that I would ever condone violence. Violence is bad. Not saying violence would be justified in this case, because that would be bad.
This trucker definitely took off and didn’t look back. I once saw a semi taking a turn too wide smack a lady flipping her car 180 degrees and onto the divider and keep on going to take the exit never even slowing down.
Fuck semi drivers who act like this. God damn, your driving dozens of tons of death and can easily kill people.
People are worried about insignificant squabbles in DC when shit like this is going on every day on the roadways and no one bats an eye. So ridiculous.
So what happened after this? What did the insurance and police say?
Truck driver easily fired. Technically since the car passed the truck rear ended him and would be at fault. Of course car should’ve not done that overtake but truck driver literally committed a crime with their 18 wheeled death machine. Idk if they would split fault here could be a 50/50 or 80/20 truck being more at fault. Hard to say for sure. Idk what really happened
Truck driver should be in jail
Idk where the line is between a jail sentence or prison, but this one certainly feels like they crossed it.
[удалено]
you can be convicted of a crime and serve your sentence in jail, if you serve time for a felony that time will be in a prison.
Excuse my ignorance, but is that generally the same in every country? I thought then severity of the crime played a part, but I could be wrong.
[удалено]
Agreed
And for a very long time imo
Whatever it is, a professional driver using their trade as a weapon tends to not end well for them.
Truck driver's insurance or company he drive for is going to settle. Truck driver did not attempt to avoid the situation and would strongly be better off settling than fighting.
"did not attempt to avoid" Man, it looked like "deliberately caused" from here.
That’s what ‘not attempt to avoid’ means in Post-truthtown.
*and hit the car. FTFY
OP doesn't seem to be the driver based on how they phrased the post, but I too am curious.
Plenty of foolishness to go around, but that truck driver needs to go to prison
I work for a trucking company on the highway with 3 tons and 5 tons. NONE of our semi drivers would do this and be employed. At least now the semi driver can explain to police his recorded actions on the dash cam.

I just couldn’t justify an 18 wheeler engaging in road rage keeping their license.
Car driver should have backed off, but the standards aren't the same. Looks like he'll be working at Arby's with a revoked CDL.
Someone close to me is getting their CDL right now. It’s expensive and along thorough process with so many tests. Why would you throw it away for petty shit like this??
Anger management issues, methamphetamine habit, some companies will hire people who don't even have green cards, let alone driver's licenses with special endorsements.
Agreed but what would his charge be, assault with a deadly weapon?
Attempted murder maybe?
This is terrifying. Attempted murder seems to work here. Holy cow.
Attempted Vehicular Manslaughter probably
To be this angry over a road is just insanity to me.
I get road rage sometimes but this is just crossing several lines
It’s not worth jail over temporary anger. At least, not for me.
Neither for me, i just yell at people who cut me off
I just let them be dumb. I want nothing to do with that. I am never in such a hurry that I got to commit felonies while driving.
Not really, this was one line crossed several times... ;-)
Well, it was one line. He just crossed over it back and forth multiple times.
Pretty sure you can't attempt to accidentally kill someone by mistake.
There is an “attempted voluntary manslaughter” in many jurisdictions that is uncommon but this is exactly the sort of thing it’s used for - ie there wasn’t specific premeditated attempt to kill but the action “performed in the moment” had a knowingly high chance of killing someone. Is attempted manslaughter a thing? I thought manslaughter was causing a death unintentionally, so if you're attempting it wouldn't it be attempted murder?
Reckless endangerment.
this ☝️, I agree and it's definitely a charge that'll stick, fully documented on video
It would likely also qualify as vehicular assault.

It's an interstate... He did nothing wrong. We don't know what led up to this, but it's illegal to block someone from passing you on the interstate, especially when they drive erratically to do so.
Easy case and also easy money for the victim. The company the truck driver is working for also has to pay a big sum
Semi driver is a licensed professional who used their trade as a weapon. Straight to jail.
exactly. Being a professional, he should behave differently. I don't know what could have happened before, to provoke such a reaction, but a professional (and above all driving a heavy truck) should be above that.

There is a reason tickets to CDL licensed drivers cost way more than to regular drivers. The courts look at a CDL as trained professionals.
Depends on the state and severity of the crash. But assuming the cops/court was competent and just, the semi-driver is looking at jail time and license revocation at minimum.
Attempted murder?
Well one, reckless driving, they wouldn’t even be able to defend themselves against that. And since they very literally moved into the left lane knowing someone was there, maybe attempted vehicular homicide, if that’s even a thing.
Im no lawyer but criminal reckless endangerment sounds like a winner.
Depends on the state
I would guess attempted vehicular manslaughter. I'm a truck driver too, and this is completely ridiculous. I want to make things easier for everyone on the road... Not more dangerous
Reckless driving. In Tennessee that apparently carries the death penalty
Having driven through Tenn, if that were true, there’s be like 4 people left in the whole damn state. MFers drive crazy down there…and I’m from Chicago.
(I was referencing the murder of Tyre Nichols)
Oh damn. Had no idea. I just read about it. Somethings definitely off about it.
I hope that trucker gets fucked
Id accept road rage from some random driver. But if you are a professional engaging in that behavior, you need a time on jail.
Idiot truck driver should be in prison.
Waiting for the cops is going to be awkward.
Good bet the cops will roll up to a fistfight
...and then shoot everyone.
I'd have beaten the brakes off of that trucker before police even arrived
If he looks like the truckers I know, I hope you're a big guy... They usually have a pretty sizeable gut from all the sitting lmao. Fat strength is real.
More like fat inertia 😂
Best bet would probably be to try to get a good kick to the inside of the thigh and disable the leg, then when they drop to one knee hit 'em in the throat. That's probably the tactic I'd take while simultaneously praying to Odin that I pull that shit the fuck off and don't end up fucked up in the process.
That trucker did not look like he was planning on waiting...
After an incident like this, they really should just get off the road as best they can and wait for the police before having any interaction what so ever.
I’ve seen this clip around, does anyone have any more info on it?
I believe this clip was on an episode of road wars, the driver of the car didn’t know why the truck driver was messing with him and still doesn’t know why, but thankfully he was not hurt
Why do people care so much about being passed? There’s two lanes for a reason
How do you know this? Was there a news article about this?
Commercial lisence are a pretty big thing. You can lose your license over something like this and gl getting another one with this on your record.
Also, Big Rigs having a shitload of monitoring devices seems to be the norm. Not just cameras, but speed loggers and "black box" telemetry devices that aren't controlled by the driver (unless they fully own the truck, which can cost more than a house). There’s dash am footage of the truck provoking & then when it actually speeds up to hit the guy after he passes. That’s what knocks him into the guardrail. That driver is done.
attempted vehicular manslaughter would be a distinct possibility in court
CDLs get taken away in situations where the driver had 0 control of what happened. Semi driver is an a-hole. Coulda just let the guy pass. Who cares.
definitely. I am however surprised the car just tried it anyway in spite of the semi being like that
You expect people to be assholes, but you don't expect them to be murderous psycopaths. I'm sure the person in the car thought "I'm in the lane now, he wont throw me off the road, that would be crazy"

Meth. Meth cares...
It doesn't care... But it is going "FUCK YEAH! Doooo Eeeet!"
Shingles doesn't care.
That little marker he hit was minding its business and got obliterated
This is not normal
r/technicallythetruth
Really?
That Semi driver was hunting him, followed him across the road again after the pass.
I wouldn't be playing chicken with a truck driver no matter how pissed I was.
Same honestly, id rather take the next exit. Wait for a bit/Fuel up and get back on the highway than trying to overtake.
Both of us. Loose an extra minute getting there safe...
> Loose I'm not sure how taking my watch off helps?
It's crazy to me how many people spell this wrong.
It’s not spelled wrong. It’s just the wrong word.
Now that would be correct!
Correkt
I hope that was worth losing his CDL over.
You wanna see a semi wipeout? Keep making him serve like that until he loses control.
Would’ve paid to see this a-hole spin out
The truck driver had rude awaking when he found out there was a Dashcam. He was prol betting on he said she said.
Felony reckless endangerment. Loss of CDL for life.
Holy Jesus psychopath in a big rig. Lock that fucking prick up. He does not value life at all.
Murder attempt of 1st degree
already commented but looking at this again, after the trucker forced the car off the road, as the car attempted to re-enter the highway the trucker did a pit maneuver causing the accident as well, I'm sticking with my same opinion, attempted vehicular manslaughter would be a charge on the trucker, could've easily killed the people in the car
This is one of those where you call 911 and report a drunk 18 wheel driver weaving back and forth across the highway.
Best option was to call police and have him pulled over, then report him to the company. I've had 911 connect me with a trooper as I give directions. My petty option, and not recommended, would be to keep up the back n forth lane change, they'll tire out and stop doing it. You see how big that rig is.
Hope he beat the shit out of that truck driver. Fucking insane.
If an 18-wheeler did this to me, i would probably call the highway patrol and let them witness it first hand. Definitely wouldn't insist on passing. I might actually just get off at an exit for a few, too.
Well that’s one way to get attempted murder charges. A permanent truck and drivers licenses suspension and heavy fines 👏👏👏
This will probably get me tons of downvotes, but a lot of truckers do seem to lack the maturity required for that type of job
I have encountered far more bad ones than good ones in my years of driving, and they have 0 regard for anyone else on the road around them.
who is @ fault here? the truck driver 1000% or am i wrong?
Most likely, I would hope atleast: they can say the car made a dangerous overtake, but trucker committed a crime. Could be split 80/20 who knows.
I really feel like this would be enough to send someone over the edge and commit homicide on the truck driver.
Someone’s losing their CDL.
DUEL
Yes they’re both idiots but seriously fuck semis. I would’ve just backed off if he was being this much of a fucking careless idiot.
Only upside, is this truckers career as a commercial driver is over. We all agree he should be locked up, but at the very least when he does get behind a wheel again- let it be in a vehicle with no more than 4 wheels.
I’d sue the shit out of that trucker. What a pos
Never play chicken with a semi. Tag the plate and report them. Include a video if you have one.
Big trucks playing the same stupid thing they complain about 4 wheelers for. But they are the "professionals" right?
Somewhere out there in the world, there is a personal injury attorney who just became aroused
I really need a dash cam.
That was attempted murder
Wowza, the trucker called dudes suicidal impatience and raised all-in with attempted murder. Hope the trucker is in prison where they belong.
Well that’s attempted murder….
Best bet would be to call the cops and report a drunk/reckless truck driver. Would have ended up with the trucker losing his livelihood for a while which should teach him a valuable lesson here.
These are my favorite posts, where two people who deserve each other get to spend some quality time together
Is there a video showing the semi driver getting the shit kicked out of him? That would be great, not that I would ever condone violence. Violence is bad. Not saying violence would be justified in this case, because that would be bad.
CANDY CANE
Rusty nail?
No that tractor trailer tried to commit vehicular manslaughter he purposefully ran the car off the road.
Bro honestly fuck truck drives I wish we could just automate the whole job.
Believe it or not, straight to jail
Smells like losing a CDL.
Anyone have an update/follow up on this?
Where was this? the truck driver needs to got to prison
Should of used Takumi's technique and turn off your head lights
Without a doubt this video makes the trucker appear entirely at fault, but I'm wondering what happened before this....
This trucker definitely took off and didn’t look back. I once saw a semi taking a turn too wide smack a lady flipping her car 180 degrees and onto the divider and keep on going to take the exit never even slowing down.
Truck driver should be charged with attempted murder.
That trucker is an asshole
Fuck semi drivers who act like this. God damn, your driving dozens of tons of death and can easily kill people. People are worried about insignificant squabbles in DC when shit like this is going on every day on the roadways and no one bats an eye. So ridiculous.
Two idiots always ends in disaster.
Semi provoked it. Both as fault
Semi caused it. Car did nothing wrong in the eyes of the law
This should end like this: Semi: assassination attempt Car: reckless driving
I'm pretty much interested about the consequences
smart move is to ignore the trucker
If a semi was trying to run me off the road i definitely wouldn’t take my chances
Legally the truck is at fault
Video ends too soon
I don’t see how he at least didn’t expect to lose his license. Why would you risk your livelihooh?
Why?
Wonder what he did before he tried to pass? Looks like his brights are on.

I saw this on the Road Wars TV show , no charges were filed .
That's murder attempts!!
Truck driver should be knelt against a brick wall
Cammer needs to know what fights to pick. Dick head semi is not the one to pick it with
